WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 2, 2003, the Department of Planning Services staff approved the application for Shultz Farms, Inc., do Steve Shultz, 21475 County Road 19, Milliken, Colorado 80543, for Nine (9) Lots with E (Estate) Zone Uses, along with 9.4 acres of Open Space on the following described real estate, to wit: Lot B of Recorded Exemption #2828; being part of the NW1/4 of Section 31, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on October 15, 2003, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance) for The Estates at Hill Lake, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Shultz Farms, Inc., do Steve Shultz, with terms and conditions being as stated in said agreement, and accepted Irrevocable Letter of Credit #253, drawn on the New Frontier Bank, in the amount of $54,562.83, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Irrevocable Letter of Credit #253, drawn on the New Frontier Bank, in the amount of $54,562.83 be, and hereby is, canceled and released. Case number PF-622 Steven Shultz, Applicant Staff from the Department of Public Works conducted a field inspection in June 2009 and determined that the property was in compliance with all transportation elements as stated in their referral dated June 25, 2009. Planning Services inspected the site on May 8, 2009 and determined that all non -transportation related items had been completed and were acceptable. The Weld County Attorney, the Department of Public Works and the Department of Planning Services, have determined that the on site road improvements required for the Estates at Hill Lake and guaranteed via Letter of Credit #253, from New Frontier Bank, in the amount of for fifty-four thousand five hundred and sixty-two and 83/100s (54,562.83) dollars, be released in full.
