HomeMy WebLinkAbout20093149.tiffRESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV #0900227 AGAINST CODY PICKERING AND RANA SCHRODEN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Cody Pickering and Rana Schroden, ZCV #0900227, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of December, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Cody Pickering and Rana Schroden were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to refer said matter back to the Department of Planning Services, since the property owners have submitted an application for a Use by Special Review permit. REMEDY 2009-3149 elation Summary Rep t As we have previously discussed in order to maintain more than 1 (one) COMMERCIAL VEHICLE or equipment within the boundaries of a Subdivision, such as Casa Grande, a Use by Special Review (USR) shall be obtained. Additionally as we discussed, if instead, you decide to reduce to only 1 (one) Commercial Vehicle, you are eligible to instead apply for a Zoning Permit for a Commercial Vehicle (ZPCV) permit. If this is the avenue you wish to pursue all other Commercial Vehicles and/or equipment shall be removed from the property. If the appropriate application is deemed complete and submitted to this office prior to December 8th (and if necessary any additional pieces of equipment or Commercial Vehicles are removed - if proceeding with the ZPCV application), the above scheduled Violation Hearing will be cancelled. No pictures were taken during this inspection. Cody Pickering called. He stated that the letter he just received made reference to some other letter, but this was the first one he received. I explained that I sent the initial letter on 08/04/09 and then this one on 08/11/09. He said he had the 08/11/09 one in his hand. I explained the difference between the ZPCV and the USR applications/permits. He stated he had some other pieces of equipment that he has on the property that aren't utilized commercially, but they are on the property. I asked him to send a letter (or e-mail) with a picture of the piece of equipment and I would take it to our weekly staff meeting. He said he would get that done. I told him that I would automatically inspect the property sometime after 09/11/09 unless I heard from him to inspect it sooner. He said he understood. He asked me to re -send the ZPCV application. I told him I would get it out in today's mail. The Pre -Application Review was conducted at the Greeley Planning Office. The planners handed him the Violation Hearing Notification notice during the Pre -Application meeting. I left a voice mail for the complainant regarding the property being scheduled for a Violation Hearing.
