All structures are in place and no new construction is proposed. Water will be supplied by Left Hand Water District. The District has indicated the water tap is sufficient for a business as long as the business is operated by the occupants of the residence. Although the facility will not have any employees, there will be dog owners who come to the site and they must have access to potable water, restroom and hand washing facilities. The application does not indicate how the sanitation facilities will be supplied. Either a septic system will need to be installed at the kennel or the existing restroom must be made available for use. There is an existing septic system (permit G19940130) that was permitted for a 3 bedroom residence and will require an engineer's review to ensure there is sufficient capacity to serve the proposed kennel operations. There is not a septic permit on file for the residence that was built in 1909. The owner has indicated there is no plumbing located in this house. The 1909 home should be indicated as "for storage only" on the plat. There was no mention if any water will be used in the daily sanitation of the kennel and/or supplies (bowls, bedding ect). All liquid waste from the kennel operation must be contained. Either a septic system can be installed for the kennel or the existing home septic system must be made available for use. The additional hydraulic load must be taken into account when an engineer evaluation is completed. The waste handling plan should indicate that waste is cleaned from the kennel on a daily basis and picked up weekly by a sanitation company. This information shall be included in the waste handling plan as well as the name, address and phone number of the waste removal company. A dust abatement plan, for on site dust, is required. Noise will be restricted to the level allowed in the commercial zone district. EXHIBIT i 2009-2747 • • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan (on site dust) for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment (WCPHE). 2. A copy of the current Pet Animal Care Facilities Act license shall be provided to WCDPHE. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4. In the event the applicant intends to utilize the existing septic system at the existing home for visitor, patron and/or kennel sanitation needs, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load from the resident's occupants and visitors. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 5. Alternately to item #4 above, the applicant shall install an individual sewage disposal system for visitor, patrons and kennel sanitation needs and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 2 • • • 6. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the house constructed in 1909. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. Alternately, the owner shall provide documentation indicating the home will be used for storage only. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 6. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. . 3 • • • 9. Adequate drinking, handwashing and toilet facilities shall be provided for visitors and patrons of the facility, at all times. 10. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11. The facility shall utilize the existing public water supply. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Weld County Road Classification Plan (FHU): WCR 3 is a major arterial road, which requires a 140 - foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Our most recent AADT count reflects 379 vehicles per day taken in February 2008; the 851h percentile reflects speed limits at 48 mph. Trucks account for 7% of the traffic at this location. Access: Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of the County. Properties within municipalities or other counties which access County roads are subject to this policy. The applicant shall utilize the existing residential/agricultural access to this parcel and must maintain a 30' turning radius at the access. Our estimation of the maximum number of trips per day generated by this development is 78 if, on a given day, all 39 dogs at the facility are there for doggie daycare and will be dropped off and picked up during the same day. Off-street parking spaces including the access drive shall be surfaced with gravel, recycled asphalt, or the equivalent and shall be graded to prevent drainage problems. Storm Water Drainage: A water quality capture feature to control run-off from your property is required. Calculations provided for the water quality capture feature are acceptable. The area for the water quality feature shall be called out as "Reserved Drainage Area, No Build" on the USR site plan. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. The New Consolidated Lower Boulder Reservoir and Ditch Company, of which I am the Secretary, owns the Lower Boulder Ditch. The Northern Colorado Water Conservancy District (NCWCD) has an agreement with our Company to utilize its easement. In addition, NCWCD has recorded separate easements under the name "South Platte Supply Canal." I am making this response only on behalf of our Company, and not on behalf of NCWCD. Certain representations made in the "USR Questionnaire" are incorrect and are of concern to the Company. Specifically: At section 2, "All storm water and wastewater drains south on this property away from any irrigation ditches;" At section 4, "my business will not have any effect on the irrigation water;" and At section 8, "all of the water drains south. This includes storm water as well as any wastewater that is used at the property. This is away from the irrigation ditch that borders the north side of the property, which is the main concern so no additional steps need to be taken." (Emphasis added.) I have attached photocopies of an aerial photograph and a topographical map of the subject property and immediate environs. I also have intimate personal knowledge of the area, having been an officer and director of our Company for more than 15 years and having lived within one and one-half miles of the subject property. While actively engaged in farming, I conducted farming operations on virtually all the immediately surrounding properties on several occasions. In fact, a good portion of the subject property drains in a Northerly to Northeasterly direction. Even that portion of the property that does not drain more -or -less directly toward our ditch, drains into a natural drainage swale that drains into our ditch. • • • • The map attached to the application indicates something called a "Water Quality Feature" in the Northeast corner of the subject property. The application contains no description of the purpose or operation of this "feature." In the past, we have had water quality problems caused by drainage from high -density animal operations in the immediate vicinity of the subject property. We do not want to repeat the experience. We are concerned that the applicant may be trying to understate the potential for impact on our ditch because of his repeated reference to the subject property draining away from the ditch, when exactly the opposite is true. Until we have better assurance that contaminants from the operation of this facility will not enter our ditch, we must oppose the application. Thank you for your consideration. Based on my review, I have the following comments and stipulations: • Since the kennel operation will be using existing buildings, it will not be necessary for the required fire flow to be provided to the existing buildings. However, should additional buildings be constructed on the site, or moved onto the site, then the required fire flow will have to be provided for those new buildings. The required fire flow will be determined by the total floor area and type of construction, as defined by the International Building Code. However it will not be less than 1,500 gallons per minute at 20 pounds per square inch. This will require the installation of one or more fire hydrants on the site. • Provide access to the site that meets the standards of the Fire District. Fire Department access roads must be 20 feet in width, have a clear height of 13 feet, 6 inches and must be capable of supporting an imposed load of 75,000 pounds. Roads shall be provided so that apparatus may reach within 150 feet of all portions of buildings as measured along apparatus roads and around the exterior of the buildings. • If not already provided, approved address numbers shall be placed on the residence or on a freestanding sign in such a position to be plainly visible and legible from the street fronting the property. The proposal is for a dog boarding and day care business for up to 39 dogs in addition to use as a residence. This property is currently used as a private residence. Structures are already on site and no new construction is being proposed. There will be no new landscaping and the trees present on the property will not be removed. The property is surrounded by large contiguous parcels of productive agricultural lands and an irrigation ditch runs along the north side of the property. Typical wildlife expected to be found on site includes coyote, red fox, raccoon, striped skunk, mule and white-tailed deer, song birds, doves, black birds, and raptors. Coyotes, foxes, skunks, raccoons, raptors and other wildlife may be attracted to the site if client pets are left unsupervised, or pet food is left exposed outdoors. To minimize potential harm to client pets or wildlife, fence outdoor exercise areas adequately, including overhead. Additionally, install fencing in a manner that minimizes opportunity for animals to burrow in or out of the facility. Client pets should only be fed indoors, and remove empty food bags promptly with disposal only in wildlife -resistant trash containers. For additional suggestions on how to prevent conflicts between wildlife and pets please consult our website: www.wildlife.state.co.usiEducationfLivingWithWildlife. Storm water runoff from the parking lot and outdoor exercise areas may adversely impact water quality and consequently wildlife habitat. Runoff from this property currently moves to the south, away from the irrigation ditch. Drainage plans for the property should meet the Weld County Code and should continue to be directed away from the existing irrigation ditch and associated riparian habitat. We appreciate the applicant's intention to properly seal waste to be removed weekly with the trash. Finally, diseases carried by wildlife may be transmissible to pets. We recommend that all dogs coming to the kennel be properly vaccinated against rabies and canine distemper. We would also encourage perimeter fencing around outdoor exercise areas that minimize opportunity for close contact between client pets and wildlife.
