Captain Taylor,
I spoke with you on Friday, May 29th, 2009 concerning a deed that was signed by the Region
VIII Secretary of Department of Health Education and Welfare in 1966. The reason the deed
was signed by the of Department of Health Education and Welfare was because the land was
owned by the Federal Government and the sale had provisions that the new owner use the
facility in part for educational purposes for a period of 20 years. The facility was subsequently
sold in 1986. CEESI is requesting an amendment to its Use By Special Review (USR) permit
with Weld County and is adding another building to our facility. The amended USR process
requires we notify the mineral rights owner of our request. I have attached the original deed in
1966, the new deed in 1986, our request, and our correspondence with Weld County.
I understand that it is rare that the of Department of Health Education and Welfare gets
• involved with land issues and we just need your consent. Because this issue is probably better
addressed by the BLM branch of the Federal government, we are also sending a letter to:

AmUSR-954 is scheduled for June 2, 2009 at 1:30PM in the Greeley Planning office Hearing Room. This is the same
building that we have previously met to discuss this facility.
The County Attorney's office believes that the interests are protected in that the Grantee (CEESI) will provide all royalties to
the Grantor (US Government). Notice is still required, and a letter should be sent to the Regional Director Region 8

In this letter of notification, CEESI should state that the royalties from any resource development will be protected
as the QuitClaim Deed dated April 1, 1966, Reception Number 1485929 provides this protection.
Further, CEESI is requesting waiver of the thirty day notice requirement prior to a Public Hearing.
Submit a cover letter, the QuitClaim Deed and the Public Notice on CEESI letterhead for their review.
The referral comments will be addressed at the conclusion of the hearing process. The last hearing is scheduled before the
Board of County Commissioners on June 24, 2009. This hearing is at 10 a.m. and is in the
Centennial Building 915 Tenth Street.
Staff has suggested that the case be placed on the consent agenda. This means that unless there is opposition or concerns
from at least two commissioners, the case will be forwarded to the Board of County Commissioners with a recommendation
of approval. As representative for the application you and /or Roger should be prepared to answer inquiries should any be
presented.
For the purposes of our presentation, is there an electronic version of the site delineating the placement of the structures, the
fonner missile bay and similar physical features? This document may be schematic but have a level of accuracy to
demonstrate how the existing structures integrate with the former Atlas E site.

• You had faxed me the CEESI quick claim deed from April 1st, 1966 identifying the
mineral rights owners as the Grantor (United States of America). Did the Weld County legal
staff waive the requirement for a 30 day notification to the mineral rights owners (United States
of America) for the USR process? In other words are we still scheduled for a June 24th
hearing date?
• In the USR packet that was returned to us, everything was checked as "We have
reviewed the request and find no conflicts with our interests." In the Referrals
w/comments section there are comments and recommendations from Robert Powell (Plans
Examiner), Roy Rudisill (OEM), David Snyder (Public Works), and Lauren Light (Environmental
Health). Are we required to address each comment and each recommendation made? Many
of the issues raised were already addressed in the information that we submitted or in the
original USR-954.
Can you give me some details concerning our upcoming meeting on June 2nd, specifically:
• What time is the meeting?
• Where do we meet?
• Will this meeting be similar to our earlier USR application meeting where
representatives from the Health Department, Public Works, and the like, review our package
and we answer questions each department might have?
• Is there anything we need to do in preparation for the meeting?
• Can Roger Shaffer and I represent CEESI (as we have done before) or is it
necessary to have the owners attend?
