Dear Gary:
The Department of Planning Services is in receipt of your request received via electronic mail on
December 29, 2008. As staff indicated in your pre -application meeting this morning staff will support this
request and coordinate the release of the permit through the Greeley Planning office. You or
representatives for Wegner Construction may pick up this permit on or before December 31, 2008 at 430P
in the Greeley office.
Staff is also able to support the full release of the building permit for this structure, the addition of an Area
Office Building at the Cheyenne Compressor Station at 65657 State Highway 85, as there is a line item
budget requisition that requires immediate address as further described in your letter dated December 29,
2008. The protocol for release of this permit is at the discretion of the Board of County Commissioners.
Staff will forward this request to their attention immediately.
Staff is willing to assist Colorado Interstate Gas Company in obtaining their 2008 construction objectives
and meet their project obligations. That being stated, staff is on record that there is risk associated with
the release of the building permit at this juncture without the appropriate land use permitting in place, and
this risk is wholly borne by the Colorado Interstate Gas Company.

Mr. Ogle,
I am requesting that the Building permit for the addition of an Area Office Building at the
Cheyenne Compressor Station at 65657 HWY 85 be released to allow the contractor to proceed
with the construction of the facility.
The funding for this project was contingent upon the project being completed in the 2008
calendar year. Obviously it's too late for this to occur, however if the permit is released I could
prepay for a large portion of the construction and therefore not have to carry much of it over to
the 2009 budget Any money not spent in 2008 is lost and carryover will come from projects
approved for the 2009 budget year.
I realize that our addition is being held up due to the need for an updated USR, but I am
confident that the USR will be updated in a timely manner. The new addition just made us
aware of the need for the review and update of the USR.
I realize that there is some risk associated with releasing the permit prior to the approval of the
updated URS. I am willing to assume a certain amount of risk as a large sum of money has
already been spent in preparation of a new facility and there is no reason to believe that it will
not be constructed as planned
Our contractor, Wegner Construction, is available now.

Dear El Paso Natural Gas Company:
The Department of Planning Services and Building Inspection are in receipt of a building permit
application for the above identified oil and gas processing facility, identified as the Cheyenne
Compressor Station. Per the application materials, a 5760 SF wood frame office building on
crawl space with all utilities, including one men's and women's lavatory, ten (10) offices, a break
room, mechanical room, training and conference rooms was requested.
Staff review of this request included an assessment of the existing field conditions in comparison
to the land use permit of record, in this instance, Use by Special Review plat number 485 [USR-
485]. It is the determination of this office that there have been several significant upgrades to
the facility which has not been reviewed by County and similar external agencies. Given this
situation, staff is requiring El Paso Natural Gas to amend the existing permit to include the
components of the existing field condition and also to include future improvements that may be
anticipated in the long term. This office appreciates that future technical advancements may be
difficult to predict, and staff is of a similar understanding of the company attempt to forecast the
unknown.
However in this instance staff has determined the proposal to be a substantial change from the
permitted land use application. Therefore, this office is requesting that a pre -application meeting
be attended by representatives for El Paso Natural Gas Company. Following this meeting, staff
will be requesting that an Amended USR application be submitted for processing. To facilitate
the pre -application meeting, please find attached a link to the webpage for your use.

The addition of a warehouse for the new facilities at the Cheyenne Plains Compressor Station and
Processing facility were not part of the original special use permit. The need for this building was
identified early on in the project, however funding to build it was not approved until this year.
The facility will be used solely for the storage of new or remanufactured parts and supplies to support
the operations of the newly constructed Cheyenne Plains Compression and Processing facilities. The
parts and supplies will consist of replacement filter elements, spare engine parts for the compressors,
spare electric motors for key pumps and auxiliary equipment, parts and supplies for water treating
equipment and various other consumables associated with operating and maintaining the new facilities.
The new warehouse will be a 40W X 80'L metal building with one roll up door and 2 man doors
positioned on a concrete foundation and floor. The building will have overhead lighting, minimal
electrical receptacles and electrical power to operate the overhead door. Heating and Air conditioning
are not required for this building.
There are no additional personnel requirements associated with this addition.

