The violation was initiated due to the operation of "Jessup Trucking" without first going through the Site Plan Review [SPR] permitting process. This case has not been presented to the Board of County Commissioners through the Violation Hearing process. This application if approved, conditions met and plat recorded will correct the violation. If the application is denied or not recorded in a timely fashion, Code Compliance will proceed with the violation by scheduling a Violation Hearing before the Board of County Commissioners to refer this case to the Attorney's office for legal action; otherwise all storage, operations and advertisements shall be removed from the property. This site plan review is approved with the attached conditions: Prior to recording the Site Plan Review plat, the applicant shall address the following to the Department of Planning Services' satisfaction: A. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Evidence of their approval shall be submitted to the Weld County Department of Planning Services. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). The applicant shall attempt to address the requirements (concerns) of Greater Brighton Fire Protection District, as stated in the referral response dated October 27, 2008. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Greater Brighton Fire Protection District) C. The applicant shall either submit a copy of an agreement with the property's mineral owner/operators stipulating that the oil and gas activities have been adequately incorporated into the design of the site or show evidence that an adequate attempt has been made to mitigate the concerns of the mineral owner/operators. Drill envelopes can be delineated on the plat in accordance with the State requirements as an attempt to mitigate concerns. The plat shall be amended to include any possible future drilling sites. The applicant has submitted a Private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all landscaping, transportation (access drive, parking areas, et -cetera) and non -transportation (plant materials, fencing, screening, water, signage et -cetera). The applicant shall submit to the Department of Planning Services an itemized landscaping bid for review. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Site Plan Review plat. Or the applicant may submit evidence that all the work has been completed and approved by the Department of Planning Services and the Department of Public Works. The applicant shall address the concerns of the Department of Public Works, specific to the items addressed in the referral dated November 6, 2008. These items include: 1. Delineation of the water quality control feature in a drainage easement; 2. Internal traffic circulation plan; 3. Estimated traffic counts to the facility for employees, customers and visitors; 4. Signed by a registered professional engineer, licensed to practice in the State of Colorado, stamped and dated Construction Drawings; 5. Signs designating truck parking shall be delineated on the construction drawings, with a detail of such. 6. All redline comments on the construction plans shall be addressed. The applicant shall provide written evidence that the individual employed as the caretaker residing in the existing stick built structure located at 12675 County Road 4 is employed by Jessup Transportation or by the property owner, Ruby Hammond. The applicant shall submit a dust abatement plan (on site dust) for review and approval, to the Environmental Health Services, Weld County Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Department of Public Health and Environment) H. The plat shall be amended to delineate the following: All pages of the plat shall be labeled Site Plan Review SPR-425. (Department of Planning Services) 2. The Site Plan Review Map shall be prepared in accordance with Section 23-2- 160.V of the Weld County Code, specifically to scale and label all adjacent County Roads. The vicinity map shall be delineated on the plat in compliance with Section 23-2- 160.V.6 of the Weld County Code, specifically illustrating the parcel and surrounding parcels. (Department of Planning Services) 4. The sight distance triangles shall be delineated on the plat. Any existing landscaping within the sight distance triangles shall be removed and relocated. The applicant shall provide at a minimum eight (8) parking stalls for this facility The dimensions of the parking stalls shall adhere to Section 23-4-30 and Appendix 23-A of the Weld County Code. This site will not be required to meet all requirements of the American Disability Act (ADA). (Department of Planning, Services) 6. The applicant shall delineate the location of curb stops in the parking areas per Section 23-4-30.D of the Weld County Code. (Department of Planning Services) 7. The applicant shall show the type of lighting that will be used on site in conformance with the Weld County Code. (Department of Planning Services) 8. County Road 4 is classified by the County as a local paved road, which requires 80 feet of right-of-way at full build out. The applicant shall verify the existing right- of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. The plat shall delineate the existing right-of-way and the documents which created it along with any additional right-of-way reservation required. (Department of Public Works) 10. The single approved access into the site from County Road 4 per Weld County Code Section 8-2-20. (Department of Public Works) 11. Signs designating truck parking shall be delineated on the construction drawings, with a detail of such. (Department of Public Works) 12. Add a note to the cover sheet of the Site Plan Review Plat stating that Weld County will not be responsible for the maintenance of the water quality control features. (Department of Public Works) 13. The entrance to the site shall be paved a minimum of sixty (60) feet from