HOLDINGS, LLC
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including
the codification of all previously adopted ordinances of a general and permanent nature enacted
on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and
hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to
read as follows.
CHAPTER 26
MIXED USE DEVELOPMENT
Amend Sec. 26-1-20. Planning area boundaries.
C. The Southeast Weld MUD area is approximately five thousand nine hundred
seventeen (5,917) acres in size. It is located in southern Weld County along the
transportation corridors of Weld County Roads 49 and 22, and is situated to
participate in the County's future share of commercial, industrial, and residential
growth. The area is in close proximity to major regional economic generators such
as Denver International Airport and the metropolitan areas of Denver and Greeley.
The existing transportation links of 1-76 and its existing interchanges, and the
County's commitment to Weld County Road 49 to serve as the County's only
continuous north -south highway from Greeley to the south, east of Interstate 25,
support the need to identify this area as an urban corridor. The planning area
boundaries are shown on the Southeast Weld Mixed Use Development Area
Structural Land Use Map, reflected in Appendix 26-R.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and
sub -sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.

The Weld County Planning Commission will hear a request on Tuesday, December 16, 2008, for the
purpose of considering two Weld County Comprehensive Plan Amendments. The first Amendment is to
modify the Southeast Weld Mixed Use Development Area Structural Plan, Map 2.1 Structural Land Use
Map. The second amendment is for inclusion of additional acres into the Southeast Weld Mixed Use
Development Area Structural Plan, Map 2.1 Structural Land Use Map.
The first Amendment is located in Part of Sections 17 and 18, Township 2 North, Range 64 West of the
6th P.M. and Sections 2, Township 2 North, Range 65 West of the 6th P.M. The second Amendment is
located in Part of W2 of Section 5 Township 2 North, Range 64 West of the 6th P.M. Both Amendments
are located in the vicinity of County Road 22 and County Road 49.
Prospect Farms II Holdings LLC, Pioneer Communities Inc. & HP Farms LLC are proposing that the
Weld County Comprehensive Plan be changed (first Amendment) to modify 294 acres to residential uses
and 613 acres to agricultural uses and (second Amendment) to include 317 acres for residential uses.
The Comprehensive Plan serves as the County's foundation for all land use and development regulations
in the County.
The public hearing will take place on Tuesday, December 16 at 1:30 p.m. at the Southwest Weld County
Office located east of Interstate -25 off Exit 240 (Firestone) at 4209 County Road 24.5. Additional