Dear Mr. Martinez:
Thank you for your letter dated May 13, 1998 concerning the addition of a compressor to this
site. According to your letter, this compressor will be the eighth compressor located on the site.
Development Standard #la attached to USR-485 allows for future expansion to eight (8) 2,700
horsepower natural gas engine/compressor units. Staff has reviewed your request and has
determined that the addition of the eighth 2,700 horsepower natural gas engine/compressor unit
is not a substantial change to USR-485.
Since this addition equals the maximum number of compressors allowed by USR-485, any
future expansion or additions to the site may require an amendment to the USR.

Dear Mr. Hodges:
Colorado Interstate Gas Company (CIG) acquired 118 acres on April 25, 1978, for
purposes of constructing compressor station facilities for its natural gas transmission system.
On January 27, 1978, CIG filed an application with Weld County Planning Department
for a Special Use Permit to construct, operate and maintain compressor station facilities
upon the actual purchase of the property. On April 20, 1978, the Board of County
Commissioners, Weld County, Colorado, granted CIG a Special Use Permit (SUP -
351:78:3) for the construction of a compressor station.
On December 17, 1981, CIG filed an application to revise SUP 351:78:3 to include the
construction on new compressor station facilities to accommodate volumes of natural gas
being transported through the newly constructed 36 -inch Trailblazer Pipeline. On
February 3, 1982, the Weld County Planning Commission resolved that CIG's proposed
additions were of no substantial differences from the original approved Special Use Permit
dated April 20, 1978. The Development Standards indicate, among other items, that the
major facilities shall be limited to 8 compressor engines.
In May of 1997, CIG installed a new compressor engine within a new compressor building
addition. This work was permitted under the original Special Use Permit No. 351:78:3
and Resolution of February 3, 1982.
CIG again proposes to install an additional compressor engine to the existing compressors
as previously constructed. This new project will require an addition to the existing
compressor building to house this new compressor engine. This addition will be the fourth
compressor engine is shown in the clouded area on CIG Map CHY-0-2(1 A).
CIG requests this 1998 Compressor Addition (WIC) proposal also be permitted under the
original Special Use Permit No. 351:78:3 and Resolution of February 3, 1982.

- It is the opinion of the Weld County Planning Commission that this
request is in agreement with the Weld County Comprehensive Plan in
that the proposed use would not appear to have any adverse impacts on
the agricultural interests of the County or the environment.
- It is the opinion of the Department of Weld County Planning Commission
that the proposed operation is in compliance with the provisions of
Section 31.4 of the Weld County Zoning Ordinance. The requested use
is one allowed in an Agricultural Zone District by special review and
would be compatible with the existing surrounding land uses.
- It is the opinion of the Weld County Planning Commission that the
attached development standards will minimize impacts on surrounding
uses and the area to the greatest extent possible and provide adequate
protection of the health, safety and welfare of the inhabitants of the
County.
This request does not exist in an Overlay District Area.
These determinations are based, in part, upon a review of the referral entities
which have reviewed this request, the information submitted by the applicant and
other relevant information regarding this request. The Weld County Planning Commis-
sion recommendation is conditional upon the following:
1. The attached Development Standards being recommended and adopted for
the Special Use Permit to promote compliance with Sections 24.5 and
24.6 of the Weld County Zoning Ordinance.
2. No building or electrical permits shall be issued on the Special Use
Permit area until the Development Standards for the Special Use Permit
and the property owners signature have been placed on the Special Use
Permit plat and the plat has been delivered to the office of the
Department of Planning Services.

