Narrative:
This facility has an active Zoning Violation (ZCV08-00212). The violation was initiated due to the
operation of "Jessup Trucking" without first going through the Site Plan Review [SPR] permitting process.
This case has not been presented to the Board of County Commissioners through the Violation Hearing
process.
This application if approved, conditions met and plat recorded will correct the violation. If the application
is denied or not recorded in a timely fashion, Code Compliance will proceed with the violation by
scheduling a Violation Hearing before the Board of County Commissioners to refer this case to the
Attorney's office for legal action; otherwise all storage, operations and advertisements shall be removed
from the property.
This site plan review is approved with the attached conditions:
Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
A. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health & Environment.
Evidence of their approval shall be submitted to the Weld County Department of Planning
Services. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the facility
name, address, and phone number). (Department of Public Health and Environment)
B. The applicant shall attempt to address the requirements (concerns) of Greater Brighton
Fire Protection District, as stated in the referral response dated October 27, 2008.
Evidence of such shall be submitted in writing to the Weld County Department of

C. The applicant shall either submit a copy of an agreement with the property's mineral
owner/operators stipulating that the oil and gas activities have been adequately
incorporated into the design of the site or show evidence that an adequate attempt has
been made to mitigate the concerns of the mineral owner/operators. Drill envelopes can
be delineated on the plat in accordance with the State requirements as an attempt to
mitigate concerns. The plat shall be amended to include any possible future drilling sites.

D. The applicant has submitted a Private Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for all landscaping,
transportation (access drive, parking areas, et -cetera) and non -transportation (plant
materials, fencing, screening, water, signage et -cetera). The applicant shall submit to the
Department of Planning Services an itemized landscaping bid for review. The agreement
and form of collateral shall be reviewed by County Staff and accepted by the Board of
County Commissioners prior to recording the Site Plan Review plat. Or the applicant
may submit evidence that all the work has been completed and approved by the
Department of Planning Services and the Department of Public Works. (Department of

E. The applicant shall address the concerns of the Department of Public Works, specific to
the items addressed in the referral dated November 6, 2008. These items include:
1. Delineation of the water quality control feature in a drainage easement;
2. Internal traffic circulation plan;
3. Estimated traffic counts to the facility for employees, customers and
visitors;
4. Signed by a registered professional engineer, licensed to practice in the
State of Colorado, stamped and dated Construction Drawings;
5. Signs designating truck parking shall be delineated on the construction
drawings, with a detail of such.
6. All redline comments on the construction plans shall be addressed.

F. The applicant shall provide written evidence that the individual employed as the caretaker
residing in the existing stick built structure located at 12675 County Road 4 is employed
by Jessup Transportation or by the property owner, Ruby Hammond. (Department of

G. The applicant shall submit a dust abatement plan (on site dust) for review and approval,
to the Environmental Health Services, Weld County Department of Public Health and
Environment. Evidence of such shall be submitted in writing to the Weld County

H. The plat shall be amended to delineate the following:
All pages of the plat shall be labeled Site Plan Review SPR-425. (Department of

2. The Site Plan Review Map shall be prepared in accordance with Section 23-2-
160.V of the Weld County Code, specifically to scale and label all adjacent
County Roads. (Department of Planning Services)
3. The vicinity map shall be delineated on the plat in compliance with Section 23-2-
160.V.6 of the Weld County Code, specifically illustrating the parcel and
surrounding parcels. (Department of Planning Services)
4. The sight distance triangles shall be delineated on the plat. Any existing
landscaping within the sight distance triangles shall be removed and relocated.

