Comments made during this phase of the process will not be all-inclusive, and will address the critical issues of concern including but not limited to the Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. All issues of concern and critical issues shall be resolved with the Public Works Department. WCR 34 is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most recent AADT count for WCR 34 reflects 279 vehicles taken in 2007. The 85th percentile indicates that the average geed is 53 miles per hour with 48% of the traffic being trucks. WCR 49 is classified by the County is a Strategic Roadway, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most recent ADT count for WCR 49 reflects 3720 taken in 2009. The 85th percentile speed is 71 miles per hour with 35% truck traffic. Improvements Agreement: The applicant shall enter into an Improvements Agreement According to Policy Regarding Collateral for Improvements (Lonestar Saltwater Disposal Facility USR-1708). Please refer to Rich Hastings, Engineering, to finalize this item. Haul Route: WCR 34 between the intersections of WCR 49 and WCR 53 Improvements: In reviewing the traffic study, the applicant is identifying approximately 180 round trips (total) per day. Improvements required with the heavy hauling and hauling volume are: ➢ Upgrading to pavement of WCR 34 between WCR 51 and WCR 53, one mile ➢ Paving of the internal roadway (truck circulation pattern) parking lot and widening of the site access radiuses to 60 feet shall be required. ➢ A stop sign will be required to be installed at the access before traffic will enter onto WCR 34 ➢ A westbound left turn deceleration lane on WCR 34 • A southbound left turn deceleration lane on WCR 49 on to WCR 34 ➢ A right turn acceleration lane and a right turn deceleration lane on WCR 49 Page 1 of 3 M:\PLANNING - DEVELOPMENT REVIEW\USR-use by Special Review \USR-1708 Lonestare Injection Well Lonestar Sal Comments 08-06-09.doc sposal Facility The applicant shall provide the County with construction drawings that detail the required improvements. The ilans shall consist of, at a minimum, main entrance intersection layout and grading, cross section, approach oad, internal truck circulation pattern, and adequate turning radiuses. A geometric recommendation on depth of asphalt overlay and base to accommodate heavy truck traffic shall be provided. These plans will require approval by the Public Works Director/County Engineer or his representative. A registered professional engineer registered in the state of Colorado must prepare the construction plans. The plans, when reviewed and approved, will constitute a section of this agreement. They will be attached hereto and referenced as Exhibit "A." The applicant shall warrant and guarantee all improvements for a period of one year from completion. Maintenance: Lonestar agrees to excavate, repair, or patch any damage of said road that has been created by heavy truck hauling from this USR site. The type and method of repair will be determined by the Public Works Director/County Engineer or his representative. The repairs shall commence within thirty (30) days of receipt or our written notice. There will be an annual road inspection in the spring to determine actual conditions and what work is to be preformed that summer if any repairs are needed. In the future if road damage has increased beyond the point that repair of damage can reasonably restore the road, Lonestar will pay a proportional share for reconstruction of those parts of said road. Traffic Study: Weld County Public Works has received a Traffic Study for USR-1708 Lonestar Saltwater Disposal Facility prepared and stamped by Matthew Kruse. After reviewing the submitted traffic study I have prepared the following comments: *here are sight distance issues at the intersection of WCR 34 & 49 due to rolling hills in the area. - The applicant has indicated that this site will produce 180 trips per day. - No parking or staging of commercial vehicles on the county road is allowed. Use on -site parking area. -A stop sign will be required to be installed at the access before traffic will enter onto WCR 34. - The access will have 45' radius to accommodate the larger trucks entering and existing the site. - A westbound left turn deceleration lane is warranted on WCR 34 into the project site access based on the turning movement figures in the traffic study. -A southbound left turn deceleration lane is warranted on WCR 49 onto the WCR 34 based on the turning movement figures in the traffic study. - Although turn lanes are not warranted on WCR 49 based on the proposed trip volumes supplied in the Traffic Study Public Works is requesting a right turn acceleration lane and a right turn deceleration lane on WCR 49 to account for: • • The heavy trucks in use which require longer acceleration and deceleration times and lengths as compared to passenger vehicles • Public safety the 85th percentile is 71 mph on WCR 49 and there have been 6 accidents in the past 4 yrs. Preliminary Drainage Report: A preliminary drainage report stamped, signed, and dated by Daniel Dean Hull, P.E. number 39337, was submitted for review. 1. Please provide a final drainage report which addresses all redline comments in the preliminary report and on the drawings associated with the preliminary drainage report. 2. Please ensure that the final drainage report and all associated drawings are stamped, signed, and dated by a registered professional engineer licensed in the State of Colorado. 3. Please provide an in-depth discussion regarding the off -site flows and how they will impact the site if WCR 34 is overtopped. 