MEMORANDUM OF UNDERSTANDING BETWEEN THE COLORADO STATE HISTORIC
PRESERVATION OFFICER AND COLORADO INTERSTATE GAS COMPANY.
WHEREAS, the Colorado State Historic Preservation Officer (SHPO)
has determined that some types of projects submitted for review
by Colorado Interstate Gas Company (Company) in compliance with
federal laws and regulations will have no effect to historic
properties and therefore, do no require cultural resource
inventories; and,
WHEREAS, it is in the best interests of the SHPO and the Company
to reduce investments of time and resources in the review process
by eliminating project reviews:
NOW, THEREFORE, it is mutually agreed that certain types of
projects will be exempt from review according to the following
stipulations:
1. Projects such as pipeline taps, meter settings, removal of
meter settings, removal and replacement of existing pipelines
(not to exceed 1000 feet of pipe) or other earth disturbing
activities that take place on existing pipelines, or areas that
have been disturbed by appurtenant facilities need not be
submitted for review.
2. If a project, otherwise fitting the exempt categories defined
in Stipulation 1, may affect a historical resource or
archaeological site, the Company and SHPO will review the project
in order to determine if the property can be avoided, and/or to
determine if the property is eligible for listing in the National
Register. Properties or sites determined eligible will be
treated in accordance with the requirements of Section 106
of the National Historic Preservation Act of 1966, as amended.
3. Should cultural resources be discovered during construction
activities, work will be halted by the Company until the
resources have been evaluated in terms of the National Register
criteria, 36 CFR 60.4, in consultation with the SHPO.
4. The SHPO may monitor activities carried out pursuant to this
Memorandum of Understanding (MOU). The company will cooperate
with the SHPO in carrying out its monitoring responsibilities.
5. This MOU will be in effect from a period of five (5) years
from the date it is signed by the SHPO. The MOU will be renewed
at the end of the period if mutually agreed to by the SHPO and

In compliance with Federal Energy Regulatory Commission Rule 234 authorizing the issuance
of Blanket Certificates of public convenience and necessity, Colorado Interstate Gas Company
(CIG) is required to get concurrence from the U.S. Fish and Wildlife Service (Service) that
any proposed construction by CIG will not have adverse effects on listed or proposed species
or their habitats as identified in the Endangered Species Act (ESA) of 1973, as amended (16
U.S.C. 1531 et. seq). This letter authorizes CIG a blanket clearance for minor gas pipeline
construction projects. This clearance letter is for the period July 1, 1997 through
September 30, 1998.
Our primary areas of concern regarding construction projects are threatened and endangered
species, wetlands, and migratory birds. The following habitat types should be avoided in
order for this clearance to be in effect: wetlands, including marshes and playas; rivers and
streams; riparian woodlands; native prairie grasslands; prairie dog towns in the eastern half of
Colorado; and any National Wildlife Refuge property. In the event of potential effects to any
of these types of areas, we prefer to review and evaluate the proposal individually.
If CIG , as FERC's designated representative for these blanket projects, determines any
proposed activity may affect a federally listed threatened or endangered species, formal
consultation should be initiated between FERC and the Service. If there will be no effect, or
if the Service concurs in writing there will be beneficial effects, then further consultation is not
nescary.
This clearance letter applies to very limited, low -impact projects including pipeline taps, meter
reclaims, dehydrators, domestic well connections, any pipelines of two miles or less,
compressor units on existing station properties, and any monitoring facilities occupying less
than three acres. Proposed projects which involve construction other than these named

February 3, 1982, the Weld County Planning Commission resolved that CIG's proposed
additions were of no substantial differences from the original approved Special Use Permit
dated April 20, 1978. CIG's expansion of facilities were shown on Map WCHY-SK-1.
CIG now proposes to install an additional compressor engine to the compressors
constructed in 1982. This new project will require an addition to the existing compressor
building to house this new compressor engine. This addition is shown in the clouded area
on CIG Map CHY-0-2(1 A).
CIG requests its 1997 Addition (WIC) proposal be permitted under the original Special
Use Permit No. 351:78:3 and Resolution of February 3, 1982.

D. The West Greeley Soil Conservation District could see no
reason why approval for this request should not be granted
provided the applicant protects all bare areas on the site
with revegetation or suitahle gravel cover to provide wind
and water -erosion protection.
The Department of Planning Services staff recommendation for approval
is subject to the Special Use Permit plat being amended to show the
deceleration lane on Highway 85 at the access to the Special Use
Permit area as recommended by the Colorado Division of Highways in
a letter dated February 10, 1978.

