HomeMy WebLinkAbout20090700.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 25, 2009 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, March 25, 2009, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William H. Garcia, Chair Commissioner Douglas Rademacher, Pro -Tern Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Administrative Services, Monica Mika MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of March 23, 2009, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: Commissioner Kirkmeyer moved to add the following under New Business: 2) Consider Intergovernmental Agreement Concerning Administration of the State of Colorado Neighborhood Stabilization Program and authorize Chair to sign - City of Greeley. The motion was seconded by Commissioner Long, and it carried unanimously. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated the House of Representatives is expected to vote in favor of the Rocky Mountain National Park Wilderness Bill today. He stated the good news is that Rocky Mountain National Park will become a wilderness area; however, the bad news is the Bill will not contain the language regarding water the Board hoped it would. He further stated he hopes the approved language will not put the Colorado -Big Thompson Water Project at risk. Commissioner Conway commended the Board for its leadership and bringing attention to the issue. He stated it is unfortunate Congress did not oppose the water language, particularly Congresswoman Markey, who chose not to engage herself with the issue. 2009-0700 BC0016 Commissioner Kirkmeyer stated she would like to comment on the oil and gas situation occurring in southern Weld County. She stated conversations have been taking place with one of the oil and gas operators in the area and although they are not assuming blame for the situation, they are working with the residents in the affected area to mitigate the effects of the natural gas in the well water. She stated she wonders why the Oil and Gas Conservation Commission is not using its environmental funds to investigate the locations of abandoned wells. Commissioner Kirkmeyer stated one of the wells in question is from 1950 and the oil and gas operator cannot locate it, perhaps due to incorrect coordinates. Commissioner Conway stated Ms. Kirkmeyer's question is a valid question for the public meeting to occur in the Town of Hudson on Friday evening. He stated Channel 4 reported problems with additional residences; however, the problems may be related to naturally occurring coal and methane. Commissioner Kirkmeyer stated all of the incidences may be related because there is coal in the area and the drilling may have occurred through a coal bed. She stated she believes the Oil and Gas Conservation Commission needs to be determining where the source of the problem is. In response to Commissioner Conway, Commissioner Kirkmeyer stated she feels the Board should consider drafting a letter prior to the meeting on Friday evening; however, she wants to first confirm with the Department of Environmental Health the uses she has in mind are the proper uses for the fund. Commissioner Rademacher stated there are now eight homes affected by the contaminated well water, according to a report this morning. BIDS: APPROVE BID #0900071, 2009 BRIDGE REHABILITATION - DEPARTMENT OF PUBLIC WORKS: Monica Mika, Director of Administrative Services, stated this bid is for the replacement of eight bridges. Ms. Mika stated the County is able to replace an additional bridge, and originally staff believed the County could afford to replace only seven bridges. Commissioner Rademacher inquired about the discrepancy in prices from the different vendors. Ms. Mika stated the large difference in bid amounts may be a reflection on the economic market. In response to Commissioner Rademacher, Mike Bedell, Department of Public Works, stated he is unsure if Weld County has ever conducted business with the contractor; however, the contractor has completed work for the Cities of Longmont and Greeley, and everyone he has spoken to has been happy with the work the contractor completed. He stated the cost is quite a bit lower than staff anticipated; however, he believes many contractors are submitting lower bids to keep their employees working. Commissioner Rademacher stated he simply wants to be sure the contractor is able to perform the necessary work for the amount quoted. Mr. Bedell stated he could not identify a reason not to award the contract to the low bidder. In response to Commissioner Conway, Mr. Bedell stated all of the reports regarding the contractor's work have been satisfactory and no concerns, or complaints, were shared. In response to Chair Garcia, Marcia Walters, Purchasing, stated the County has utilized the contractor in the past; however, she is unsure of how long ago it was. Commissioner Rademacher moved to approve said low bid from Jags Enterprises, in the amount of $150,498.00, based on staff's recommendation. Bob Beets, Jags Enterprises, stated there is a large disparity in bids occurring presently, and although the job was bid as low as could be managed, his company owns specialized equipment which will make the job go quickly. Mr. Beets stated his company chooses to bid on the jobs it owns the specialized equipment for. Seconded by Commissioner Conway, the motion carried unanimously. OLD BUSINESS: CONSIDER MEMORANDUM OF UNDERSTANDING FOR JOINT FUNDING FROM BUREAU OF JUSTICE ASSISTANCE AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY (CON'T FROM 3/23/09): Bruce Barker, County Attorney, stated the Board met with Sheriff John Cooke and Kim Fliethman, Sheriff's Office, regarding the memorandum yesterday. Commissioner Conway moved to approve said Memorandum of Understanding and authorize the Chair to sign. Commissioner Long seconded the motion. Commissioner Kirkmeyer expressed she appreciates Mr. Cooke and Mr. Fliethman attending the work session yesterday, and she explained work sessions are important to the Board so it may understand if there are recurring costs to the County or any negative consequences to the budget. There being no further discussion, the motion carried unanimously. Minutes, March 25, 2009 2009-0700 Page 2 BC0016 NEW BUSINESS: CONSIDER AMENDMENT#1 TO CONTRACT FOR REPLACEMENT OF BRIDGE 87/42.5 OVER SOUTH PLATTE RIVER AND AUTHORIZE CHAIR TO SIGN: Wayne Howard, Department of Public Works, stated the amendment to contract is to accept an additional $800,000.00, to fund the increased costs of constructing the bridge over the South Platte River. He stated Weld County applied for this grant in 2005 and staff never anticipated how high the 2008 costs would be in the construction industry; therefore, additional funds are necessary to complete the project. He stated the bridge is scheduled to be complete late this summer. In response to Commissioner Rademacher, Mr. Howard stated the County will provide a twenty percent match, in the amount of $160,000.00, and the amount was included in the budget. Commissioner Conway moved to approve said amendment and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried unanimously. CONSIDER INTERGOVERNMENTAL AGREEMENT CONCERNING ADMINISTRATION OF THE STATE OF COLORADO NEIGHBORHOOD STABILIZATION PROGRAM AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY: Tom Teixeira, Greeley -Weld County Housing Authority, stated the agreement will allow the City of Greeley to act as the lead agency for a 5.6 million dollar grant to allow Weld County to purchase distressed or foreclosed properties, some of which may be rehabilitated and sold to qualifying families. Mr. Teixeira stated the City of Greeley Urban Renewal Department has experience with this type of program and funding. Chair Garcia stated the Board attended a work session on Monday afternoon, which answered many of the questions the Board had regarding the Program. Commissioner Long moved to approve said agreement and authorize the Chair to sign. Commissioner Rademacher seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
