WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS ,ithas been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 22nd day of August, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of Helmut Simon, located in all that part of the NEa of Section 11 , Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, more particu- larly described as follows : All that part of the NEa of Section 11, Township 6 North, Range 67 West of the 6th P.M. , Weld County, lying East of the right of way conveyed to the Northern Construction Company by deed recorded in Book 221 at page 49 , Weld County Records; and all that part of the SEa of said Section 11, described as follows : Beginning at the South- east Corner of said Section 11; Thence North 00°18 ' West along the East line of said Section 11, 882 feet, the True Point of Beginning; Thence North 89°48"West, 1429 feet; Thence North 57°20 ' West, 350 feet; Thence North 81°49 ' West, 350 feet; Thence North 57°52 ' West, 643 feet; Thence North 00°45 ' West, 1300 feet to an iron pin at the intersec- tion of the East line of the right-of-way of The Great Western Railway as now constructed and the East and West centerline of said Section 11; Thence North 89°30 ' East, 2620. 4 feet, more or less, to the East line of said Section 11; Thence South along the East line of said Section 11 to the True Point of Beginning. Said described parcel of land contains 227. 007 acres , more or less , and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. does not come within the purview of the definition of the terms "subdivision" and "subdivided land" as set forth in Section 30- 28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- ee' PC- I/ 770669 missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land owned by Helmut Simon, be exempt from the definition of the terms, "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-lA(3) of the Weld County Subdivision Regulations. The parcel of land in question is described as Pt. Ei of Section 11 , T6N, R67W of the 6th P. M. , Weld County , Colorado. The property is located 1 mile south of Severance. The subject property contains 227 . 007 acres of predominantly Class II and III irrigated soils. The request is to split the property into parcels of 1. 007 acres and 226. 0 acres . Presently there are two sets of residential improvements with associated out buildings located in the northeast corner of the proposed Lot B. As stated in a letter dated July 27 , 1977 , it is Mr. Simon' s intention to sell the proposed Lot B and retain the proposed Lot A as a new residential site . Based upon the information submitted and the adopted policies in the County, the Planning Commission Staff recommends the request be approved for the following reasons : 1. The Severance Planning Commission has indicated they have no objec- tions to the granting of the recorded exemption. 2. The Windsor Planning Commission has indicated they have no objec- tions to the approval of the request. 3. Theproposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the agricultural districts (Sec- tion 3. 3a of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since the use would be compatible with the sur- rounding agricultural uses. 4.