5. The applicant shall provide at a minimum eight (8) parking stalls for this facility
The dimensions of the parking stalls shall adhere to Section 23-4-30 and
Appendix 23-A of the Weld County Code. This site will not be required to meet
all requirements of the American Disability Act (ADA). (Department of Planning,

6. The applicant shall delineate the location of curb stops in the parking areas per
Section 23-4-30.D of the Weld County Code. (Department of Planning Services)
7. The applicant shall show the type of lighting that will be used on site in

8. The location and dimensions of any proposed signs per Article IV Division 2 of

9. County Road 4 is classified by the County as a local paved road, which requires
80 feet of right-of-way at full build out. The applicant shall verify the existing right-
of-way and the documents creating the right-of-way. If the right-of-way cannot be
verified, it shall be dedicated. The plat shall delineate the existing right-of-way
and the documents which created it along with any additional right-of-way

10. The single approved access into the site from County Road 4 per Weld County
Code Section 8-2-20. (Department of Public Works)
11. Signs designating truck parking shall be delineated on the construction drawings,
with a detail of such. (Department of Public Works)
12. Add a note to the cover sheet of the Site Plan Review Plat stating that Weld
County will not be responsible for the maintenance of the water quality control

13. The entrance to the site shall be paved a minimum of sixty (60) feet from the
edge of the right-of-way. The cattle guards shall be installed at the end of the
north end of the paved entrance. Public Works will allow the use of recycled
asphalt (RAP) behind the property line. (Department of Public Works)
14. Delineate the erosion control measures (silt fence, straw bales, et cetera) on the
grading plan. (Department of Public Works)
G. The following notes shall be placed on the plat:
All proposed or existing structures will or do meet the minimum setback and
offset requirements for the zone district in which the property is located.
Pursuant to the definition of setback in the Weld County Code, the required
setback is measured from the future rights -of -way line.
2. In the event that a portion of the building is proposed to be leased or sold to
another party in the future, the applicant shall submit a copy of the lease of sales
agreement and information regarding the proposed use of the leased portion to
the Weld County Building Inspection Department, Mountain View Fire Protection
District and the Department of Planning Services for review. Based upon the
proposed use and/or impacts of the leased portion, the Department of Planning
Services may require a new Site Plan Review application. (Department of

3. In accordance with the Weld County Code, no land, building or structure shall be
changed in use or type of occupancy, developed, erected, constructed,
reconstructed, moved or structurally altered or operated in the Commercial and
Industrial Zone District until a Site Plan Review has been approved by the

4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for
final disposal in a manner that protects against surface and groundwater

5. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste

in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,C.R.S., as

6. Waste materials shall be handled, stored and disposed of in a manner that
controls fugitive dust, blowing debris and other potential nuisance conditions.

7. The applicant shall operate in accordance with the approved "waste handling

8. The facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone District, as delineated in 25-12-103, Colorado Revised Statutes,

9. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times. (Department of Public Health and Environment)
10. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. (Department of Public Health

11. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. (Department of Public Health

12. The facility shall utilize the existing commercially permitted well. (Commercial

13. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health &Environment, Water Quality Control

14. The operation/property shall comply with all applicable rules and regulations of
the State and Federal agencies and the Weld County Code. (Department of

15. A building permit application must be completed, and two complete sets of
engineered plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report
preformed by a registered State of Colorado engineer shall be required.

16. A plan review must be approved and permit must be issued prior to the start of

17. New construction shall conform to the requirements of the various codes adopted
at the time of permit application. Currently the following has been adopted by
Weld County: 2006 International Building Code; 2006 International Mechanical
Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and
the 2008 National Electrical Code and Chapter 29 of the Weld County Code.

18. Setback and offset distances shall be determined by the 2006 International
Building Code and Chapter 23 of the Weld County Code. (Offset and setback
distances are measured from the farthest projection from the structure).

19. Prior to the release of building permit, the applicant shall submit evidence of
approval from the Greater Brighton Fire Protection District to the Weld County

20. Landscaping materials as indicated in the approved Landscape / Screening Plan
shall be maintained at all times. Dead or diseased plant materials shall be
replaced with materials of similar quantity and quality at the earliest possible

21. Lighting shall comply with the requirements and standards for off-street parking
spaces per Section 23-4-30.E, Section 23-2-250.D and Section 23-3-250.B.6 of

22. All structures, including signs, on site must obtain the appropriate building

23. Effective January 1, 2003, Building Permits issued on the proposed lots will be
required to adhere to the fee structure of the Weld County Road Impact Program.

