WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Ls, Colorado has reviewed the request of Arnulfo and Augustine Lopez for an exemption from the definition of "subdivision" and "sub- divided land" in Section 30-29-101 (10) , CRS 1973, as amended, ;_.; and Section 2-1 of the Weld County Subdivision Regulations, and L WHEREAS, the Board of County Commissioners finds that Arnulfo and Augustine Lopez are owners of certain parcels of land located in Part of the Northwest Quarter of Section 6 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Parcel I A parcel of land in the Northwest Quarter (NA) of Section 6, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northwest Corner of said Section 6, and considering the West line of said Section 6 to bear South 00°00'00" West, with all other bearings contained herein relative thereto; Thence South 00°00'00" West, 435.00 feet; Thence South 88°16'10" East, 30.01 feet to the True Point of Beginning; Thence South 88°16'10" Fast, 266.22 feet; Thence North 01°17'03" Fast, 60.00 feet; Thence North 88°16'10" West, 267.50 feet; Thence South 00°00'00" West, 60.03 feet to the True Point of Beginning. Said described parcel contains 0.368 acres, more or less, and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. Arnulfo and Augustine Lopez are brothers and Arnulfo Lopez desires the subdivision exemption so that he will be assured of a permanent ingress and egress to his property. The access will be across Augustine Lopez ' present property. No new parcels are being created by this request, and WHEREAS, the legal descriptions of the resulting parcels of land are as follows : Augustine P. and Guadalupe Lopez Lot B of Recorded Exemption No. 0803-31-3-RE223 , recorded August 24, 1976 in Book 775 as Reception No. 1696997, Weld County Records, being a part of Lot B of the SWa of the SWa of Section 31, Township 6 North, Range 65 West of the 6th P.M. , according to the subdivision of lands by the Union Colony of Colorado, Weld County, Colorado, except Parcel I as described above and including Parcel II as described above. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Parcel I and Parcel II as hereinabove described be, and hereby are, declared to be exempt from the definition of "subdivision" and "subdivided land" as set forth in Section 30-29-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations , and BE IT FURTHER RESOLVED by the Board that the resulting parcels of land as described above be, and hereby are, considered to be single lots.