4. Weld County's experience with the detention pond outlet design provided by the applicant is that they are difficult to maintain and clog easily. Please design an orifice plate and trash for the outlet instead of the riser pipe. 5. It should be noted that a grading permit will not be issued until all issues have been resolved and a set of acceptable construction plans have been provided to Public Works. An early grading permit will not be issued. Prior to the issuance of a grading permit, the applicant must submit evidence of approval of a stormwater construction permit from the Colorado Department of Public Health and Environment. Geotechnical Report: The applicant has submitted a Geotechnical Report for the onsite conditions which was stamped, dated, and signed by Joels C Malama, P.E. # 42184. The report does not contain a design for the on -site asphalt pavement. A pavement design pavement design shall be submitted for review. Flood Hazard Development Permit: Not required. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall file an Air Pollution Emission Notice (A.P.E.N.) with the Colorado Department of Health and Environment's (CDPHE) Air Pollution Control Division. 2. A Ground Water Monitoring Plan shall be submitted to the Weld County Department of Public Health & Environment (WCDPHE) for review and approval. 3. Stormwater Discharge Permit coverage shall be obtained from the CDPHE Water Quality Control Division for construction activities. We recommend that the following requirements be met prior to receiving final approval of building permits: 1. A concrete secondary containment structure (floor and walls) surrounding each tank or battery of tanks shall be constructed. The volume retained by the structure shall be 150% greater than the volume of the largest tank inside this structure. A registered professional engineer shall design the structure. The structure shall prevent any release from the tank system from reaching land or waters outside of the containment area. The operator shall provide evidence from the engineer to the Weld County Dept. of Public Health and Environment (WCDPHE) indicating that the structure has been constructed to meet this criterion. • • • 2. A detailed design of the "concrete unloading pad" shall be submitted to WCDPHE for review and approval. The design shall demonstrate how all spilled waste, stormwater and wash down water will be contained within the receiving area and concrete sump. The design shall also include the method in which seams will be sealed to prevent leakage through the pad. A leak detection system shall be designed and installed beneath the "concrete unloading pad". The "concrete unloading pad" shall be constructed and operated in accordance with the approved design. 3. The applicant shall submit evidence to the WCDPHE, Weld County Planning Services and the Colorado Oil and Gas Conservation Commission (COGCC) that the facility was constructed in accordance with application materials. 4. A copy of the drilling log shall be submitted to the WCDPHE. 5. An individual sewage disposal system (I.S.D.S.) permit is required for sewage flow from the proposed office building. The system must be designed by a Colorado Registered Professional Engineer and in accordance with Weld County I.S.D.S. Regulations. 6. Solids and sediment will accumulate in the storage tanks. The facility shall submit a detailed plan to WCDPHE for approval that describes the method of solids removal, including all on -site handling procedures and disposal. Any amendments to the approved plan shall be submitted in writing to WCDPHE for approval. 7. A Detailed Closure Plan shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. The Closure Plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. 8. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third -party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. In the event the COGCC does not have the authority to require financial assurance for the entire cost required for the third -party closure, the facility shall post the remainder of the financial assurance with Weld County. The facility shall submit evidence, in writing, to the WCDPHE that the appropriate financial assurance has been obtained. We recommend that the following requirements be incorporated into the permit as development standards: 2 • • • 1. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 2. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. 3. No disposal of waste, other than Class II, as defined by the Environmental Protection Agency, is permitted. Any changes from the approved Class II use would require an amendment to this Special Use Permit. 4. Any wastes generated on the facility shall be disposed of in accordance with the Colorado Solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation or law. 5. This facility shall adhere to the maximum permissible noise level of 70 dBA as allowed in the industrial Zone as delineated in 25-12-103 C.R.S. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 7. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 8. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. 9. All liquid wastes received at the facility shall be unloaded on the unloading pad. The concrete unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. During winter months, the facility shall maintain the unloading pad free of ice. 10.Any analysis of waste shall be forwarded to the WCDPHE, who reserves the right to require additional, more extensive monitoring at a later date. 11.All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12.Any petroleum contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. 13. The property owner or operator shall be responsible for complying with all of the Development Standards. Noncompliance with any of the Development Standards may be reason for revocation of the Permit by the Weld County Board 3 • • • of County Commissioners. 14.The facility shall comply with the approved groundwater monitoring plan. 15.All storm water, which has come into contact with waste materials on the site, shall be confined on the site. In the event that storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site -wide storm water plan shall be developed and implemented. The plan must be approved, in writing, prior to implementation by WCDPHE and CDPHE. 16.Adequate drinking water, hand washing, and toilet facilities shall be provided. 17.Any individual sewage disposal system (I.S.D.S.) on the property shall be permitted, installed, maintained and operated in compliance with all provisions of the Weld County Code, pertaining to I.S.D.S. 18.