24. Effective August 1, 2005, Building permits issued on the subject site will be
required to adhere to the fee structure of the Capital Expansion Impact Fee and

25. The property owner shall allow any mineral owner the right of ingress or egress
for the purposes of exploration development, completion, recompletion, re-entry,
production and maintenance operations associated with existing or future

26. This application is proposing a well as its source for water. The applicant should
be aware that groundwater may not meet all drinking water standards as defined
by the Colorado Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly encourages well users to
test their drinking water prior to consumption and periodically test it over time.

2. Prior to Operation:
A. A stormwater discharge permit may be required for a development/redevelopment/
construction site where a contiguous or non-contiguous land disturbance is greater than
or equal to one acre in area. The applicant shall inquire with the Water Quality Control
Division (WQCD) of the Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater
discharge permit. Alternately, the applicant can provide evidence from WQCD that they

3. Prior to the Issuance of the Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed office and shop
buildings and shall be installed according to the Weld County Individual Sewage Disposal

B. The septic system is required to be designed by a Colorado Registered Professional

The Department of Planning Services' has reviewed your application and related materials for compliancy
with the Weld County Code. We find that your proposed Site Plan Review meets the intent of the Code
and it has been conditionally approved by staff. We have enclosed our comments for your case.
If applicable, please address all issues identified in the staff comments. Prior to submitting the mylar,
please submit two (2) paper copies of your plat for review by the Department of Planning Services' staff.
Upon approval of the paper copies please submit a mylar plat along with all other documentation required
as conditions of approval. The mylar plat shall be recorded in the office of the Weld County Clerk and
Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the
requirements of Section 23-2-160.V of the Weld County Code. The mylar plat and additional
requirements shall be submitted within sixty (60) days after the date the Administrative Review was signed
by Planning staff. There is an eleven (11) dollar recording fee per mylar sheet that you will be responsible
for paying to record the plat.

Public Works has reviewed the 7 -Day Completeness Review. The Public Works Department
shall be looking for four critical items:
➢ Site Plan Review
➢ Traffic Study
➢ Preliminary Drainage Report
➢ Geotechnical Soils Report
Site Plan Review: Please show the three water quality ponds on the site layout. Please show
the existing rundowns which will be maintained by the Cottonwood Ski Lake. Please revise the
turning radius to show 55 feet on each side of the driveway. Please place the cattle guards
back to back with no space between them.
Traffic Study: Please provide estimated traffic counts to the facility for employees, customers,
and visitors.
Preliminary Drainage Report: A Preliminary Drainage was provided. Please provide cutoff
walls on all water quality ponds. The existing rundowns have not been engineered. The cutoff
walls must extend deep enough to prevent head cutting onto the applicant's property in the
event of a failure on the existing rundowns. Photos taken around the south end of the
Cottonwood Ski Lake on August 7, 2008 show head cutting can exceed 4 feet in a 10 -year
event.
Geotechnical Soils Report: Provide a copy of the Geotechnical Soils Report.
Flood Hazard Development Permit: A Flood Hazard Development Permit (FHDP) will not be
required for this site.

On May 30, 2008 a discussion took place, in the Greeley Administrative Offices Director's office
regarding the non -compliant Jessup Trucking Facility. The legal description is Subdivision
Exemption number 997; being part of the SE4 of Section 30, Township 1 North, Range 66 West of
the 6th P.M., Situs Address is 12679 County Road 4.
Background Information:
Jessup Trucking has been in operation at this location for several years and was recently cited
for non-compliance with the lack of a Site Plan Review when representatives for the applicant
attempted to apply for a new office trailer to be located on site.
Access is from CR 4 a two lane paved road having Collector status or 80 feet of right-of-way
The use of the property will remain. A single family residence, a barn and a loafing shed are
currently positioned on site. All improvements will be retained with the loafing shed to be utilized
for screening of personal vehicles parked on site.
Brighton Fire Protection District is the responding agency
Mountain View Water, ISDS/Sewer]
Site Plan required delineating circulation, parking for personal and commercial vehicles, lighting
Traffic Study not required, 40 foot radius required at all points of ingress and egress utilized for
the Jessup Trucking Facility.