DEVELOPMENT STANDARDS
1. The permitted use on the hereon described parcel of land shall
be facilities for a natural gas compressor station as shown
on the plans. Major facilities shall be limited to:
a. Four 2700 horsepower natural gas engine/compressor units
and auxiliary equipment with future expansion to six such
natural gas engine/compressor units.
b. One 55' x 200' prefabricated commercial building, which
shall house the four natural gas engine/compressor units.
Future expansion to six units shall add an additional 80'
to the length of the building.
c. One 30' x 127' prefabricated commercial building which
shall house the office, shop, and warehouse with a 39' x
75' wing to house auxiliary equipment.
d. Three houses for station personnel.
2. The facility shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems. The
noise levels at the property lines shall not exceed 70 db(A)
from 7:00 a.m. to 7:00 p.m. and 65 db(A) from 7:00 p.m. to
7:00 a.m. as stated in C.R.S. 1973, 25-12-103.
3. Upon termination of the operation of the compressor station,
all facilities and structures shall be removed to 30" below
grade. The site shall be reclaimed to a state compatible
to the present surroundings.
4. The Special Use Permit area shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust, and the
growth of noxious weeds.
5. Access shall be limited to the one access off U.S. Highway 85
as shown hereon. The access road shall be paved for a distance
of 50 feet from U.S. Highway 85.
6. All sewage disposal facilities installed on the site shall
conform with all applicable Weld County and State Health
Regulations. These systems shall be designed by a professional
engineer.
7. A buried tank shall be installed to collect hydrocarbon wastes
from the engine/compressor units and auxiliary equipment. The
wastes shall be pumped out and hauled to an approved disposal
site.

8. An incinerator meeting the requirements of the State of
Colorado shall be installed for the disposal of solid waste
materials. An Air Emission Permit shall be obtained for
this incinerator.

Office. A water treating system shall be provided to assure
the quality of the water.
10. The engine/compressor units may be in operation 24 hours per day
and 365 days per year.
11. A deceleration lane shall be installed by Colorado Interstate
Gas Company at the access as shown hereon. Said deceleration
lane shall be constructed in accordance with the Colorado
Division of Highways standards and installed by December 1,-1978.
12. The appearance of the facility shall be maintained in a neat
and orderly condition through periodic painting and maintenance.

Trailblazer Expansion
Dear Mr. Honn:
Our company recently submitted an application for Use By Special Review
covering the expansion of our compressor facility north of Rockport,
Colorado. These expanded facilities are to be used in conjunction with
the new 36" O.D. Trailblazer Project to transport natural gas from
Whitney Canyon in southwestern Wyoming to the Beatrice Interconnect
near Beatrice, Nebraska.
Recent studies and publications point to the large natural gas reserves
present in the Overthrust Belt areas of Utah, Wyoming, and Idaho.
Development of these reserves will require the new construction of a
new outlet, such as Trailblazer, to additional markets such as the
curtailed markets of the midwest and east. For this reason, Trailblazer
Pipeline Company, Overthrust Pipeline Company, and Colorado Interstate
Gas Company have together proposed construction of the Trailblazer
Project. Colorado Interstate Gas Company will own and operate that
portion of the project extending from near Rock Springs, Wyoming, to
our Compressor Facility north of Rockport, Colorado, parallel to our
existing natural gas pipeline system.
Our company will acquire gas supplies for transport from its affiliate,
C.I.G. Exploration Company, from preferential purchase rights on
approximately 41,000 acres in the Overthrust Belt in Lincoln County,
Wyoming, and from additional gas purchases as they are acquired. In
addition, the companies forming Trailblazer Pipeline Company and
Overthrust Pipeline Company have large commitments for gas in the
Overthrust Belt and other major Rocky Mountain fields.
In order to meet these present and future capacity requirements, it will
be necessary for our company to install new compressor facilities on the

Trailblazer Pipeline to be located at our Rawlins, Wyoming, station site
and at our Cheyenne Compressor Station -Rockport delivery point. The new
facilities to be installed at the Cheyenne Compressor Station will con-
sist of two 2,700 BHP compressors and new meter facilities as well as
the additional office space and auxiliary building required. As more
supplies are obtained from the Overthrust Belt and other major fields,
additional compressors, up to as many as six, will be needed to guaran-
tee adequate line capacity.

extension to house the control room/office.
5. Three 10' x 15' meter buildings to house meters at the
Trailblazer CIG/NGPL connection.
6. Two inlet separators to remove any liquid estrained in the
gas so it will not enter any of the engine/compressor units,
and so it will not be metered.

