All requirements outlined in the referral dated October 6, 2009 from the St. Vrian Sanitation District shall be addressed, and written evidence provided to the Department of Planning Services. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). Written evidence of Health Department approval shall be submitted to the Department of Planning Services. (Department of Public Health & Environment) D. The applicant shall address the requirements outlined in the referral dated October 19, 2009 from the Department of Public Works. Note in particular that a revised Drainage Report is required and necessary before review of the Construction Drawings can be undertaken. Written evidence of Department of Public Works approval shall be submitted to the Department of Planning Services. (Department of Public Works) E. The approved Flatiron II PUD final plat (Reception No. 2606946) includes locations at the west ends of both Lot 3 and 4 for detention ponds. Reconcile the inconsistency between the platted location and proposed designed location, and confirm acceptance from the Weld County Public Works Department. If the proposed re -location is acceptable, the revised location will need to be shown in the replat document, discussed below as Condition 1.H. Written evidence shall be provided to the Department of Planning Services. F. The applicant shall provide evidence that the Town of Firestone is aware of the proposed development due to the north half of the 60 foot access having been annexed by the Town. The agreement and form of collateral shall be prepared and reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the SPR plat. An amendment to the Flatiron II PUD is proposed in conjunction with this proposal, in order to combine Lots 3 and 4 into a single lot. Planning Services has determined that this represents a Minor Modification to the PUD Final Plan, as defined in Section 27-8-40.B of the Weld County Code. The revised PUD Final Plan shall be submitted to Weld County for review, and a signed mylar then approved and recorded. The access easement leading from the 1-25 E. Frontage Road is currently an unnamed driveway. In order to provide accurate way -finding without naming the drive, provide evidence that an Off -Site Directional Sign, indicating the address of the proposed building for this lot, can be placed on Lot 1, Flatirons II PUD subdivision. (See Section 23-4-75 of the Weld County Code for the definition of an Off -Site Directional Sign.) Provide a graphic of the sign, and provide evidence from the owners of Lot 1 that you can legally construct a sign on their property. (Department of Planning Services — Addressing) J. As an alternative to Condition 1.1 immediate above, you would be required to propose a name for the access drive/street, which will then need to be incorporated into the re -plat referenced in Condition 1.H. Also, if the access drive is converted to a named road, the owners of the building on Lot 2, Flatirons II PUD will be required to change their address to reflect their access onto the newly -named road. The applicant shall address the requirements outlined in the referral dated October 8, 2009 from the Mountain View Fire Protection District and provide evidence to the Department of Planning Services that they have satisfactorily reviewed utility and site plans for the site. Revise the title block to correctly reflect the subdivision and read as follows (all sheets): Flatiron Construction Corp. Lot (new lot number, once determined), Flatiron II PUD Part of the West Half, Southwest Quarter of Section 11, Township 2 North, Range 68 West of the 6th Principal Meridian Weld County, Colorado SITE PLAN REVIEW NO. SPR-432 B. Re -number all sheets to be 1 of 7, 2 of 7, etc. (Department of Planning Services) C. On Sheet 1, correct the legal description to Lot (new number), Flatiron II PUD, (etc., as existing). D. On Sheet 2, add both the Property Owner and Department of Planning Services' Certificates, per Section 23-2-160.W.6. E. Remove all setback indicator lines. SPR-432 Flatiron Construction Corporation 3 F. On Sheets 2 and 3 (currently SP2.0 and SP3.0), verify that all proposed signs are noted (including planned building signs). Signs must comply with Division 2, Appendix 23-C, Appendix 23-D and Appendix 23-E of the Weld County Code. Indicate the setback for the proposed sign at the southwest entry drive (a minimum of 5' is required), and provide the dimensions, per Section 23-2- 160.V.11. An elevation drawing of the proposed sign can be added to any of the set sheets, and the sign can be up to 150 square feet in size, per Section 19-3- 620.D. G. Indicate the recordation information for all easements noted on the plat, per Section 23-2-160.V.12 of the Code. H. Add the owners' names of adjacent properties. Designate and provide two off-street loading parking spaces, in close proximity to the building, per Section 23-4-50.A — E. The two such spaces are in addition to the 139 off-street parking spaces required by Chapter 23, Appendix 23-B. J. Verify that the requirements of the American Disability Act (ADA) are met for parking. ADA parking spaces must be a minimum of twenty (20) feet by eight (8) feet with five (5) foot aisles. A minimum of one space must be van accessible with an eight (8) foot aisle. A hard -surface accessible path is required from the building to the public right-of-way. Grading shall not be greater than 2% for the handicap stalls and access aisles. The dimensions of the handicapped parking space must be indicated on the plat. (Department of Planning Services) K. The approved Flatiron II PUD final plat (Reception No. 2606946) includes locations at