This application regards the placing of an office trailer on the 2.51 acre site. The property is
zoned I-3 Industrial and will remain zoned I-3 for this project.
The property is presently and will continue to be used by Jessup Transportation, Inc. as a tractor
trailer staging yard with an existing caretaker house/office. Access will be from WCR 4 through
the existing driveways. The new office trailer will have a footprint of approximately 30 feet by
12 feet and be approximately 10 feet high. The office trailer will not have plumbing, but will
require electrical service.
Jessup Transportation, Inc. has six employees. There are six existing parking spaces located in a
three sided building on the north portion of the site. Two additional spaces are planned south of
the office trailer. The trucking business will use the bathroom facilities in the existing caretaker
house/office. The septic system for the existing caretaker house/office was installed in 1993
(Weld County Health Department permit No. G-930293). Our calculations indicate the current
use will not exceed the design capacity of the existing septic system. Water is provided by a site
well (permit No. 17900A issued in 1997). A state well permit application to change the existing
well from residential to commercial was submitted to the State of Colorado Division of Water
Resources in July. To date, we have not received anything back from the State.
Landscape improvements will consist of placing a 15 -foot wide strip of decorative rock on the
south side of the property, outside of the future Weld County Road 4 right-of-way.
Existing site runoff flows north and discharges into the existing Cottonwood Ski Lake on the
property north of the site. A water quality capture pond/structure will be constructed at each of
the existing 3 rundowns channels that convey stormwater from the site to the ski lake.

Dear Mr. Ogle:
Attached are the revised construction drawings for the planned development. The comments
dated November 26, 2008 have been addressed as follows:
Planning:
A. Attached are the Waste Management Plan and approval email from Lauren Light of the
Weld County Health Department.
B. Keith Laube of Laube Engineering called Kris Krengel of the Greater Brighton Fire
Protection District on December 12, 2008 to discuss the Fire Department's requirements.
Since the building is more than 150 feet from the road, a fire truck turn around is
necessary. We have shown a truck turn -around with a 50 foot outside radius on the Site
Layout, sheet C2. The access gate is at least 24 feet wide and the site surface consists of
gravel road base capable of supporting Fire District apparatus. The site conditions meet
the fire department requirements. Note 2 on the Cover sheet has been changed to
reference the Greater Brighton Fire Protection District.
C. Property's mineral owners/operators-Oil/gas wells and tank batteries must have at least a
150 foot setback from habitable houses. Since the new office trailer is located within 90
feet of the existing house, the office trailer will not adversely affect any oil/gas
development on this site.
D. An engineer's estimate is attached for the public and private improvements. Upon
acceptance of the construction drawings, an agreement between the owner and County
can be finalized.
E. Public Works comments:
1. A drainage easement has been provided for each of the water quality control features.
2. Truck turn -around radii have been added to the Site Layout, sheet C2.
3. Estimated traffic counts are included in Note 2, Site Layout, sheet C2.
4. The submitted sheets have been stamped by a professional Engineer licensed in
Colorado.