We have received the above referenced proposal to expand facilities
at this gas compressor station. Water which is needed for the houses and
office is supplied by two wells which were issued permits pursuant to
Colorado Revised Statute 37-92-602 (1)b and c, (permit nos. 96966 and 96967).
These wells are approximately 900 feet deep.
Insufficient information was provided concerning the increased water
requirements associated with this proposed expansion. It appears; however,
that the major change that will occur as a result of this proposal with respect
to any potential increase in the water requirements would be the increased
number of employees that are needed to operate the equipment who will use
water for drinking and sanitation purpose. Unless other major water uses
are involved, we would assume this could be met by the two wells which were
permitted on the basis of an annual withdrawal of 4 acre-feet each.
We have no objections to this proposal, provided the applicant can show
that the water requirements will remain within the limitation of the well permit.

In relation to our application submitted December 17, 1981, we
enclose a fully executed Sign Posting Certificate certifying that the
sign provided by your department was posted at our Cheyenne Compressor
Station at least ten (10) days prior to the Planning Commission Hearing
on our Use by Special Review application.
Please note that Colorado Interstate Gas Company (CIG) is an interstate
natural gas transmission company subject to regulation under the Natural
Gas Act and the Natural Gas Pipeline Safety Act. CIG believes that the
Weld County Zoning Ordinance and all related Weld County ordinances and
resolutions do not apply to CIG because the functions involved in CIG's
pipelines and appurtenant facilities are subject to the jurisdiction of
the federal government which has pre-empted these broad areas of regulation.
In its December 3, 1981 letter to CIG, the Weld County Board of County
Commissioners recognized this and advised CIG that Weld County would not
attempt to regulate CIG in the areas the federal government has pre-
empted it.
Even though CIG thus believes it is excluded from the coverage of
the previously referenced ordinances and resolutions, CIG recognizes
that Weld County has certain local concerns. As a responsible corporate
citizen, CIG has filed for a Use by Special Review as it relates to
nonpre-empted impacts. Nevertheless, CIG reserves the right to contest,
in the appropriate forum, Weld County's assertion of jurisdiction over
CIG in the areas of federal government preemption.

- It is the opinion of the Weld County Planning Commission that this
request is in agreement with the Weld County Comprehensive Plan in
that the proposed use would not appear to have any adverse impacts on
the agricultural interests of the County or the environment.
- It is the opinion of the Department of Weld County Planning Commission
that the proposed operation is in compliance with the provisions of
Section 31.4 of the Weld County Zoning Ordinance. The requested use
is one allowed in an Agricultural Zone District by special review and
would be compatible with the existing surrounding land uses.
- It is the opinion of the Weld County Planning Commission that the
attached development standards will minimize impacts on surrounding
uses and the area to the greatest extent possible and provide adequate
protection of the health, safety and welfare of the inhabitants of the
County.
- This request does not exist in an Overlay District Area.
These determinations are based, in part, upon a review of the referral entities
which have reviewed this request, the information submitted by the applicant and
other relevant information regarding this request. The Weld County Planning Commis-
sion recommendation is conditional upon the following:
1. The attached Development Standards being recommended and adopted for
the Special Use Permit to promote compliance with Sections 24.5 and
24.6 of the Weld County Zoning Ordinance.

