GAIL 0 SUBJECT: AmUSR-485, Colorado Interstate Gas Company The Weld County Public Works Department reviewed the submitted application for critical items, including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970- 350-2163) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway U. S. Highway 85) Site Plan: The applicant needs to delineate on the plat all asphalt or gravel internal road section. U. S. Highway 85 Access Control Plan: A note should be placed on the plat identifying U. S. Highway 85 Corridor Plan. If the plan is extended to the Wyoming border, the applicant shall work with CDOT on their existing permitted access or future upgrades to this plan. Drainage Items: The water quality calculations appear acceptable to Public Works. On the plat, the water quality features need to be labeled as "Water Quality Feature -No build area". Three water well permits have been issued for the site. Well permit # 96966 is approved for "human consumption, sanitation and fire protection". Well permit # 96967 has been abandoned. Well permit # 60734-F is approved for "industrial" use. There are four septic systems on the property. Permits G19820024 and G19780168 are each permitted for 10 people. Permit SP -0400219 is permitted for 12 people and permit SP -0800235 is permitted for 4 people. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, for on site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. Installation of any air conditioning or air handling equipment that uses ozone depleting refrigerants will require analyses for possible registration in the CDPHE-APCD, CFC Program, as defined in Regulation No. 15 "Control of Emissions of Ozone Depleting Compounds", of the Air Quality Control Commission. Please notify the WCDPHE, Environmental Health Services when a/c equipment has been selected or purchased. Alternately, the applicant can provide evidence that they are not subject to these requirements. 3. The applicant shall provide the septic system permit number, for each existing septic system, and identify the location on the plat map. • • • 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of the Certificate of Occupancy for the office: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. 2 • • • 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. All pesticides, fertilizer, and other potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 8. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing private water supply. 10.Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons, at all times. 11.This application is proposing wells as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 12.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 13. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 14. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 3 ‘itz • wID€. AmUSR-485 1. A building permit shall be obtained prior to the construction of buildings or structures including the compressor building and the office building. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code, 2006 International Energy Conservation Code and Chapter 29 of the Weld County Code. 4. The office will require an engineered foundation based on a site -specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. The structure will probably be classified as B (Office) occupancy. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all properly pins shall be staked prior to the first site inspection. 7. Provide letter of approval from Nunn Fire protection District prior to construction of the office building or the compressor building.. 8. There is one active building permit and nineteen building permits with final status on record for this parcel. Since they are not increasing the traffic counts using this access at all, there is no cause for them to obtain a new CDOT access permit. State Engineer We have reviewed the above referenced proposal for a Site Specific Development Plan and Use by Special Review Permit for the amendment of an existing natural gas transmission and compression facility for a new office building and future compressor building on a parcel of approximately 117 acres. The submitted material does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. There are two existing permitted wells located within the subject parcel, permit nos. 96966 and 60734-F. Permit no. 96966 allows this well to withdraw ground water at a rate of 15 gallons per minute (gpm) for drinking and sanitary purposes inside a commercial business, fire protection, and domestic purposes for not more than three single-family dwellings. Permit no. 60734-F allows this well to withdraw up to 50.5 acre-feet per year at a rate of 32 gpm for industrial purposes. The Findings for permit no. 60734-F also indicate that the maximum annual amount of ground water that may be withdrawn by the well with permit no. 96966 is 2.5 acre- feet. Based on the current permitted uses, the well with permit no. 96966 may be used as a water supply for drinking and sanitary purposes inside the new buildings, while the well with permit no. 60734-F is restricted to industrial use. So long as the existing wells continue to be used in accordance with their permitted conditions and for their permitted uses, this office has no objections to the subject request.
