RESOLUTION WHEREAS, a public hearing was held on March 3, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of the Colorado State Highway Depart- ment, c/o Leo O'Connor, 1420 Second Street, Greeley, Colorado, (Lynn Shipps land) requesting permission to locate a gravel pit operation on the following described property: A parcel of land located in the Northwest Quarter of Section 36, Township 9 North, Range 66 West of the 6th P. M. , Weld County, Colorado, and more particularly described as follows to-wit: Beginning at a point in the Northwest Quarter of said Section 36 from which point the Northwest Corner of Section 36 bears North 28°50' West a distance of 1847 feet, more or less, to the point of beginning; Thence South and parallel to the West side of said Northwest Quarter a distance of 470 feet to a point; Thence East and parallel to the North side of said Section 36 a distance of 530 feet to a point; Thence North and parallel to the West side of said Section 36 a distance of 225 feet to a point; Thence West and parallel to the North side of said Section 36 a distance of 110 feet to a point; Thence North and parallel to the West side of said Section 36 a distance of 245 feet to a point; Thence West and parallel to the North side of said Section 36 a distance of 420 feet more or less to the point of beginning, containing 5. 10 acres, more or less, and WHEREAS, the Petitioner was present, being represented by Mr. Joe Intermill, Assistant Highway Engineer of the Colorado Highway De- partment, and WHEREAS, there was no opposition to the request of Petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be author- ized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the Petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Department, c/o Leo O'Connor (Lynn Shipps land), to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: p • i"? i 750439 7 i 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That Petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when gravel extraction is completed said premittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit excavation and rehabilitation shall be limited to plans as submitted and in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. SUBJECT: Minutes MOTION: By Mr. Heitman to approve the minutes of November 19, 1974 as mailed. Seconded by Mr. Rothe. A unanimous vote of "Aye". Motion carried. SUBJECT: Mobile Home Regulations APPEARANCE: Bob Adams, Zoning Inspector Tape 563 DISCUSSION: Mr. Adams stated that, administratively, the Planning Commission established the procedure that mobile home permits were issued on a temporary basis. This is not really backed up by our regulations. Presently, mobile homes are allowed on farms over 80 acres irrigated, 160 acres dryland for farm use on a temporary basis and must be renewed annually. The smaller parcels of ground have been referred to the Board of Adjustment for approval or disapproval . A lot of those allowed on the farms are put on foundations and put on tax rolls. These people feel they are being taxed twice. Would like to change the regulations one way or the other. Staff recommendation is to revamp the complete mobile home regulations covering the temporary permit and adding Section "F" which would apply to all instances with the exception of Section Mr. Honn stated that the 12 month renewal and review was to give us the ability to check and make sure the mobile home was still being used for its original use allowed. Need the 12 month check defined better in the regulations. It is allowed to just store a mobile home on one's property by just paying the taxes. Need to clarify wording in the proposed amend- ment. Need some more work on proposed amendment. SUBJECT: Globe Drilling Violation LOCATION: SEQ SEQ Sec 32 Ti R66 APPEARANCE: Bob Adams, Zoning Inspector DISCUSSION: Globe Drilling has been sent two violation letters regarding storing oil field equipment in an agricultural zone. Location is the SD-4 SEQ Sec 32 T1N R66 West. As of December 3, 1974, there are three trailers, one truck and three engines sitting on the ground; one tool or suply box, two large piles of debris, several two-wheel trailers, miscellaneous drill stems, hoses, steel , forms and two junk cars. In May, 1974 the first violation letter sent. There is a subdivision right next to this property. 