NOW THEREFORE, the said party of the second part hereby accepts and approves said underpass construction and agrees to retain the same; and that said party of the first part is hereby released and discharged from any and all claims of damages of whatever kind or nature that may hereafter arise by reason of said construction or operation, and that said underpass shall be the property of the party of the second part, and said party of the second part shall be solely responsible for its repair and operation.
