ORDINANCE NO. 9
AN ORDINANCE CONTAINING CHANGES AND AMENDMENTS TO THE WELD COUNTY INDIVIDUAL
SEWAGE DISPOSAL SYSTEM REGULATIONS.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:

The following changes and amendments to the Weld County individual
sewage disposal system regulations are made by the Board of County Commis-
sioners, Weld County, Colorado. Changes and amendments will be underlined.
Reference to page numbers are from the Weld County Individual Sewage Disposal
System Regulations booklet in effect prior to the passage of these amendments.
PAGE 1 , Section I. , Paragraph 1 .2 (Addition - Amendment)
Policy: The Weld County Board of County Commissioners declares the
purpose of the regulations is to protect the physical and mental health of
the people, to control communicable diseases, to regulate waste from dwellings,
business, industrial and public buildings. These regulations shall be
applicable throughout Weld County, and shall be enforced by the Board of
County Commissioners. These regulations are designed to control the con-
struction, location, and operation of sewage disposal systems, transportation
and final disposal of sewage materials and control of Systems Contractors
and Systems Cleaners of such systems. The Weld County Board of County Commis-
sioners declares that its general policy is to require the use of public sewer
systems where and whenever feasible, and to limit the installation of
individual sewage disposal systems only to areas that are not feasible for
public sewers. These regulations shall apply, including, but not by way of
limitation, to all individual sewage disposal systems and to sewage treat-
ment works which are not required to comply with provisions of the Water
Quality Control Act, Article 8 of Title 25, CRS 1973. These regulations
shall meet or exceed the requirements of the guidelines as adopted by the
Colorado Board of Health pursuant to 25-10-104, CRS 1973.

ment of these regulations.

2.53: "Water Quality Control Commission" means the commission created
by 25-8-201 , CRS 1973.

b. A permit fee of Fifty Dollars ($50.00) shall be required of applicants
for new individual sewage disposal systems, payable to the Weld County Health
Department when the permit is issued.
c. No permit fee shall be charged for alteration or repair of an existing
sewage disposal system, except where an entire new absorption field is to be
installed, a fee of Fifty Dollars ($50.00) will be assessed for the permit.
d. Owners of sewage disposal systems, which are required by the con-
ditions of their permit to submit effluent samples to the Department, shall
pay a fee of Twenty-five Dollars ($25.00) per sample and 12¢ per mile traveled
from the principal office to the site and return for each sample taken by an
employee of the Department. Any owner or occupant may request the collection
and testing of a effluent sample at the above fee which may be done at the
option of the Department.

3.4: PRELIMINARY INVESTIGATION: After a person has obtained an indi-
vidual sewage disposal permit, a Registered Professional Sanitarian or a
Registered Professional Engineer shall visit the applicant's property to make
a preliminary investigation on behalf of the Department, consisting of:

3.5: After reviewing all required information, a Registered Profes-
sional Engineer or Registered Professional Sanitarian acting on behalf of the
Department shall determine the type or types of sewage disposal systems
which are suitable for the property, and may give a conditional approval of the
plans and specifications; or may recommend that the permit be denied if the
proposed system cannot comply with these regulations. The conditional
approval shall set forth conditions to which the system must comply including
component minimum size, required engineer design, effluent testing,
cleaning or maintenance schedules, or other special conditions prior to
construction of the system. Final approval of the permit shall not be granted
to the applicant or to a subsequent owner until the conditions have been met
and the system inspected and found to comply with these regulations . Except
as provided in 25-10-107, CRS 1973, final approval of the permit shall not be
granted for the following systems unless they are designed by a Registered
Professional Engineer and after they have been approved by the Board of Health:

In the case of any system with a design capacity over 2,000 gallons of
sewage per day, or which discharges effluent into state waters, or are
designed to serve 20 or more persons per day, the Department may give its
conditional approval or may disapprove the application. Thereafter the
conditionally approved application, together with the Department's recom-
mendation shall be forwarded to the Water Quality Control Commission for its
review. If either the Department or the Water Quality Control Commission
disapproved the application, no final permit shall be issued. If the system
is approved, it shall be maintained and operated so as to meet the require-
ments of the permit and these regulations.

VARIANCE ON APPEAL: Upon finding that strict enforcement of these
regulations would cause undue hardship to the applicant and a further
finding that a variance would not be injurious to public health, the Board
of Health may authorize the issuance of a variance. The applicant may appeal
denial of a variance by the Board of Health to the Board of County Commis-
sioners. The burden of proof is upon the applicant to show that the variance
will not injure adjacent properties, will not conflict with the purposes of
these regulations, and will not adversely affect the health of any person.

a. Any person who commits any of the following acts or violates any
of the provisions of this article, commits a Class 1 petty offense, as
defined in Section 18-1-107, CRS 1973.
b. Constructs , alters , installs or permits the use of any individual
sewage disposal system without first having applied for and received a per-
mit as provided in Paragraph 3.3 or as provided for in 25-10-105(1 ) (g) or
25-10-106(k) , CRS 1973.
d. Violates the terms of a cease and desist order which has become
final under the terms of Paragraph 3.20, or the terms of 25-10-106(2)(1 ) ,
CRS 1973.
e. Conducts a business as a Systems Contractor without having ob-
tained the license provided for in Paragraph 3. 16, or provided for in
25-10-108 (2) , CRS 1973.
f. Conducts a business as a Systems Cleaner without having obtained
the license provided for in Paragraph 3. 17, or provided for in 25-10-108(2) ,
CRS 1973.
g. Wilfully fails to submit proof of proper maintenance and cleaning
of the system as required by rules and regulations adopted pursuant to Para-
graphs 3. 5, 3. 17 or 3.21 or provided for in 25-10-106, CRS 1973.

