RE: GRANT OF CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
C-COMMERCIAL DISTRICT FOR BILLY CULLEN.

WHEREAS, the Board of County Commissioners of Weld County,
r,. Colorado, pursuant to Colorado statute and the Weld County Home
PM Rule Charter, is vested with the authority of administering the
_i affairs of Weld County, Colorado, and
rt WHEREAS, a public hearing was held on November 23, 1977 , in
° the Chambers of the Board of County Commissioners of Weld County,

Colorado, at 2 : 00 o'clock p.m. , for the purpose of hearing the
petition of Billy Cullen, 16436 Weld County Road No. 7 , Mead,
Colorado 80542, requesting a change of zone from A-Agricultural

District to C-Commercial District, for the following described
parcel of land, to-wit:
all of that part of the Southwest a of Section 10, T3N, R68W,
of the 6th P.M., Weld County, Colorado, being more particularly
described as follows:
Beginning at a point on the West line of Section 10 whence the
West a corner of said Section 10 bears North 00°05'50" East
667.00 feet; thence at right angles to said West line South
89°54'10" East 657.28 feet to the right-of-way of the Great
Western Railroad; thence along said right-of-way North 52°06'50"
Fast 100.10 feet; thence North 69°58'10" West 364.10 feet;
thence North 76°51'10" West 127.20 feet; thence North 75°04'10"
West 279.28 feet to the said West line; thence along said West
line South 00°05'50" West 285.96 feet to the point of beginning,
containing 3.036 acres more or less.
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioners for a change of zone upon the aforementioned tract
of land, and
WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the petitioners and the recommendations of the Weld
County Planning Commission, and having been fully informed and
satisfied that the request for rezoning complies with the Weld
County Comprehensive Plan and the conditions set out in Section
8 . 2 and 8 . 3 of the Weld County Zoning Resolution;

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of
Billy Cullen for a change of zone from A-Agricultural District
to C-Commercial District on the above-described tract of land,
be, and hereby is , granted subject to the condition imposed
by the Weld County Planning Commission for on-site fire pro-
tection.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated October 4, 1977, be, and hereby are, incorporated as
the findings of fact of the Board of County Commissioners in
this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day
of November , A.D. , 1977 .

November 23 , 1977
I hereby certify that pursuant to a notice dated October 17 ,
1977 , duly published October 19 , 1977 and November 9 , 1977 in
the Greeley Journal, a public hearing was held on the request
of Billy Cullen for a Change of Zone from A-Agricultural to
C-Commercial District. Mr. Cullen was present and made his
request. There was no one in the audience opposed to the
change of zone. After receiving the favorable recommendation
of the Weld County Planning Commission and hearing all
testimony, Commissioner Dunbar made a motion to grant the
change of zone with the provision that the applicant provide
on-site fire protection measures as requested by the Longmont
Fire Protection District. Commissioner Carlson seconded the
motion and it carried unanimously. All five Commissioners
were in attendance at the hearing.

2. The rezoning request agrees with the policies contained within
the Weld County Comprehensive Plan in that the request for
commercial development is in compliance with the use designation
for this area as outlined in the Mead Comprehensive Plan.
3. The Mead Planning Commission has recommended this rezoning
request be approved since the proposed commercial use agrees
with Mead' s Comprehensive Plan.
4. The Weld County Health Department has indicated that the proposed
commercial development is in compliance with Weld County and State
Health Standards.
5. The Longmont Fire Protection District indicated they had no
objections with the approval of this request provided the
applicant implements fire protection measures as outlined in the
Fire District ' s letter dated September 14, 1977.
7. The applicant has submitted petition forms signed by surrounding
property owners in support of this rezoning request . To date
our office has not received any opposition to this request
from any of the other surrounding property owners.
The Planning Commission recommendation for approval is subject to the
request by the Longmont Fire Protection District for the applicant to
provide on-site fire protection measures as outlined in the District ' s
letter dated September 14, 1977, becoming a condition of approval by
the Board of County Commissioners in their resolution of approval for
this rezoning request.

At present there is no lumber yard in the whole mead and surrounding
area. .

YES, We would be able to serve the community with a local lumber
and buldingl supplies.
1. What features apply to the property res;uesting rezonina which make it logical to re-
zone this -tract and not to rezone in a similar manner surrounding properties which
may have like land use characteristics. The property is in a propsed
commercial zone that the city has -already planned.
Why are other area r, in the County a lready zoned according to the requested classi-
fication, unsuitable for the development which is proposed. There is none

B. The only water available is a small domestic ta .
C. Lumber yards present one of the greatest fire .potent].als and
one of the greatest exposure hazards. (probability of fire spread-
ing. to other stackr. or structures).

We would recommend an approval of this application only upon
agreement of the applicant to:
A. 1 . Extend a 6" water main from the Mead water supply to the
front of the property and install an approved fire hydrant.
2. Install a fire detection system in all buildings and sheds,
meeting our approval and connected to Longmont Dispatch Center.
B. . Or, 1 . If the water main extension is unavailable from read, to
revert to NF?A standard 1231 "water supplies for suburban and rural
firefighting". This would require an acceptable tank, cistern, or
other year-round static water source with a protected, accessable
4 1/2" dry-hydrant with a female 1. 1/2" NS swivel meeting fire dis-
trict approval.
2. Install a fire detection system in all buildings and sheds,
connected to Longmont Fire Dispatch Center and approved by the Long-
mont Fire Protection District.
The total gallonage in this section is a minimum of 30,000 gallons
available for Firefighting. Actual gallonage might be scaled up-
Wards, depending upon a survey of probable fire loads, as well as
lumber stacks and building separations.
We believe these points should be consid.ored on the front-end of the
Zoning process, as the water supply for fire protection is critical,
and should be given :primary consideration at the very beginning,
rather than later in the governmental process, as no Fire Department
can successfull-y control faire. in a 'lumbex• yard ;*ithOut adequate water
supply.

Dear Ken:
Our staff has made a review of the above request and offer the following
comments :
1 . The soils are classified as -a Wiley-Colby complex with an
irrigated land use classification of Ile. This is a deep,
well drained silt loam surface soil that grades into -a
silty clay loam at about 11 inches deep. Permeability is
moderate to slow.
The soils have a moderate shrink-swell potential and this
should be taken into consideration when designing building
foundations and basements. These soils have moderate
limitations for septic tank leach fields and the design
of the system should he done as a result of a percolation
test run at the site.

in the project area.
3. The project area is not located in a floodplain or subject

4. The project would be compatible with the adjoining land use.