the west ends of both Lot 3 and 4 for detention ponds. Reconcile the inconsistency between the platted location and designed location that is proposed by with this application, and confirm acceptance from the Weld County Public Works Department. Revise the site plan (Sheet 2 of 7) as necessary. L. Verify that all utilities are proposed underground, per Section 19-3-420.B. M. On Sheet 4 of 7 (currently EP1.0, Lighting), add another bollard -style lighting fixture (Type EE) along the sidewalk leading from Lot 2 to the proposed building (across the driveway from the proposed flat pole, along the sidewalk next to the proposed detention pond). This would provide continuity of lighting along the walkway (currently shown as 0.04 footcandles at that location), better safety next to the detention pond, and meet the goals of Sections 26-2-20.A.2 and 19-3- 420.A. N. On Sheet 4, three Type CC lights are proposed on the walls on either side of the front door, creating "hotspots" that are considerably brighter than on the remainder of the site (7.25 and 6.91 footcandles, for example). Such contrast exaggerates the lower -lit parts of the building, around the corner, making them less safe than otherwise. Consider having only two Type CC lights on either side of the front door. O. On Sheet 6 (currently L1), the amount of screening proposed along the north and south property lines is inadequate. Verify that 23% of the area located within the existing Lot 3 is landscaping, as required by the approved Flatiron II PUD final plat (Reception No. 2606946). Also, verify that 75% of the landscaping proposed for the entire site is of live material, as required of Section 19-3-330. Q. On Sheet 6 (currently L1), add some non -deciduous trees to the west of the proposed patio in addition to the existing deciduous ones, to provide year-round screening. 3. The following notes shall be placed on the plat: A. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the PUD/Commercial Zone District until a Site Plan Review has been approved by the Department of Planning Services. B. In the event that a portion of the building is proposed to be leased to another party in the future, the applicant shall submit a copy of the lease agreement and information regarding the proposed use of the leased portion to the Weld County Building Inspection Department, Mountain View Fire Protection District, and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. C. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. E. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. F. The applicant shall operate in accordance with the approved waste handling plan at all times. G. Fugitive dust and fugitive particulate emissions shall be controlled on this site. H. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. I. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. SPR-432 Flatiron Construction Corporation 5 t' J. Adequate toilet facilities (portable toilets) and hand washing units shall be provided during the construction of the facility. K. The facility shall utilize the existing municipal sewage treatment system (St. Vrain Sanitation District). L. The facility shall utilize the existing public water supply (Central Weld County Water District). M. Bottled water shall be utilized for drinking during construction of the project. N. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. O. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. P. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. Q. Weld County is not responsible for the maintenance of drainage related features. Exterior illumination of structures and lots shall be restricted as follows: 1) Sources of light shall be shielded so that beams of light will not shine directly onto adjacent properties. 2) Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. S. All structures, including signs, on site must obtain the appropriate building permits. A building permit shall be obtained prior to the construction of any building. A plan review is required for each building for which a building permit is required. Industrial building plans shall bear the wet stamp of a Colorado registered architect or engineer and be accompanied with a completed Code Analysis Data sheet. Each building will require an engineered foundation based on a site - specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Two complete sets of plans are required when applying for each permit. U. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. V. Approval from the Mountain View Fire Protection District will be required before any building permits can be issued. W. Effective January 1, 2003, Building Permits will be required to adhere to the fee structure of the Weld County Road Impact Program. The proposed location of the building is located on the northernmost portion of the lot with the parking located directly south. The site is located in a MUD. Currently Weld County does not have an IGA with the Town of Firestone. Public Works The applicant will need to provide a Site Plan. Because this site is located in a MUD, the applicants would need to adhere to the requirements of curb, gutter and sidewalks. The applicants indicated that they have included these in their plan. A Traffic Study may be required by CDOT. The applicants indicated that they have planned for a detention pond, however due to size limitations they asked if retention was possible. Staff encouraged the applicants to visit with Clay Kimmi, of Public Works, (970-304-6496 ext. 3741) for further guidance. The site is not located in a FEMA regulated floodplain. • • The main access to the site is paved. The north half of the access is annexed