a. Eight (8) 2,700 horsepower natural gas engine/compressor units
and auxiliary equipment with future expansion to eight (8) such
natural gas engine/compressor units.
b. Two (2) prefabricated commercial buildings, which shall house the
natural gas engine/compressor units.
c. Two (2) prefabricated commercial buildings which shall house the
office, shop, warehouse and auxiliary equipment.
d. Three (3) houses for station personnel.
e. One (1) 50' x 100' cold storage warehouse, with a 50' x 30'
extension to house the control room/office.
f. Three (3) 10' x 15' meter buildings to house meters at the Trailblazer
CIT/NGPL connection.
g. Two (2) inlet separators to remove any liquid estrained in the
gas so it will not enter any of the engine/compressor units, and
so it will not be metered.
2. The facility shall comply with all County and State Health Standards and
Regulations pertaining to air quality, water quality, noise emission, and
sanitary disposal systems. The noise levels at the property lines shall
not exceed 70 db(A) from 7:00 a.m. to 7:00 p.m. and 65 db(A) from 7:00 p.m.
to 7:00 a.m., as stated in C.R.S. 1973, 25-12-103.
3. Upon termination of the operation of the compressor station, all facilities
and structures shall be removed to 30" below grate. The site shall be
reclaimed to a state compatible to the present sourroundings.
4. The Special Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
5. Access shall be limited to the one access off U.S. Highway 85 as shown
hereon. The access road shall be paved for a distance of 50 feet from U.S.
Highway 85.
6. All sewage disposal facilities installed on the site shall conform with all
applicable Weld County and State Health Regulations. These systems shall
be designed by a professional engineer.
7. Two (2) buried tanks shall be installed to collect hydrocarbon wastes from
the engine/compressor units and auxiliary equipment. The wastes shall be
pumped out and hauled to an approved disposal site.
8. An incinerator meeting the requirements of the State of Colorado shall be
be installed for the disposal of solid waste materials. An Air Emission
Permit shall be obtained for this incinerator.
9. Water for the houses and office shall be supplied by two wells which shall
have the approval of the State Engineer's Office. A water treating system
shall be provided to assure the quality of the water.
10. The engine/compressor units may be in operation 24 hours per day and 365
days per year.
11. A deceleration lane shall be installed by Colorado Interstate Gas Company
at the access as shown hereon. Said deceleration lane shall be constructed
in accordance with the Colorado Division of Highways standards and installed
by December 1, 1978.
12. The appearance of the facility shall be maintained in a neat and orderly
condition through periodic painting and maintenance.
13. All bare areas shall be protected by revegetation or suitable gravel cover
to provide wind and water erosion protection.
14. The Special Use Permit shall be limited to the plan submitted and governed
by the Development Standards stated above and applicable Weld County regulations.
Any changes to the plans and/or Development Standards shall require approval

FORT LUPTON PUBLIC SCHOOLS - WELD COUNTY SCHOOL DISTRICT RE -8
REQUEST: A school facility
REVIEW: Per C.R.S. 22-32-124 (9) 1973.
APPEARANCE: Dr. Fink, Superintendent of Fort Lupton Public Schools stated
School District RE -8 wants to set-up satellite schools at
Wattenberg and Aristocrat Ranchettes. Wattenberg has a
building that can be used. They have purchased a building
from the Denver School District to be -used in Aristocrat.
This is technically a double wide mobile home that the
Denver School District has used for ari 1ti.onal classroom
space. Mr. McConahay, Developer of Aristocrat, has given
the Fort Lupton School District use of a lot for this
purpose. They would like to get education out of its
isolated position and back into the community, as it should
be.
Constance Schroeder, Director of Continuing Education for
the Fort Lupton School District, stated they would work
with the community to see what type of classes would be
held for both the adult and school age level population
of these areas.

Lee Morrison, Assistant County Attorney, reported schools are exempt
from county and land use regulations, in some cases the Planning Commis-
sion acts as an advisory committee. Any decision made by any body, such
as the Planning Commission, is not binding.
Constance Schroeder reported they had spoken to the applicants waiting
for water taps in Aristocrat Ranchettes, getting signed permission from
those on the waiting list so they (the school district) could move first
into line for a water tap. The Health Department has also given a written
statement that the lot is adequate for a septic system.
Rod Allison, Current Planner, indicated that the Department of Planning
Services staff recommended approval. No written recommendation was
presented.
The Chairman called for discussion from the audience. There was none.

Bob Ehrlich moved the Weld County Planning Commission approve this request.

Planning Services staff for denial.
Fred Otis, Chairman, asked if this was a request for a building permit
or a violation?
Lee Morrison, Assistant County Attorney, stated this is one of the avenues
open to Mr. Wyatt, the other would be changes in the recorded exemption.
Granting the building permit would not alleviate the violation, only the
former owners who conducted the land transaction can remedy this by apply-