5. A wood rail fence has been added around the water quality control features to prevent
trucks from driving and parking in these areas. Therefore, truck parking signs are not
necessary for the Jessup Transportation truck drivers.
6. All redlined comments made on the construction plans have been addressed.
F. The individual residing in the house as a caretaker is a relative of the owner and is
compensated by the owner through a reduction in rent. A letter is attached signed by the
owner stating the caretaker situation.
G. Attached are the Dust Abatement Plan and approval email from Lauren Light of Weld
County Health Department.
H. Plat
1. "Site Plan Review SPR-425" has been added to the top of all plan sheets.
2. The Site Plan Review Map meets County Code.
3. The Vicinity Map meets County Code.
4. The sight distance triangles have been added to the Site Layout, sheet C2. There is no
existing or proposed landscaping in this sight viewing area that would create a visual
obstruction.
5. Eight parking spaces are provided that meet Weld County parking stall requirements.
6. Wheel stops have been added to the two parking spaces south of the office trailer.
7. The two existing yard lights on power poles have been called out on the Site Layout,
sheet C2.
8. A future 36" x 48" sign is shown near the site entrance on sheet C2.
9. County Road 4 right-of-way dedication with applicable recorded reception numbers
are shown on sheet C2.
10. The existing east site access drive will be abandoned as shown on sheet C2. A wood
rail fence will prevent future use of the east access.
11. A wood rail fence has been added around the water quality control features to prevent
trucks from parking in these areas. Therefore truck parking signs are not necessary for
the Jessup Transportation truck drivers.
12. Note #27 has been added to the Cover Sheet (Cl) stating that Weld County will not
be responsible for the maintenance of the water quality control features.
13. The site entrance has been changed to include recycled asphalt extending from the
edge of the right-of-way to 60 feet into the site. The cattle guards have been relocated
to the north side of the recycled asphalt.
14. Silt fence has been added along the north side of the water quality capture ponds.
Notes #1 through #26 are included on the Cover Sheet, Cl. In addition, notes #27 and #28 have
been added to address other comments.
Prior to Operation:
Since site disturbance for the proposed construction will be less than 1 acre. Therefore a
construction stormwater discharge permit is not required.

The existing office/caretaker house has an existing permitted septic system that is suitable
for intended site use.
Environmental Health Services:
• A dust Abatement Plan has been approved by Weld County Environmental Health
Department.
• A Waste Handling Plan has been approved by Weld County Environmental
Health Department. The recommended 11 development standards are included in
notes #4 through #14 on the Cover Sheet, sheet Cl.
Public Works:
Final Plat
I. Sheets Cl and C2 serve as the plat map. The legal description is provided and property
boundaries are shown with distances and bearings.
2. The resubmitted drawings have been stamped by a professional engineer licensed to
practice in the State of Colorado.
3. The water quality features are now shown inside drainage easement boundaries.
Offsite:
1. An engineer's estimate is attached for the private improvements. Upon acceptance of the
construction drawings, an agreement between the owner and County can be finalized.

3. Traffic movement and turning radii for the trucks have been added to the drawings, refer

practice in the State of Colorado.

Upon review of my case files and computer, an active Zoning Violation (ZCV08-00212) was noted. This
violation was initiated due to the operation of "Jessup Trucking" without first going through the Site Plan
Review (SPR) permitting process. This case has not been presented to the Board of County

The following comments are made in response to the above noted site plan review. The 2006 Edition of
the International Fire Code, and other codes or standards referenced within the Fire Code, governs these
comments and resulting requirements.
RE: Site Layout, Utility and Landscape Plan (Drawing C2)
1. Emergency vehicle access shall be provided to within 150 feet of any point on the exterior wall of
any building or structure constructed or moved onto the subject property. Access routs shall have
an unobstructed minimum width of 24 feet; be constructed of an all-weather surface capable of
supporting Fire District apparatus; have a minimum unobstructed vertical clearance of 13 feet 6
inches; and have a maximum inside turning radius of 30 feet and a minimum outside radius of 50
feet. Dead-end access roads in excess of 150 feet in length shall be provided with an approved
turn -around.
2. Any new residential structures (home) constructed or moved onto this property shall be provided
with an approved NFPA 13D Residential Sprinkler system. Plans for the system shall be
submitted to the Fire District for review and approval prior to commencing installation of the
system.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information, water to the site will be provided by an existing
commercial well. The applicant has re -permitted the existing well under permit no. 278173. The uses
allowed by the permit are drinking and sanitary purposes for a commercial business. Water from the
well cannot be used for lawn or landscape irrigation or for any other purpose outside the business
building structure. The well can be used for drinking and sanitary purposes for the commercial
operation as long as the well is operated in accordance with the terms and conditions of the well
permit.

