For your information, Kerr-McGee owns oil and gas leasehold interests in the Property and the Anadarko Entities together own the mineral interests that underlie the Property. This letter constitutes a waiver by Kerr-McGee and the Anadarko Entities to the receipt of timely notice of the hearing in Weld County on December 1, 2009 pursuant to requirements of Colorado Revised Statutes §§ 24-65.5-101 et.seq_ This waiver is limited to the Property and the timely notice of the hearing on December 1.
