Please be advised that on July 23. 2009, Weld County, whose address and telephone number are 1111 H St. P.O. Box
758, Greeley, CO 80632; (970) 356-6496. submitted a request for full reclamation responsibility release for the Peters
Pit. Permit No. M-1986-001. The construction materials extraction operation is located at or near Section 27,
Township 12N, Range 63W, 06th Prime Meridian. in Weld County.
Written comments or objections to the release may be submitted to, and additional information obtained from, the
Division of Reclamation, Mining and Safety, 1313 Sherman Street, Room 215, Denver, Colorado 80203, (303) 866-
3567. Comments or objections should be submitted within 15 days. The Division is required to wait 30 days after the
release decision is made to allow for appeals.

et seq, as amended.

The following explanations cover Limited impact applications (ii0's) and Special
(Ten -Day Processing - Ill's) applications. In the interest of efficient processing,
please check the appropriate box to indicate which type of application you are applying
for. 111 permits may be issued only under special circumstances 3e sure you are
eligible.

LIMITED IMPACT OPERATIONS must disturb less than ten acres (including all
roads, stockpile areas and any other surface facilities) over the life of the
mine, and must extract LESS THAN 70,000 tons of mineral, overburden or
combination thereof per calendar year. If the affected area is some fraction
greater than nine acres, be sure NOT to round this figure up to ten acres in
the narratives or elsewhere.
SPECIAL (ten-day processing) operations are any sand, gravel, or quarry
aggregates operations which are to be operated for the sole purpose of
obtaining materials for highway, road, utility, or similar -type construction
under a Federal, State, county, city, town, or special district contract where
the contract calls for work to be commenced within a specifically short time
and which will affect ten acres or less (including all roads, stockpile areas,
and any other surface facilities).
INSTRUCTION: This application and all accompanying materials as outlined below must be
submitted in duplicate. For further guidance, and information for Limited
Impact Operations, see Rule 3 and for Special Permits, see Rule 4.

EXHIBIT A - Legal Description
The legal description must identify the affected land and be wholly adequate for field
location of the property. It can be in the form of metes & bounds survey or a
description by reference to township, range, and section, to at least the nearest
quarter -quarter section. Where applicable, the street address or lot number(s) may be
used.
EXHIBIT B - Mining Plan
This can be a general discussion of the methods, equipment, phases or stages of the
operation and those areas of land affected by each. The plan should be correlated with
the map and should show where extraction will begin, and which direction, if any, it
•ll proceed.
EXHIBIT C - Map
This map should clearly define the permit boundaries and contain sufficient information
to determine the location of the affected land on the ground and existing and proposed
roads or access routes to be used in connection with the mining operation. All
immediately adjacent landowners of record must be shown. The quarter section corner,
section line, or any other locatable points should also be shown on this map.
EXHIBIT D - Wildlife, Water Resources, Vegetation and Soils Information
Each of the above -mentioned subjects must be addressed as outlined in the applicable
Rule.
EXHIBIT E - Reclamation Plan
As with the mining plan, this should be a general discussion of the methods, equipment,
phases or stages of the reclamation process and those portions of land affected by each.
If possible, the plan should be closely correlated with the map. If not, the narrative
must be comprehensive enough to draw an accurate verbal picture of the expected
appearance of the area after completion of reclamation.

E• BIT F - Proof of Compliance with Local Government Zoning
In accordance with 34-32-115(4)(e), the Board must make a finding that the operation
will be in compliance with local zoning or subdivision regulations. You are not
required to submit this information, but a submission would assist the Division's
processing of the application. When the Division notifies the local government of the
existence of this application, it will request information regarding compliance with
applicable local law. It is intended that operators may concurrently come into
compliance with local requirements at the same time the Division is processing this
application. Information regarding the status with local government will be helpful.
EXHIBIT G - Source of Legal Right -to -Enter
This could :e a copy of the lease, deed, abstract of title, or current tax receipt. An
acceptable alternative would be a statement acknowledged by a Notary Public that the
operator has the legal right to enter the mine.
EXHIBIT H - Reclamation Costs
For a 110 permit, if the operator requests financial warranty to be less than $5,000.00,
the operator must submit facts to support such a request. Otherwise, a financial
warranty of $5,000.00 will automatically be set. For all 111 permits, the financial
warranty shall be $2,500.00 per acre.
4,01IBIT I - Terms of Governmental Contracts (111 Applications only)
For Special 10 -Day (111) permits, the operator must submit a copy of the contract or
other proof that proves the necessity of a Special 10 -day permit. The operator must
also submit evidence of the financial warranty provided under the governmental contract,
if it was required.
NOTICE PROCEDURES
After the application is considered "filed" (pursuant to Rule 1.1(10) with the Mined
Land Reclamation Division, notice procedures outlined in rule 3.2 and/or 4.2 must be
followed. (format for such notices will be included in the letter you receive from. the
MLR staff informing you of the Completeness ("filing") of your application.)
FINANCIAL WARRANTY
All applicants must submit a financial warranty in an amount determined by the Board
Prior to permit issuance. The law and regulations allow for several different types of
financial warranty. You should determine what type of financial warranty you desire to
use and obtain the appropriate forms from the Mined Land Reclamation Division during the
application review period to facilitate finalization of an acceptable financial warranty
and permit issuance. For 111 applications, financial warranty must be submitted before
.the application can be considered complete.

COLORADO WATER LAWS
The permittee is encouraged to contact the State Engineer, with regard to the
administration of water rights, and the Colorado Department of Health, with regard to
the discharge of pollutants into the waters of the State. Violation of Colorado water
laws could result in enforcement actions taken by the State Engineer and/or the Colorado
2coartmect of Health.

(N15SEk) of Section 27, Township 12 North, Range 63 West of the Sixth
Principal Meridian, Weld County, Colorado, being more particularly
descrbied as follows:
Beginning at the Southeast corner (S.E.Cor.) of said Section 27 and
considering the South line of said Section 27 as bearing North
90 00'00" West and with all other bearings contained herein relative
thereto: Thence North 34°23'59" West, 1933.25 feet to the TRUE POINT
OF BEGINNING;
Thence North 17027'09" East,_414.00 feet; Thence South 75°24'19" East.
492.17 feet; Thence South 0309'56" West, 253.90 feet; Thence South