Weld County Public Works Department has reviewed this Site Plan Review (SPR) request.
The SPR application was received by Public Works on October 23, 2008. Comments and
concerns identified during this phase of the process may not be all-inclusive, as other concerns
or issues may arise during the remaining application process.
Requirements
The following concerns identified by Weld County Public Works shall be resolved prior to
recording the final plat for this Site Plan Review:
Final Plat:
1. A plat map does not appear to have been submitted to the Public Works Department.
2. All drawings shall be stamped by a registered professional engineer, licensed to practice
in the State of Colorado.
3. Please show the water quality control features in a drainage easement.
Offsite:
1. A private maintenance agreement for items such as the driveway paving, cattle guards,
signs, water quality features, etc. with both Exhibits A & B filled out shall be required.
Collateral will be required for 100% of the estimated costs on schedule A. (Blank
Agreement is attached)
2. A public road maintenance agreement for such items as the driveway paving in the right
of way with both Exhibits A & B filled out shall be required. Collateral will be required for

Access:
1. This site is limited to one access point off of WCR 4. Please provide information
regarding which access will be closed and how it will be closed.
2. Intersection sight distance triangles at the site entrance will be required. All landscaping
within the triangles must be less than 31/2 feet in height at maturity, and noted on the
Final Plat.
3. Please include a traffic circulation plan.
4. Please provide estimated traffic counts to the facility for employees, customers, and
visitors.
Construction Drawings:
1. Please ensure that the Construction Drawings are signed, stamped, and dated by a
registered professional engineer, licensed to practice in the State of Colorado.

2. Signs designating truck parking shall be shown on the construction drawings. A detail
showing the design of the sign shall be shown on the construction drawings.
3. Please add a note to the cover sheet stating that Weld County will not be responsible
for the maintenance of the water quality control features.
4. The entrance to the site shall be paved a minimum of 60 feet from the edge of the right
of way. The cattle guards shall be installed at end of the north end of the paved
entrance. Public Works will allow the use of recycled asphalt (RAP) behind the property
line.
5. Please show the erosion control measures (silt fence, straw bales, etc) on the grading
plan.
6. Please address all redlines on the construction drawings. Please return the redlined
plans with the next submittal.
Drainage:
1. The Drainage Report appears to be acceptable to Public Works.
The applicant shall address the comments listed above for this Site Plan Review (SPR)
process. The review process will continue only when all appropriate elements have been
submitted. Issues of concern must be resolved with the Public Works Department prior

Environmental Health Services has reviewed this proposal for a staging yard for tractor
trailers which includes an existing caretaker house/office and the placement of an
additional office trailer. There are six employees that utilize the site. Water is provided
by a commercial well permit (278173) and an individual sewage disposal system (G-
19930293 and G19860044).
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan (on site dust) for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing well water. (permit #278173)
10. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
be made aware that groundwater may not meet all drinking water standards as
defined by the Colorado Department of Public Health and Environment. We
strongly encourage the applicant to test their drinking water prior to consumption
and periodically test it over time.

CHANGEIEXPANSION OF USE OF AN EXISTING WELL
ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS Of APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2. unless approval
of a variance has been granted by the State Sutra of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 1B
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the policy of the Slate Engineer dated 4/9/85 for appropriation of ground
water tributary to the South Platte River system.
4) Approved for the use of an existing well constructed under verbal emergency 97VE444 and permitted under 17900-A.
Issuance of this permit hereby cancels permit no. 17900-A.
5) Tne use of ground water from this well Is limited to drinking and sanitary facilities as described in CRS 37-92-802(1)(c),
for a commercial business. Water from this well shall not be used for lawn or landscape irrigation or for any other purpose
outside the business building structure.
6) Production from this well is restricted to the alluvium.
7) The pumping rate of this well shall not exceed 15 GPM.
8) The annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot (108,600 gallons).
9) Approved as the only well on a tract of land of 2.51 acres described as That portion of the SW 1/4 of the SE 1r4. Sec. 30,
Twp. 1 North. Rng. 66 West, 8th P.M . Weld County, reference attached exhibit A.
10) The return flow from the use of this well must be'through an individual waste water disposal system of the
non -evaporative type where the water is returned p the same stream system in which the well is located. The maximum
consumptive use of ground water shall not exceed'1g percent.
11) A totalizing flow meter must be installed on this welt and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (record'ed at least annually) and submitted to the Division Engineer upon
request.
12) This well shall not be more man 200 feet from the location specified on this permit.