by Firestone. There was discussion of utilizing the existing access directly to the south of the cul-de-sac to access their lot in which they store their heavy equipment as well as providing another access from extending the main access to the east (north of the subject lots). Staff informed the applicants that only one internal access is allowed; therefore the access from the cul-de-sac will be acceptable. Planning Department Staff encouraged the applicants to visit with the Town of Firestone with regard to the proposal as well as the possible benefits of annexation. The applicants indicated that they are currently working on an agreement with Encana. Staff stated that the building cannot be located over property lines. According to the proposal it appeared that the building overlapped the property lines. In submitting the request for administrative hearing, the appellant has the option of including within the appeal a request for a review by the Department's internal administrative review committee pursuant to [Code] subsection 2.10. When such committee review is requested, processing of the appeal for formal administrative hearing, 2.9(5) and (6), shall be suspended until the appellant notifies the Commission to proceed with the administrative hearing, or the appellant submits a request to the Commission or the administrative law judge to withdraw the appeal. PERMIT EXPIRATI• 1. A permit shall be considered expired if the access is not under construction within one year of the permit issue date or before the expiration of any authorized extension. When the permittee is unable to commence construction within one year after the permit issue date, the permittee may request a one year extension from the issuing authority. No more than two one-year extensions may be granted under any circumstances. If the access is not under construction within three years from date of issue the permit will be considered expired. Any request for an extension must be in writing and submitted to the issuing authority before the permit expires. The request should state the reasons why the extension is necessary, when construction is anticipated, and include a copy of page 1 (face of permit) of the access permit. Extension approvals shall be in writing. The local issuing authority shall obtain the concurrence of the Department prior to the approval of an extension, and shall notify the Department of all denied extensions within ten days. Any person wishing to reestablish an access permit that has expired may begin again with the application procedures. An approved Notice to Proceed, automatically renews the access permit for the period of the Notice to Proceed. CONSTRUCTION 1. Construction may not begin until a Notice to Proceed is approved. (Code subsection 2.4] 2. The construction of the access and its appurtenances as required by the terms and conditions of the permit shall be completed at the expense of the permittee except as provided in subsection 2.14. All materials used in the construction of the access within the highway right-of-way or on permanent easements, become public property. Any materials removed from the highway right-of-way will be disposed of only as directed by the Department. All fencing, guard rail, traffic control devices and other equipment and materials removed in the course of access construction shall be given to the Department unless otherwise instructed by the permit or the Department inspector. 3. The permittee shall notify the individual or the office specified on the permit or Notice to Proceed at least two working days prior to any construction within state highway right-of-way. Construction of the access shall not proceed until both the access permit and the Notice to Proceed are issued. The access shall be completed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within the highway right-of-way. A construction time extension not to exceed 30 working days may be requested from the individual or office specified on the permit. 4. The issuing authority and the Department may inspect the access during construction and upon completion of the access to ensure that all terms and conditions of the permit are met. Inspectors are authorized to enforce the conditions of the permit during construction and to halt any activities within state right-of-way that do not comply with the provisions of the permit, that conflict with concurrent highway construction or maintenance work, that endanger Ill highway property, natural or cultural restSurces protected by law, or the health and safety of workers or the public. right-of-way or anyydopted municipal system and drainage plan. 5. Prior to using the access, the permittee is required to complete the construction according to the terms and conditions of the permit. Failure by the permittee to abide by all permit terms and conditions shall be sufficient cause for the Department or issuing authority to initiate action to suspend or revoke the permit and close the access. If in the determination of the Department or issuing authority the failure to comply with or complete the construction requirements of the permit create a highway safety hazard, such shall be sufficient cause for the summary suspension of the permit. If the permittee wishes to use the access prior to completion, arrangements must be approved by the issuing authority and Department and included in the permit. The Department or issuing authority may order a halt to any unauthorized use of the access pursuant to statutory and regulatory powers. Reconstruction or improvement of the access may be required when the permittee has failed to meet required specifications of design or materials. If any construction element fails within two years due to improper construction or material specifications, the permittee shall be responsible for all repairs. Failure to make such repairs may result in suspension of the permit and closure of the access. 