ing for a recorded exemption on the piece of property that exchanged
hands.
APPEARANCE: Richard P. Wyatt appeared in his own behalf. He stated he
had bought this "80" acie parcel and applied for a building
permit for his personal residence. It was then that he
discovered that an illegal land transaction had taken place
before he purchased the property, and the acreage was not
eligible for a building permit. He explained the lay of
the land. The land which has been "split off" is
owned and farmed by the adjoining property owner. The
way a concrete ditch runs through the property, and that
in reality, the small parcel which was sold to the neighbor
really made better sense than the original plat. He also
explained he had no intention of any further subdividing
of this land, even though he is a contractor. He intends
to seed most of the land to grass and continue to farm it.
A discussion ensued by the members of the Planning Commission about why
this constituted an illegal lot, considering the size of the property,
and why, when the 1.3 acre lot that had been split off was done so to
improve the adjoining farm,the Department of Planning Services staff was
interpreting this as two illegal lots?
Chuck Cunliffe, Planning Director, explained that in order to correct this
problem we would need both property owners, at the time of this transaction,
to be party to the application. The easiest way would be to add this 1.3
acre lot to the adjacent property, which would be an amendment to a recorded
exemption that is currently on the property. Granting permission for a
building permit would not do away with the fact this land is still under
violation. The actual violation is the 1.3 acres that was taken out of
Mr. Wyatt's land which creates a subdivision.
Lee Morrison, Assistant County Attorney, stated there are really two
violations (1) the act of splitting the land without complying with
the subdivision regulations creates parcels illegally; and (2) the
act of creating parcels without complying with the subdivision require-
ments makes all of the parcels illegal parcels. The act of subdividing
withoutcomplying with the subdivision regulations, regardless of the
size, creates illegal parcels. A subdivision exemption when properly
granted, means you are exempt from the regulations. Just subdividing
without coyplying with the regulations taints all the resulting properties.
Fred Otis told Mr. Wyatt he felt he was applying a Band-Aid to the problem.
He imagined he would have quite a lot invested in his house when it was
finished and it would still be on an illegal lot. He would still have
all the current problems with more money invested into them. If these
lots never became legal he would have long-range problems. Mr. Wyatt
stated he felt the former owner of his land and the current owner of
the adjacent property would go through the proper procedures to correct
this problem. They have stated that part of the hold-up has been a

resurveying of the property, which would cost more than they paid for the
1.3 acre parcel.
Chuck Cunliffe, Planning Director, explained the recorded exemption is
issued on the entire piece, not just one part of it. The only thing we
would require is a new plat that shows the 61 acres and 1.3 acres combined.
He has a survey on the 61 acres from his other recorded exemption case;
and he has a survey on the 1.3 acres. It is not a matter of going out
and redoing the survey, it is a matter of redrafting the mylars they would
have to submit to apply for a recorded exemption.
Bill Diehl state he wished to make a statement. Living in the country
this whole thing sounded pretty rediculous to him. Isn't there someway
we can get around this? This is not the only time this is going to
happen, nor is it the only time a piece of property will change hands
and then you have to go back to the original landowner.
Chuck Cunliffe, Planning Director, replied there is no way to get around
this. We have offered some alternatives to all parties involved and have
come up with what we felt is a good solution. Even to issue the building
permit would do nothing to correct the illegality of the lots. They will
still remain illegal by definition of the County Subdivision Regulations
and State Statutes. There is a procedure they could have gone through,
they did not, and therefore, they are in violation and there is no way
we can just close our eyes and let it go away. It woun't go away. The
only issue today is, do you want to issue Mr. Wyatt a building permit on
an illegal parcel?
Bob Ehrlich asked the applicant if he was under any time restraints. He
replied no, the ground is frozen now.
The Chairman called for discussion from the audience. There was none.
MOTION
Bob Ehrlich moved that this request be tabled until the next regularly
scheduled meeting of the Weld County Planning Commission to be held on
February 16, 1982. Motion seconded by Jerry Kiefer.

land owner and see if they could remedy this problem, since he is not in
a position to remedy it himself.

APPEARANCE: Roger Houtchens, Attorney -for the applicant, stated the
applicant is asking for a replat of lots 7, 8 and 9, Block
5, town of Gill. Mrs. Warren owns both houses on these
lots and she wants to convey off the house to the east by
conveying the east two-thirds of Lots 7, 8 and 9. No
roadways, alley -ways or rights -of -way for utilities will
be changed. She just wants to put a line through the three
lots so there will only be two lots. Whomever may own the
new unimproved lot may be able to obtain a building permit
at a later date.
The Chairman called for discussion from the audience.
Dorothy Hamlet, adjacent property owner, stated she would like to see
where the line would be on the plat. She stated they have property in
the town of Gill and they want equal rights for anything that may go on
in the town of Gill from now on.

