Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. I am a 30+ year residential Realtor here in Greeley and have attached a total of six sales during the targeted time period of Jan, 07 to June, 08. The Assessor has determined an increase in the value of my residence since the previous valuation from $504,287 to $514,516 which is a 2% increase. It is my contention as a 30 + year professional Realtor in Greeley that NO neighborhood had an increase during that period of time and in fact most neighborhoods suffered (and continue to suffer) a 10% to 20% total decrease in value. It is inaccurate to believe a house that was not improved or changed had market forces cause it's value to increase when all other neighborhoods had a distinct and measurable decrease in values. I am including six comparable sales during the Jan 07 to June 08 time period. Three are in my immediate neighborhood and three are similar size and types of properties in like neighborhoods similar to mine. The Assessor has my house as a 2309 sq ft ranch with a mostly finished daylight basement built in 2003.
