Subject: Elms at Meadow Vale, Third Filing
Planning Case No. S-579
Dear Mr. Deibel:
The Department of Planning Services [PL] received a request from your office concerning the
collateral for the Elms at Meadow Vale, Third Filing, more specifically described as part of the
N2 NW4 of Section 4, Township 2 North, Range 68 West of the 6th P.M., Weld County,
Colorado. This office working in concert with the Department of Public Works [PW] and the
Clerk to the Board of County Commissioners office [CTB] reviewed the collateral for this project
and determined the following:
A Deed of Trust was accepted from Floyd Oliver, Reception #2810568 and #2810569 [CTB
Tracking No. 2001-1924] for Public Road Maintenance in the amount of seven hundred eighty-
nine thousand three hundred ninety and no/100s ($789,390.00) dollars and for Private Road
Maintenance in the amount of two million, two hundred ten thousand and no/100s
(2,210,000.00) dollars. This action occurred on July 18, 2001. The Resolution of Board action
is enclosed.
On July 24, 2002, Floyd Oliver submitted an Irrevocable Letter of Credit No. FGAC-02119 drawn
on the Fidelity Guaranty and Acceptance Corporation in the amount of eight hundred eighty-nine
thousand and no/100s ($ 889,000.00) dollars as replacement collateral for the Deed of Trust.
The Departments of Public Works and Planning Services prior to this date had conducted a
visual inspection of the Third Filing and recommended the cancellation and release of collateral,
with acceptance of the Letter of Credit in the amount of eight hundred eighty-nine and no/100s
($ 889,000.00) dollars as replacement collateral for all remaining improvements.

On a date prior to November 10, 2003, when there was action by the Board of County
Commissioners, the Departments of Public Works and Planning Services conducted a visual
inspection of the Third Filing and recommended the cancellation and release of all collateral
associated with this Filing as in their opinion, all improvements as specified in the Public and
Private Improvement Agreements had been accepted as complete by both of these offices. The
Resolution of Board action is enclosed.

Department of Public Works, the Office of the Clerk to the Board, and the Department of
Planning Services are able to assist Lennar Colorado in answering your questions and/ or
obtaining all requested documents.
Should Lennar Colorado desire to review specific documents, Weld County requests that this
request be put in writing and addressed to the Office of Planning Services for coordination and