Mr. Hamlet appeared and stated they had no objections to this proposal.
He just wanted to go on record that they want equal rights if they should
happen to do something like this.
Mrs. Hamlet questioned Mr. Houtchens regarding this replat.
Mr. Houtchens stated the buyer of the larger lot will be Mrs. Warren's
son. The dividing line will be a ten foot driveway that is currently
in use by both property owners.
The Planning Commission discussed whether a new lot line would make the
garage too close to the property line and if this would allow the property
to conform with the current zoning laws. Fred Otis, Chairman, felt this'
should not enter into the Planning Commission's recommendation at this
time.
Mrs. Hamlet asked what would happen if one lot were sold or one of the
owners died? She also stated she had no objections to this request, but
if they should decide to do something of a similar nature they expected
equal rights.
Fred Otis, Chairman, told Mrs. Hamlet each application is considered on
its own merits and if they would like to file an application they were
certainly welcome to do so. They would receive the same consideration
as any other applicant.
Mr. Houtchens said, in the event of Mrs. Warren's death the garage would
have to either be torn down or moved according to the deed.
Lee Morrison felt one thing needed to be considered in the joint use of
the garage between the residents of the two houses. There is a joint
ownership in effect. One has an easement to the use and one has the
actual ownership as this is being proposed.
MOTION
Jerry Kiefer moved that the Planning Commission recommend approval of
this request to the Board of County Commissioners for the reasons as
outlined by the Department of Planning Services staff. Motion seconded
by Wilbur Wafel.

REQUEST: Expand a Natural Gas Compressor Station
LEGAL DESCRIPTION: Part of the N', Section 5, T11N, R66W of the 6th P.M.
Weld County, Colorado.
LOCATION: Three and one-half miles north of Rockport
APPEARANCE: Floyd Robertson, Colorado Interstate Gas, explained his
company currently operates two large natural gas pipelines
from southern Wyoming. They have a compressor station
located north of Rockport on a 118 acre site. This summer
they will be putting in a thirty-six inch line, which will
be tied in with two other companies, Overthrust Pipeline
Company and Trailblazer Pipeline. In order to maintain
the capacity of this line they will need to have additional
compression, but since it is operated separately, they will
need an additional compressor. Since they have the site,
and there is plenty of room, they felt they could place it
on this site. It would require no changes other than an
additional compressor. He is aware of the recommendations
of the Department of Planning Services staff, and has no
objections to them.
The Chairman asked for discussion from the audience. There was none.
MOTION
Bob Ehrlich moved this request be approved for the reasons stated in the
Department of Planning Services staff recommendation along with the
Development Standards. Motion seconded by Bob Halleran.
The Chairman asked for discussion from the members of the Planning Commis-

Bill Diehl asked if these pipelines would run parallel with the lines
that are currently there. They will.
The Chairman asked the secretary to poll the members of the Planning

Rod Allison, Current Planner, presented a request from the Mead Sanitation
and the Milliken Sanitation Districts for upgrading of their treatment
facilities to remain in compliance with the current State Discharge
Standards. They will not be enlarging their facilities. This proposal
would require a motion authorizing the chairman to sign the project
application form.

Lee Morrison, Assistant County Attorney, reported we do not need to take
an action on an ordinance. It is up to the Planning Commission to
decide whether they wish to state they have no comment, or choose to
review the materials submitted to the State and make a comment based
upon this.
The Chairman asked for discussion from the audience. Dale Olhausen,
Hogan and Olhausen, Engineers for the project explained there will be
no change in the size. They will install two aerators in existing
oxydation ponds and adding some chlorination equipment at the Mead
site. Milliken will be adding an emergency holding basin, there will
be no change other than modifications to meet current standards. They
do; however, need some type of signature on the applications.
MOTION
Jerry Kiefer moved the members of the Planning Commission authorize the
Chairman to sign on the line for "no comment" on both the Mead and
Milliken applications, meaning that we have taken no position and thereby
see no problem. Motion seconded by Bob Halleran.
The Chairman called for discussion from the members of the Planning
Commission. There was none.
The Chairman asked the members to vote by yes or no. Motion carried
unanimously.
