HomeMy WebLinkAbout20092456.tiffWI�Yc Ma; COLORADO MEMORANDUM TO: MICHELLE MARTIN, PLANNING SERVICES FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT:AMUSR-1232 DATE: 08/28/2008 Environmental Health Services has reviewed this proposal for an amendment to an existing Recreational Facility with uses similar to those seen at Guest Farms and Fairgrounds. The amendment would allow the number of people, at the site, to be increased to 10,000 people up to 6 times a year and 5,000 people up to 10 times a year. A maximum of 1200 people per day would be allowed all other days of the year. Left Hand Water District provides water to the site. There is an existing Individual Sewage Disposal System (SP -0000030) which was designed to serve up to 200 people. Due to the large number of people that could potentially visit the site, this Department recommends the facility connect to Saint Vrain Sanitation for sewer provision. The applicant also has the option to expand the existing septic system. If the existing septic system is expanded to accommodate 1200 people per day, the applicant is subject to the requirements of the Water Quality Control Division of the Colorado Department of Public Health and Environment. The septic system would also require authorization from the EPA. In addition, the septic system would be required to be designed by a registered engineer and be approved by the Weld County Board of Health. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment (WCDPHE). The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). EXHIBIT 2009-2456 • • • • • 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 2. The applicant shall submit a dust abatement plan for review and approval, to WCDPHE. 3. The site shall either be connected to Saint Vrain Sanitation District or the existing individual sewage disposal system (ISDS) expanded to accommodate 1200 people per day. 4. If the existing ISDS is expanded, the system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. The ISDS shall be permitted according to the Weld County Individual Sewage Disposal Regulations 5. If the existing ISDS is expanded, approval from the Colorado Department of Public Health and Environment shall be provided, in writing, to WCDPHE. 6. If the existing ISDS is expanded, authorization from the EPA shall be provided, in writing, to WCDPHE. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 2 • • • • • The facility shall be operated in accordance with the approved "dust abatement plan". 6. There shall be no open burning conducted on the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control Commission Regulations, 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Permanent handwashing and toilet facilities shall be provided for 1200 people per day. 9. The facility shall utilize portable toilets and handwashing units to temporarily supplement the sanitary facilities for the 16 temporary events per year. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. (Left Hand Water District) 12.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 14. If applicable, the applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 15. Our comments and requirements are as follows: • • COMMENTS: WCR 3.25 is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. According to the peak hour traffic values defined in the traffic study and required volumes designated by the CDOT Access Code auxiliary lanes will not be required. Additional traffic signals are also unnecessary for the proposed increase in traffic volume proposed by the applicants. However, the applicants should contact CDOT to ensure that they do not require additional improvements for State Highway 52 due to the increase in traffic volumes that are proposed by the applicants. REQUIREMENTS: Preliminary Drainage Report: The applicant was requested to provide a preliminary drainage report in the memo dated March 17, 2008. To date, a preliminary drainage report has not been provided. Please provide a preliminary drainage report that has been stamped, signed, and dated by a registered professional engineer licensed in Colorado. The drainage report needs to follow the Preliminary Drainage Report Checklist that was included in the USR application packet. Traffic Study: Weld County Public Works has received a Traffic Study for AmUSR-1232 Anderson Farms prepared and stamped by Matthew Delich. After reviewing the submitted traffic study I have prepared the following comments: - The applicant has indicated that this site can produce up 5000 trips per day. -No parking or staging of vehicles on the county road is allowed. Use on -site parking area. -Stop signs will be required to be installed at the accesses before traffic will enter onto WCR 3.25 -The Colorado Department of Transportation (CDOT) has jurisdiction over all State highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify if any improvements will be required at the intersection of WCR 3.25 and SH 52 to accommodate traffic from the Anderson Farms site. The Fire District has always been concerned that there was no water supply for fire protection at this site. When USR-1232 was approved in 1999, provisions were made to the assembly building to make the building comply with the building code and fife code for the assembly use. The District approved the use provided no additional building construction would occur at the site unless an approved water supply was available and the plans for additional construction approved by