Box 758 Greeley, Colorado 80631 Gentlemen: Mr. Oscar Barnes and some other neighbors of his from around Nunn, Colo- rado recently called me and are "up-in-arms" about people dumping trash in a County gravel pit. This ex-County gravel pit is located six miles west of Nunn, Colorado. You will recall that in February, Mr. Barnes and I both contacted the Commissioners with regard to the County closing up the gravel pit and surrender- ing it. The pit had not been surrendered to Mr. Barnes. As a consequence, people have commenced dumping their trash in that pit. As matters now stand, it is in need of being cleaned up and of erecting some signs on the premises warning people not to dump there. We have previously requested that the Commissioners take whatever steps were necessary to fill in the hole where the gravel had been excavated and close up the gravel pit and cover up the trash that was there. Mr. Barnes advises me that no one has contacted him and no steps have been taken to do anything with the pit. On March 16, 1979, Mr. Barnes received a notice from the Weld County Health Department that this site did not conform to the minimum standards and he is well aware of this. He strongly feels that this problem should be taken care of immediately and that some signs should be put up to keep people out and endeavor then to enforce the signs until such time as people gave up the habit of dumping in that area. I believe if we could get a bulldozer up there for an hour and a half, and then get about three signs of the County warning people that no dumping was permitted, the problem would soon be taken care of. Mr. Barnes advises me that he would put up the signs if the County will furnish them and push in the gravel and cover up the debris and trash that has been left there by various and sundry people. 7406111 WELD COUNTY BOARD OF COUNTY COMMISSIONERS Page 2 June 7, 1979 I would appreciate it very much if you would take immediate steps to see that this condition is rectified. Box Nunn, Colorado 80648 Dear Mr. Barnes: Reference is made to your letter to the County dated February 9, 1979. Your easement granted to Weld County to remove gravel , sand, and road building material from a plot of land located in the SW Corner of the SWa of Section 29, Township 9 North, Range 67 West, was released June 5, 1968 as evidenced by attached copies of a resolution and Quit Claim Deed. This property is private property now, and as such is the owner's responsibility to maintain. I hope this clears up the questions you have and clarifies the ownership of the land in question. Sincerely, Norman Carlson Chairman of the Board of Weld County Commissioners NC:sar Enclosures February 9, 1979 Board of County Commissioners Weld County, Colorado Centennial Building Greeley, Colorado 80631 Gentlemen: On June 4, 1959, I granted an easement to Weld County cover- ing an acre of property which I owned in the Southwest Quarter (SW1/4) of the Southwest Quarter (SWW4) of Section Twenty-nine (29) , Township Nine (9) North, Range Sixty-seven (67) West of the 6th P.M. The property is 400 feet in length by 150 feet in width. The easement granted the County the privilege of removing all gravel, sand and road-making and building material it could remove from this parcel of land. The last few years, the County has apparently done very little with this property and has re- moved very little gravel from it. As a consequence, the neighbors and people who are not neighbors have commenced using this acre of ground as a dump for their trash and paper and what not. The present situation is undesirable as far as I am con- cerned as the owner of the adjacent land, and it is undesirable, I believe, as far as the County is concerned and something should be done to correct the situation. This easement was recorded in Book 1533, page 386 of the Weld County Records on June 9, 1959. I would request the County to take a more active part in the supervision of this acre of ground to see that it is not used as a dump for neighbors or people who are not neighbors in the future. An inspection of the property will disclose to you that it is an unsatisfactory situation and the County should take steps to clean it up and stop the use of this property as a dump in the future. I live in Nunn, Colorado, and I would be very happy to go up to the site of this acre of land and discuss the matter with your representative at any reasonable time.
