RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST PATRICK AND CALLIE SPEAR FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Patrick and Callie Spear, BCV #0800162, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Patrick and Callie Spear were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until November 20, 2009, to allow adequate time for the property owners to have a
survey of the property conducted in order to establish the property lines and the appropriate
setback and offset distances, to bring the subject property into compliance, and for an inspection
of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that BCV #0800162 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Patrick and Callie Spear to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until November 20, 2009, to allow adequate time for the
property owners to have a survey of the property conducted, in order to establish the property lines
and the appropriate setback and offset distances, in order to bring the subject property into
compliance.

corner lots abutting public rights -of -way shall not obstruct the view of vehicular traffic at an
intersection.
23-3-50.C Minimum OFFSET: three (3) feet, or one (1) foot for each three (3) feet of
BUILDING HEIGHT, whichever is greater. Fences are not required to comply with the
minimum OFFSET and may be located on the property line.
REMEDY
A current survey shall be submitted to determine property lines and offset regarding the buildings on
each side.
RECOMMENDATION
Staff recommends this case be referred to the County Attorney but delay action for 30 days to verify
offset.

04/27/2009 Phone Call Phone call from Pat Spear. He says his neighbor,
Enrique Guerrero has built a building over the property
line.
04/28/2009 Phone Call Phone call to Pat Spear. I told him a survey would need
to be done to verify the property line. He said Mr.
Guerrero has moved back his portion of the "shared"
building to meet setbacks and Pat is getting ready to do
his portion.
06/19/2009 Phone call Phone call from Pat Spear. He says he has moved the
building on his side of the property and he wants to meet
the inspector there to verify.
06/24/2009 Property Inspected Need to set property pins.
06/10/2009 Property Inspected Building has not been moved to meet setbacks.
08/25/2009 Phone Call Phone call from Pat Spear. He said he thought one of
the property pins was there. I told him the only way to
resolve this issue is to get a survey to determine where
the property line is. He said he and the neighbor do not
speak to each other so he doesn"t know how to go about
this. I suggested he call some surveyors to see what the
cost would be then write the neighbor a letter asking him
to split the cost.
10/07/2009 Phone Call Phone call from Pat Spear. He is having a survery
completed. I told him we need a copy of that and then
will need to do an inspection to verify setbacks on his
property.
10/08/2009 Phone Call After talking with Kim Ogle, I called Pat Spear. He needs
to advise his surveyor (Joe) that it is okay to release a
copy of the survey to us and can send it as a PDF file.
He will do that and said we should have it next week.

To bring your property into compliance with the Weld County Code:
A current survey shall be submitted to determine property lines and setbacks regarding the
buildings on each side.
This meeting will take place at the County Commissioners Hearing Room, First Floor, Weld County Centennial Center,
915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance at this meeting
to answer any questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners authorize the
County Attorney to proceed with legal action to remedy the violation. Our records indicate that you were made aware
of that the nature of the violation, the action necessary to correct the violation, and that you were given sufficient time to
remedy the violation. If you wish to see me personally. please call to schedule an appointment so that I may reserve a
sufficient amount of time with you.

Dear Mr. and Mrs. Guerrero and Mr. and Mrs. Spear:
Due to the unresolved setback issue regarding the "shared barn" between the two properties, it has been determined
that the property pins must be identified by submitting a current survey of the properties. Without this information,
setbacks on each side of the property line cannot be identified.
Failure to obtain a survey and submit the information to this department by August 31, 2009, will result in this office
scheduling the violations before the Board of County Commissioners to consider whether to refer the case to the
County Attorney's Office for legal action.

It has been determined that the "shared barn" that is partially on property owned by Enrique and Elise Guerrero is in
violation of the Weld County Code. As the building does not meet setbacks on either side of the property line, it must be
moved or portions removed so that it is a minimum of three (3) feet from both property lines.
It is the intention of this office to assist and cooperate with you without imposing undue hardship; however, we have no
discretion in this matter if you fail to correct this violation by June 1, 2009. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the case to the County
Attorney's Office for legal action.