the District. As you are aware additional buildings have been constructed on the site without either building permits or Fire District approval. The biggest concern the District has is this seems to continue to occur and I recently discovered an amusement park, Group A-5 Occupancy (haunted theme area) that was never permitted, approved and has very serious life safety issues related to it. Not to mention that this area would have needed a water supply for fire protection as well as some of the buildings in the theme area would have needed to be provided with a fire sprinkler system because of their size. This operation has continued to grow beyond what was approved for the original USR. At that time it was understood there was an assembly building, outdoor cooking for functions in the assembly building and a corn maze. Commercial cooking equipment has also been installed in the assembly building without approval and without a proper hood or fire suppression system. During the initial USR review, the Fire District mentioned that commercial cooking equipment was not to be installed in the building and there was to be no cooking that produced grease -laden vapors unless approved. I became aware of the small office building, ticket booths and even the 3 -sided educational structure with the wood roof during an inspection of the property. When I found these structures, I did again inform the applicant they were not supposed to be adding structures and fuel load to the property without water supply. I did not think of the building code ramifications if the structure would be safe in high winds or other weather conditions. Finally, the haunted theme area (amusement park) should not be allowed and basically removed until it can meet the provisions of the both the fire code and building code. BACKFLOW AND CROSS -CONNECTIONS. • • • There exists the possibility of contamination and pollution of the District's potable water system due to the acts and/or omissions of its users or other parties who may cause back- siphonage and cross -connections to occur. In the case of any premises where there is a well or other auxiliary water supply, the District's water system must be protected by an approved air -gap separation or an approved reduced pressure principle backflow prevention assembly. Any person, entity, association, or corporation which makes, installs, maintains or allows any such cross -connection which may cause back-siphonage and which may degrade the acceptable water quality of the District's water system shall be subject to prosecution under section 25-1-114, C.R.S. To reduce the possibility of cross -connection and back-siphonage, the District shall implement the following: 1. Notification. All new customers shall be presented with information and warnings regarding the possibility of contamination and pollution due to cross -connections and back- siphonage, and the schedule of compliance set forth in paragraph 2.2. All existing customers shall be periodically reminded of the schedule of compliance set forth in paragraph 2.2 2. Backflow Devices. 2.1 Commercial and Industrial. On or before January 1, 1992 all commercial and industrial users shall have installed an approved backflow prevention device of a type and size approved by the District, and which meets or exceeds the standards established by the Colorado Department of Health standards and specifications and which has been certified by the Foundation for Cross -Connection Control at the University of Southern California. Any unapproved backflow prevention device which is currently installed shall be replaced with an approved device at the time it fails an operational test. 2.2 Residential. On or before January 1, 1994, all residential users shall have installed a backflow prevention device of a type and size approved by the District. 2.3 Installation Regulations. Left Hand water District shall incorporate into its engineering standards such installation regulations for backflow devices which are promulgated by the Colorado Department of Health and which are consistent with this policy. 2.4 Enforcement of Backflow and Cross -Connection Policies It is the customer's responsibility to maintain their backflow prevention devices, and to see that their devices are tested at least annually by a State certified backflow inspector. The results of the test shall be provided to the District by the customer within 20 days after inspection. If evidence of installation of a backflow device is not received after customer notification, or if notice of satisfactory "passing" inspection is not received by the District within the annual anniversary of the previous inspection, the following actions will be taken by the District: 1. A reminder notice will be sent by the District. The first notice will allow a 60 day period for compliance and note all fines and actions that may result from noncompliance. 2. If no response is received within the 60 day period, a fine of $150 will be imposed on the 61st day following notification, and a second notice will be sent. 3. The second notice will have a 30 day period for compliance. If no response is received following the second notice, a fine of $300 will be applied on the 31 St day. 4. If no action is taken to bring the backflow status into compliance after the second notice, a third notice with a term of 30 days will be issued, and service to the tap will be discontinued if no action is taken before the end of that period.