3.25: JURISDICTION: These rules and regulations are promulgated by
the Weld County Board of Health and the Weld County Board of County Commis-
sioners under the authority of 25-1-507(5) and 25-10-104(2) , CRS 1973, and
Section 3-8 of the Weld County Home Rule Charter.
3.28: EFFECTIVE DATE: These regulations became effective January 1 ,
1974. Amendments and revisions to these regulations were adopted by the
Weld County Board of Health on April 12, 1976, and the ordinance enacting
said amendments took effect on July 11 , 1977 asjirovided
by Section 3-14(2) of the Weld County Home Rule Charter.

C. Percolation tests shall be conducted by a Registered Professional
Engineer or a competent Technician of the Department, unless:
1 . The Department verifies previous tests.
2. Previous Percolation tests which were made by a Registered Profes-
sional Engineer for a subdivision which shows a sufficiently suitable consis-
tency that the tests may be waived by the Health Officer.

4. Two-compartment tanks or units in series shall be provided.
5. The first compartment of a two-compartment tank shall hold one-
half to two-thirds of the effective capacity of the tank.
6. Plans and specifications must be submitted and approved for all
tanks fabricated on the site.

A. Trenches shall be constructed with a width not exceeding three
feet and a depth not exceeding three feet (unless approved by the Health
Officer). A disposal line shall be provided for the entire length of each trench
and shall be surrounded by clean, graded gravel or rock, broken hard burned clay
brick, or similar aggregate. The material may range in size from ? inch to 22
inches. Cinders, broken shell , and similar material are not recommended.
The material shall extend from at least 2 inches above the top of the pipe to
at least 6 inches below the bottom of the pipe. The top of the gravel shall
be covered with untreated building paper, a layer of hay or straw, or similar
pervious material . An impervious covering shall not be used. A device
providing distribution of the effluent shall be included. The bottom of the
trench shall be level .

B. Disposal lines composed of 12-inch lengths of a 4-inch diameter
agricultural drain tile, concrete pipe or vitrified clay sewer pipe shall
provide joint openings between lengths of pipe of 1/8 to 1/4 inch in width.
Each open joint shall be covered over the upper half of the joint opening.
Perforated plastic lines of a minimum 3-inch diameter shall be fitted with
tight joints and the perforations shall be so laid that a relatively even
distribution of effluent over the system will occur. When, at the discretion
of the Health Officer, it is necessary to maintain grade or alignment of the
tile or pipe lengths , all tile or pipe lengths shall be placed on narrow grade
boards which are securely staked. The distribution lines shall be installed
level .

B. The outer-most disposal lines in the bed shall be placed no less
than eighteen (18) inches and no more than thirty-six (36) inches from the
outside bedwalls. For each six (6) feet, or part thereof, in bed width,

there shall be one disposal line extending the length of the bed. Such pipe
lines shall be so spaced as to distribute the effluent evenly over the entire
bed area, and shall meet the requirements of Paragraph 5.5(B. ) , except the
lines shall be level . A distribution box or other distribution device
providing uniform application of flow shall be included in the seepage bed
system.
PAGE 37, Section V, Paragraph 5.8 (Typing Error)
Sand Filter Trenches: The filtering material shall be clean, coarse
sand, all passing a screen having four meshes to the inch. The sand shall
have an effective size between 0.9 and 1.1 mm. The uniformity coefficient
shall be 2.5 or less or the sand shall have an effectie size of 0.25 and
0.6 mm and have a uniformity coefficient of 4.0 or less. The sand shall not
be less than two feet deep. The distributors and underdrain shall be sur-
rounded by coarse screened gravel or crushed stone. All of the gravel or
stone shall pass a 21/2 inch screen and shall be retained on a 3/4 inch screen.
Fine gravel , 4 inch size or less may be used above and around the coarse
material , both at the distributor and at the underdrains. The slope of the
distributors shall be 0.4 percent where dosing tanks are not used, and the
slope of the underdrains 0.5 to 1.0 percent. It is required that the sand
be thoroughly settled by flooding or other means before the distributors are
placed at the final grade. The distributor and underdrains may be of agricul-
tural tile or bell and spigot pipe or perforated pipe. When preceded by
aerobic sewage treatment or other systems designed by a Registered Profes-
sional Engineer, these criteria for sand filter trenches may be varied as
necessary to provide a balanced filter design. The minimum area for said
filter trenches shall be computed as a function of the maximum daily
sewage flow according to the following table:

Dosing Tanks shall be water tight. The size of the dose, or the net
capacity of the dosing tank, shall be 60 to 75% of the volume of the dis-
tributors dosed at one time.

EFFECTIVE DATE
This Ordinance shall take effect five (5) days after its final
publication, as provided by Section 3-14(2) of the Weld County Home Rule
Charter.
The above and foregoing Ordinance No. 9 was passed, approved and
