HomeMy WebLinkAbout20090357.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST SANDRA WOLLERT FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Sandra Wollert, VI #0400212, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of February, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Sandra Wollert, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 10, 2009, to allow adequate time for the property owner to submit a Medical Hardship Permit application for the mobile home, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Otherwise, if you would like staff to re -consider your Accessory to the Farm request, please re -submit a current Accessory to the Farm Certification form (which was previously sent) along with the required supporting documentation. I believe Wendi also mentioned that you may be eligible to apply for a Medical Hardship for the mobile home. She said that she was never told that she would need to renew this permit. In fact, this is the first that she has ever heard such a thing. I told her that all Accessory uses need to be re -justified every year. I told her that I would mail her an "Accessory to the Farm Certification". I then told her about the semi trailers. She said she uses them for storage. She said her mom (who is on her death bed) has furniture stored in them. She also uses them for feed and tack. I told her to utilize semi's as storage units requires a Use by Special Review. I told her that I would be happy to mail her that application as well. You stated that you called me on September 24, 2004 and left a message. If you did leave a message either my answering machine malfunctioned or you reached an incorrect number. I never heard anything after sending in my reapplication. I also do not understand why your phone call was not followed up with a letter, from my experience with government entities this is the normal procedure. The semi -trailers have been off of my property since shortly after I returned the letter to you in 2004. I do not understand why my permit wasn't approved. I was told when I got the original permit that as long as I had livestock the modular home was legal and 1 didn't have to do anything else. I was also told I could not rent the home and I have never received any money the home. The gentleman living there is actually my father-in-law and the original person that moved in. He helps feed and watch the place and takes care of some minor mainteance around the ranch. He is 83 years old now so the amount of things I have him do has decreased, but he does not pay any money for living there. There are 2 (two) aspects to the violation: 1.) The presence of a 2nd residence on the property. Specifically, a mobile/modular home that was initially permitted as an Accessory to the Farm (back in 1996). My records show that on September 24, 2004, I left a message stating that staff had determined that the information submitted did not meet the criteria for renewal of the Mobile Home, but instead recommended either a Recorded Exemption (RE) to create a separate lot or a Use by Special Review (USR) permit for a second home on a lot. However, upon researching this violation, I have not been able to locate evidence that you have submitted either of the above applications. If you would like staff to re -consider your Accessory to the Farm request, please re -submit a current Accessory to the Farm Certification form (please see inclosed form) along with any supporting documentation.