1106 RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners that legal action be taken by the County Attorney against Globe Drilling Co. , 401 Bridge Street, Box 455, Brighton, Colorado 80601 . Motion by Mr. Rothe, Seconded by Mr. Heitman. A vote of "Aye" by Nix, Heitman, Yost, Rothe and Elliott. Motion carried APPLICANT: State Highway Department (Lynn Shipps property) CASE NUMBER: SUP #271 Tape 563 SUBJECT: Gravel Pit LOCATION: NW4 Sec 36 T9 R66 APPEARANCE: Joe Intermill , State Highway Dept. DISCUSSION: Property about two miles east of Nunn. Do not own property, will be just buying the sand and gravel . About five acres. Will do small areas at a time. Overburden will be spred back over the backslopes and reseeded. Five to six feet above flood plain. Weld County Planning Commission staff recommends approval for the following reasons: (1 ) Complies with the Weld County Comprehensive Plan page 50, paragraph 6; page 71-72 paragraph 1 and 2 of the September 1973 printing; (2) Con- forms with H.B. 1529 for sand and gravel extraction; (3) County Engi- neer recommends approval ; (4) Colorado Geologic Survey recommends ap- proval . SUBJECT TO: (1 ) County Engineer's recommendation that only State trucks will haul from the site; (2) Excavation to begin within 12 months from date of approval by Board of County Commissioners; (3) Excavation being limited to plans submitted. Mr. Straub asked if they were going to haul on County Road 98 or 100. Mr. Intermill answered Road 98. Mr. Straub has not inspected Road and would like a chance to check for bridges, etc. Mr. Intermill did not think there were any bridges on this road. Reclamation of land is in- cluded in the Subject To' s under #3. Mr. Juntunen felt there should be a direct reference in the Resolution to the reclamation plans. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to recommendations. Motion by Mr. Heitman, seconded by Mrs. Yost. A vote of "Aye" by Nix, Heitman, Yost and Elliott. Motion carried. (Mr. Rothe left) APPLICANT: Weld County CASE NUMBER: SUP #270 Tape 563 SUBJECT: Gravel Pit LOCATION: Pt SE4 Sec 18 T2 R66 APPEARANCE: Richard Straub, County Engineer DISCUSSION: Weld County has obtained several sites for gravel pits for our own use to gravel the county roads. Located at the dead end just east of Vollmar. Will be done in three phases. Will become a recreational area when the pit operation is completed. Will work with the Game and Fish Department on its development. East side of road and west of the river. Weld County Planning Commission staff recommends approval for the following reasons: (1 ) Complies with the Weld County Comprehensive Plan page 50, paragraph 6; page 71-72 paragraphs 1 and 2 of the September 1973 printing, and complies with Weld County Zoning Resolution regarding extraction of mineral resources; (2) Conforms with H.B. 1529 for sand and gravel extraction; (3) Colorado Geologic Survey recommends approval ; (4) County Engineer recommends approval . SUBJECT: Gilbert Schultz DISCUSSION: Mr. Juntunen requested present status of case against Mr. Schultz who has three mobile homes on his property, Lot 4 Lundgren Subdivision. Request that legal action be taken by the County Attorney. Originally notified in May 1974. Subdivision located in the Southeast Quarter of Section 4, Township 5 North, Range 65 West of the 6th P.M. MOTION: By Mr. Heitman, To recommend to the Board of County Commissioners that legal action be taken against Mr. Schultz by the County Attorney. Seconded by Mr. Elliott. We are requesting permission to remove sand and gravel from an area which has previously been used as a source of these materials. The pit lays in the creek bed and flood plain of Lone Tree Creek. This is a dry creek which flows only during periods of run off. The area is designated V 1 on Plate 1 of Special Publication 5-A Sand, Gravel, and Quarry Aggregate Resources - Colorado Front Range Counties. Portions of the floodplain are covered with sod. The top 0.31 in these areas will be stripped and stockpiled. Then, after the gravel has been removed, the stripped material will be spread on the backslopes and bottom of the bit which is not laying in the creek channel. These areas which ha-•e overburden placed on them will then be seeded. Useable gravel depths appear to be 81+. Backslopes will be left no steeper than 3:1. The material will probably be removed by dozer or front end loader, processed through a crushing or screening plant, then it will be stockpiled and either processed through an asphalt plant or hauled to the road as untreated sand and gravel. This area is designated vT on Plate 1 of Special rubleation 5-A-Sant , oravel , and Quarry Aggregate Resources - Colorado Front Range Counties. Sand and gravel have been previously removed from within the area ',hick we propose to work. The present creek bed has no overburden or vegetation over it 'isle top 0:3 of any area covered with overburden will be str,nne an.1 rtorkpiled. Then, after the gravel has been removed, the strippe •naterial will he spread on backslopes and bottom of the pit which is not iaytn- tr creek channel. These areas which have overburden placed on them will re n be seeded, The backslopes and bottom of the pit area will he smoothed up and left in a neat condition with backslopes being left no steeper than 3:1. While the exact gravel depth has not yet been determined, a preliminary hole indicated over eight feet of material. The quanity of material removed from this pit will vary from year to vcar, as highway maintenance and repair work needed in the area will dictate the amount of material removed. As soon as enough material is removed from an area to make reclamation work feasible we will begin reclamation of that area.
