According to what we discussed during the meeting and what you documented in your August 31, 2009 response to the Compliance Advisory, the facility appears to be taking steps toward a return to compliance. Based on our discussion, deficiencies 2, 3 and 5 from the Compliance Advisory appear to have already been remedied. The documentation related to Deficiency 6 is under review by the Department. As for the remaining items, the following schedule was agreed to during the conference. 1. Deficiency 1, Requested Action la: Within sixty (60) calendar days of September 14, 2009, complete regrading of the site and re -orientation of windrows toward the stormwater drainage ditch. This work will be completed by November 13, 2009. 2. Deficiency 1, Requested Action 1b: Within thirty (30) calendar days of September 14, 2009, a revised engineering design for the stormwater controls at the site will be submitted to the Department and Weld County. This submittal will be received by October 14, 2009. The engineering design submittal shall include a construction schedule. 3. Deficiency 1: Construction of the approved revisions referenced in #2 above will commence on or before May 15, 2010 and be completed on or before August 15, 2010. 4. Deficiency 4: Results from analytical testing on the balance of the finished compost on site will be submitted to the Department within fourteen (14) calendar days.
