RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST STEVEN AND DONNA GREGORY FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Steven and Donna Gregory, ZCV #0900039, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 16th day of June, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Steven and Donna Gregory were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 16, 2009, to allow adequate time for the property owners to submit a Use
by Special Review Permit, or remove the commercial business to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900039 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Steven and Donna Gregory to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until July 16, 2009, to allow adequate time for the
property owners to submit a Use by Special Review Permit, or remove the commercial business
to bring the subject property into compliance.

be permitted to use the special review permit process to develop.
REMEDY
As we discussed during your Pre Application Meeting on March 6, 2009, a Use by Special Review
(USR) application shall be submitted for storage of commercial vehicles and operation of the
commercial trucking business.
To avoid the above referenced Violation Hearing a complete USR application shall be submitted before
June 15, 2009. In order to meet this deadline, the 4 packets for the 7 Day Completeness Review shall
be submitted before June 1, 2009. Any necessary corrections shall be completed and the remaining
paperwork shall be submitted prior to June 15, 2009. If this is completed, the above Violation Hearing
will be cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office for immediate legal action.

On Friday, March 6, 2009 an informal discussion took place at the Greeley Administrative Offices
Conference Room regarding a proposed USR for parking of trucks and trailers. (The legal description is
Lot B RE -1334 being part of SE4SE4 of Section 28, Township 3 North, Range 65 West of the 6th P.M.;
Situs Address is 20799 CR 28)
Background Information:
The applicants have a trucking business which is operated solely by immediate family members of Mr.
Gregory (6 family members).
The existing shop on site is used to store tools for the business as well as for small maintenance of the
trucks (oil changes, etc.). The applicant indicated that his neighbor or local company take the used oil.
The applicants expressed the possibility of having a second dwelling on site; however upon research they
have determined that at this time it is not feasible as they would need to drill the well deeper and they are
not allowed a water tap from the public water system.
Health Department
According to Septic Permit No. G19770123, the septic system is sized for 4 people which is what it is
currently used for. However it will need to be evaluated by a registered engineer for adequacy of
additional users.
Staff advised applicants to visit with the Division of Water Resources and explain the nature of their
business. The Division of Water Resources may allow some flexibility in not converting the well over to
commercial use.
Building Department
Upon preliminary research the department did not find any permit on the existing shop therefore it was
determined that it may have initially been an Ag Exempt building. Therefore the building would be
classified as a Storage Shop and the applicants will need to apply for a change of use. Staff indicated that
the applicants would need to submit ventilation and electrical plans and there also would be a structural
inspection by a Weld County Inspector. The applicants stated that the shop has a dirt floor. Staff
indicated that a concrete floor would be required.
In addition to the building permit, staff alerted the applicants of the additional fees that may be required:
Road Impact Fees, Capital Expansion fees and also Stormwater Drainage fees. The Building Department
will be able to provide an estimation of fees.
Public Works
County Roads 28 and 43 are both paved. The applicants indicated that they have 3 accesses from CR
28; two for the home and one for the trucking business. Staff stated that the applicants will need to close
one of the accesses for the home; however they will allow the access for the business. A stop sign will
need to be installed at the business access. In addition, staff will need to evaluate the access to
determine if site distance and radiuses are adequate for the trucks.
The applicants will need to submit a Site Plan identifying the two accesses, dimension of driveways,
parking area as well as delineating the parking area by stop blocks or signs whichever the applicant
prefers. The radiuses for the business entrance will need to be at 60 feet.
No Traffic Study will be required; however the applicant must submit an estimated number of trips per day.
No Drainage report is required; however a water quality feature will need to be installed.
No Geotechnical Report is required.
Planning Department
The property is currently in violation (ZCV09-00039). Staff indicated that they will try to delay the violation
hearing until June 16, 2009. If the applicants have submitted a completed USR application prior to June
16, 2009 the violation hearing will be canceled.
Staff expressed that they will look for some type of screening around the truck parking area.
The applicants indicated that they may own the mineral rights to their property. They will research for
further verification.
Staff urged the applicant to contact staff for any questions:
Planner On Call (Longmont office) Monday through Thursday 12:30 to 4:30 p.m.
Planner On Call (Greeley office) Monday through Thursday 7:30 to 11:30 a.m.
Staff explained the USR process - that the applicant shall submit 4 packets for a 7 day completeness
review. Once the 7 day completeness review is complete the applicant will be informed of what items are
still required to make the application complete. After the completed application is submitted it will be sent
out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and
address as many of the referrals as possible. At the meeting the Planning Commission hearing will be
scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks after the
Planning Commission hearing.

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.