the edge of the right-of-way. The cattle guards shall be installed at the end of the north end of the paved entrance. Public Works will allow the use of recycled asphalt (RAP) behind the property line. (Department of Public Works) 14. Delineate the erosion control measures (silt fence, straw bales, et cetera) on the grading plan. (Department of Public Works) G. The following notes shall be placed on the plat: All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future rights -of -way line. 2. In the event that a portion of the building is proposed to be leased or sold to another party in the future, the applicant shall submit a copy of the lease of sales agreement and information regarding the proposed use of the leased portion to the Weld County Building Inspection Department, Mountain View Fire Protection District and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. (Department of Planning Services) 3. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the Commercial and Industrial Zone District until a Site Plan Review has been approved by the Department of Planning Services. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 5. No permanent disposal of wastes shall be permitted at this site. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. (Department of Public Health and Environment) 7. The applicant shall operate in accordance with the approved "waste handling plan". (Department of Public Health and Environment) 8. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone District, as delineated in 25-12-103, Colorado Revised Statutes, as amended. (Department of Public Health and Environment) 9. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. (Department of Public Health and Environment) 10. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. (Department of Public Health and Environment) 11. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. (Department of Public Health and Environment) 12. The facility shall utilize the existing commercially permitted well. (Commercial Well # 278173) (Department of Public Health and Environment) 13. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health &Environment, Water Quality Control Division. (Department of Public Health and Environment) 14. The operation/property shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. A building permit application must be completed, and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report preformed by a registered State of Colorado engineer shall be required. (Department of Building Inspection) 16. A plan review must be approved and permit must be issued prior to the start of construction. (Department of Building Inspection) 17. New construction shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) 18. Setback and offset distances shall be determined by the 2006 International Building Code and Chapter 23 of the Weld County Code. Prior to the release of building permit, the applicant shall submit evidence of approval from the Greater Brighton Fire Protection District to the Weld County Building Department. (Department of Building Inspection, Greater Brighton Fire Protection District) 20. Landscaping materials as indicated in the approved Landscape / Screening Plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. (Department of Planning Services) 21. Lighting shall comply with the requirements and standards for off-street parking spaces per Section 23-4-30.E, Section 23-2-250.D and Section 23-3-250.B.6 of the Weld County Code. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. The property owner shall allow any mineral owner the right of ingress or egress for the purposes of exploration development, completion, recompletion, re-entry, production and maintenance operations associated with existing or future operations located on these lands. The applicant should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically test it over time. A stormwater discharge permit may be required for a development/redevelopment/ construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. An individual sewage disposal system is required for the proposed office and shop buildings and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The legal description is Subdivision Exemption number 997; being part of the SE4 of Section 30, Township 1 North, Range 66 West of the 6th P.M., Situs Address is 12679 County Road 4. Background Information: Jessup Trucking has been in operation at this location for several years and was recently cited for non-compliance with the lack of a Site Plan Review when representatives for the applicant attempted to apply for a new office trailer to be located on site. Access is from CR 4 a two lane paved road having Collector status or 80 feet of right-of-way The use of the property will remain. A single family residence, a barn and a loafing shed are currently positioned on site. All improvements will be retained with the loafing shed to be utilized for screening of personal vehicles parked on site. Brighton Fire Protection District is the responding agency Mountain View Water, ISDS/Sewer] Site Plan required delineating circulation, parking for personal and commercial vehicles, lighting Traffic Study not required, 40 foot radius required at all points of ingress and egress utilized for the Jessup Trucking Facility. Landscape improvements will consist of placing a 15 -foot wide strip of decorative rock on the south side of the property, outside of the future Weld County Road 4 right-of-way. Existing site runoff flows north and discharges into the existing Cottonwood Ski Lake on the property north of the site. A water quality capture pond/structure will be constructed at each of the existing 3 rundowns channels that convey stormwater from the site to the ski lake. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan (on site dust) for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3.
