HomeMy WebLinkAbout20091051.tiff014 RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZONING PERMIT FOR A COMMERCIAL VEHICLE, ZPCV #0046 - ARTURO CHAVEZ AND FLORENCIA CHAVEZ-VILLALOBOS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 4th day of May, 2009, considered the request of Arturo Chavez and Florencia Chavez-Villalobos, 1935 Mary Avenue, Fort Lupton, Colorado 80621, for a Zoning Permit for a Commercial Vehicle, and WHEREAS, said commercial vehicle is requested to be located in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lots 1 and 2, Block 13, in the Town of Wattenburg, Colorado; being located in Section 25, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing Florencia Chavez-Villalobos was present, and WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be denied for the following reasons: 1. The Department of Planning Services' staff has reviewed this request and recommends this case be denied for the following reasons: Sec. 23-3-10. Intent. Agriculture in the COUNTY is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential land USES. The A (Agricultural) Zone District is established to maintain and promote agriculture as an essential feature of the COUNTY. The A (Agricultural) Zone District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land USES. The A (Agricultural) Zone District is also intended to provide areas for the conduct of USES by Special Review which have been determined to be more intense or to have a potentially greater impact than USES Allowed by Right. The A (Agricultural) Zone District regulations are established to promote the health, safety and general welfare of the present and future residents of the COUNTY. (Weld County Codification Ordinance 2000-1) The Department of Planning Staff has determined that the parking of any commercial vehicle located within a subdivision with small parcels and narrow streets does not meet the intent of the Agricultural Zone District and compromises the safety and welfare of surrounding property owners. 2009-1051 Pu 3 21 Should the Board approve this request, the following conditions shall apply: 1. The zoning permit shall not be transferable by the applicant and/or owner to any successor. The zoning permit shall terminate automatically upon conveyance or lease of the property. 2. The property is in violation of Chapter 23 of the Weld County Code (Violation #ZCV08- 00198). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance of the property. 3. Approval of this application for a zoning permit application shall not be considered to release the applicant from complying with any private covenants in place. 4. The commercial vehicle permitted must be operational with current license plates at all times. 5. There shall be no parking or staging of commercial vehicles on the County roads or rights -of -way. The applicant shall utilize on -site parking only.. 6. The applicant shall maintain compliance with Section 23-4-950 of the Weld County Code at all times. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) Mary Avenue and Edward Street are both local paved roads which require a 60 -foot right of way at full build out. There is presently a 60 -foot right-of-way for each road. These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: No parking or staging of commercial vehicles is allowed within the County right-of-way. Please use an on -site parking area only. The applicant shall utilize the existing residential access to this parcel. Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be less than 3 '/z feet in height at maturity, and noted on the final plat. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Our elderly citizens and young children are in danger every time they step onto the streets. Our community does not have proper sidewalks, so we are forced to use the sides of the streets. Our children are not able to play on the streets without being in danger and our elderly are not able to take daily walks. Another major concern is that of the traffic of the semi trucks coming through. This is a residential area and we feel that these semi trucks should be restricted from using our streets. Our roads have been damaged by these trucks coming through our neighborhoods. Residents have also been exposed to breathing in the exhaust fumes and there are concerns of the possibility of a chemical or hazardous material spill. We feel that these issues create major safety and health concerns for the residents of our community. We ask that these concerns be taken into consideration and that actions be taken to address them. My reasons are as follows: 1. The community was not designed to accommodate the travel or the parking of commercial vehicles: 2. The community water system was not laid in place to take the weight and vibrations of commercial vehicles: 3. It is not unusual for residents to walk to their destination within the community, without benefit of sidewalks, walking from one location to another takes places on the existing roads. 4. Children, senior citizens and other residents are in danger of personal injury due to the growing traffic of large commercial vehicles. 5. The wear and tear on our streets is not an expense the community is financially able to handle. Please be advised that not all the residents of Wattenberg Community received notification of the subject application and as such are not able to voice their vote. I am concerned about the increase of commercial vehicle traffic and of the number of commercial vehicles which park within in the town limits without benefit of County and/or the Community permission. I appreciate the effort on your part to inform the community of this request and request that action be taken on your to eliminate the violators who have taken it onto themselves to park commercial vehicles where the chose. These same individuals and other individuals drive through the community not adhering to speed limits or common driving courtesies. We are very concerned citizens. Concerns have been voiced to the County Commissioner. There is enough commercial traffic on WCR 6 that we do not need that traffic to be going through our community. We are a community where there are many residents. We live on the corner house and when commercial vehicles turn on to Mary Avenue off of WCR 6 there have been many times that they have had to back out on to WCR 6 in order to turn on to Mary Avenue where my vehicle is parked. There is a school bus drop off right on the corner of Mary Avenue and Edward Street — there are elementary students that would not easily be seen by a commercial vehicle. Another problem is the streets — if we lived in the city (where commercial vehicles do not drive down streets) there are at least sidewalks. Wattenberg has no sidewalks. Our biggest concern is that should this request be granted will will suffer the consequences for many years to come.
