This contract was signed in July of 2008 when former Commissioner Jerke was Chair. They have indicated that the current Chair may sign a designee letter. I am requesting that Commissioner Garcia sign the enclosed letter authorizing Tom Teixeira to sign these documents. I have spoken to Bruce Barker and he stated the board does not have to take formal action and Commissioner Garcia may just sign the enclosed letter. Note: for more than ten years and most likely 20 years that the "Responsible Administrator" name in the contract has had the authority to sign these request and reports. Good afternoon, We have recently received a mandate from accounting regarding who can sign payment request and financial status reports. commencing 2/1/09, all payment requests (PRs) and financial status reports (FSRs) must be signed by the authorized signator of your contract or their designee. The contract administrator can no longer sign these documents without a formal designation. If you have submitted these documents after the above date, they will be held until this is satisfied. If the person signing your PRs and FSRs is not he same person who signed your original contract, here is how to satisfy the requirement: On the signator's letterhead, have the contract signator designate the authorized signator for these documents, list the documents and the full contract encumbrance number. Please see attached example. You may fax letters in, scan and e-mail or send by US Postal Service. Please have these in ASAP so we can process your requests and reports. Gov 1 CDBG Rev. 6/28/02 Contract Routing # O6O.S CFDA # 14.228 CONTRACT THIS CONTRACT, made by and between the State of Colorado for the use and benefit of the Department of Local Affairs, Division of Housing, 1313 Sherman Street, Denver, CO 80203 hereinafter referred to as the State, and The Weld County Housing Authority PO BOX 130, Greeley, Colorado 80632, hereinafter referred to as the Contractor, WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for a m nt in Fund Number /per Appropriation Code Number I f & Org. Unit I GBL 6P5-3 Contract Encumbrance Number H9CDB08045G; and WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, the United States Government, through the Housing and Community Development Act of 1974 ("the Act"), Pub. L. No. 93-383, as amended, has established a Community Development Block Grant ("CDBG") program and has allowed each state to elect to administer such federal funds for its nonentitlement areas, subject to certain conditions, including a requirement that the state's program give maximum feasible priority to activities which will benefit very low-, low-, and moderate -income families or aid in the prevention or elimination of slums or blight; the state's program may also include activities designed to meet other community development needs having a particular urgency because existing conditions pose a serious and immediate threat to the health or welfare of the community where other financial resources are not available to meet such needs. Additionally, the state's program is subject to a federal requirement that not less than seventy percent (70%) of the aggregate amount of CDBG funds received by the state shall be used for the support of activities that benefit persons of very low-, low-, and moderate -income; and WHEREAS, the State of Colorado has elected to administer such federal funds for its nonentitlement areas through the Colorado Department of Local Affairs ("Department"), pursuant to C.R.S. 1973, 24-32-106(1) (d), 24-32- 304(2) co and 24-32-705(1) (i); and WHEREAS, the Department has received applications from political subdivisions in Colorado for allocations from the federal CDBG funds available to Colorado; and WHEREAS, the Contractor is one of the eligible political subdivisions to receive CDBG funds; and WHEREAS, the Department has approved the proposed Project of the Contractor; NOW, THEREFORE, it is hereby agreed that: 1. Scope of Services. In consideration for the monies to be received from the State, the Contractor shall do, perform, and carry out, in a satisfactory and proper manner, as determined by the State, all work elements as indicated in the "Scope of Service", set forth in Exhibit A, which is attached hereto and is incorporated herein by reference, and is hereinafter referred to as the "Project". Work performed prior to the execution of this Contract shall not be considered part of this Project. 2. Responsible Administrator. The performance of the services required hereunder shall be under the direct supervision of Tom Teixeira, an employee or agent of Contractor, who is hereby designated as the responsible administrator of this Project. At any time the Contractor wishes to change the responsible administrator, the Contractor shall propose and seek the State's approval of such replacement responsible administrator. The State's approval shall be evidenced through a Contract Amendment to this contract initiated by the State as set forth in paragraph 16.b) of this Contract. Until such time as the State concurs in the replacement responsible administrator, the State may direct that Project work be suspended. 3. Time of Performance. This Contract shall become effective upon proper execution of this Contract by the State Controller or designee. The Project contemplated herein shall commence as soon as practicable after the execution of this Contract and shall be undertaken and performed in the sequence set forth in the attached Exhibit A, Scope of Services. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract, and that completion of the Project shall occur not later than the termination date set forth in the Scope of Services. 1 Hello
