Billings, Chairman Board of County Commissioners Weld County Centennial Center Greeley, Colorado 80631 Dear Mr. Billings: I have your inquiry asking my opinion on the following question: "Must Weld County adopt the procedures called for in Section 3-8 (4) (n) of the Weld County Home Rule Charter in order to sit and hear cases as the Board of Equalization for Weld County?" The answer is "NO". 1973 Colorado Revised Statutes, as amended, 39-8-101 et seq specifically designates the Board of County Commissioners to sit as the Board of Equalization and further, designates all procedures that appelants must follow in order to be heard by the Board of Equalization. Accordingly, it is the opinion of this office that the statutory provisions of the State of Colorado prevail and provide for all procedures for the Board of Equalization. The Weld County Home Rule Charter Section 3-8 (4) (n) et seq deals specifically with the Board of County Commissioners sitting as a Board of Appeals to hear complaints on actions taken by County Boards, Commissions and Departments; and therefore, does not apply to the Board of Equalization.