6. The permittee shall provide construction traffic control devices at all times during access construction, in conformance with the M.U.T.C.D. as required by section 42- 4-104, C.R.S., as amended. 7. A utility permit shall be obtained for any utility work within highway right-of-way. Where necessary to remove, relocate, or repair a traffic control device or public or private utilities for the construction of a permitted access, the relocation, removal or repair shall be accomplished by the permittee without cost to the Department or issuing authority, and at the direction of the Department or utility company. Any damage to the state highway or other public right-of-way beyond that which is allowed in the permit shall be repaired immediately. The permittee is responsible for the repair of any utility damaged in the course of access construction, reconstruction or repair. 8. In the event it becomes necessary to remove any right- of-way fence, the posts on either side of the access shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence. All posts and wire removed are Department property and shall be turned over to a representative of the Department. 9. The permittee shall ensure that a copy of the permit is available for review at the construction site at all times. The permit may require the contractor to notify the individual or office specified on the permit at any specified phases in construction to allow the field inspector to inspect various aspects of construction such as concrete forms, subbase, base course compaction, and materials specifications. Minor changes and additions may be ordered by the Department or local authority field inspector to meet unanticipated site conditions. 10. Each access shall be constructed in a manner that shall not cause water to enter onto the roadway or shoulder, and shall not interfere with the existing drainage system on the 11. By accepting the permit, permittee agrees to save, indemnify, and hold harmless to the extent allowed by law, the issuing authority, the Department, its officers, and employees from suits, actions, claims of any type or character brought because of injuries or damage sustained by any person resulting from the permittee's use of the access permit during the construction of the access. CHANGES IN ACCESS USE AND PERMIT VIOLATIONS 1. It is the responsibility of the property owner and permittee to ensure that the use of the access to the property is not in violation of the Code, permit terms and conditions or the Act. The terms and conditions of any permit are binding upon all assigns, successors -in -interest, heirs and occupants. If any significant changes are made or will be made in the use of the property which will affect access operation, traffic volume and or vehicle type, the permittee or property owner shall contact the local issuing authority or the Department to determine if a new access permit and modifications to the access are required. 2. When an access is constructed or used in violation of the Code, section 43-2-147(5)(c), C.R.S., of the Act applies. The Department or issuing authority may summarily suspend an access permit and immediately order closure of the access when its continued use presents an immediate threat to public health, welfare or safety. Summary suspension shall comply with article 4 of title 24, C.R.S. MAINTENANCE 1. The permittee, his or her heirs, successors -in -interest, assigns, and occupants of the property serviced by the access shall be responsible for meeting the terms and conditions of the permit, the repair and maintenance of the access beyond the edge of the roadway including any cattle guard and gate, and the removal or clearance of snow or ice upon the access even though deposited on the access in the course of Department snow removal operations. Within unincorporated areas the Department will keep access culverts clean as part of maintenance of the highway drainage system. However, the permittee is responsible for the repair and replacement of any access -related culverts within the right-of-way. Within incorporated areas, drainage responsibilities for municipalities are determined by statute and local ordinance. The Department will maintain the roadway including auxiliary lanes and shoulders, except in those cases where the access installation has failed due to improper access construction and/or failure to follow permit requirements and specifications in which case the permittee shall be responsible for such repair. Any significant repairs such as culvert replacement, resurfacing, or changes in design or specifications, requires authorization from the Department. Hazardous Materials, Solid Waste - The Solid Wastes Disposal Sites and Facilities Act C.R.S. 30-20-100, et al, and Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), prohibit solid waste disposal without an approved Certificate of Designation (a landfill permit). The Colorado Hazardous Waste Act C.R.S. 25-15-301 et al, and the Colorado Hazardous Waste Regulations (6 CCR 1007-3) prohibit the transfer, storage or disposal (TSD) of hazardous waste except at permitted TSD sites. There are no permitted landfills or TSD sites within the State Highway Right of Way. Therefore, all solid or hazardous wastes that might be generated by the activities of entities entering the State Highway Right of Way must be removed from the ROW and disposed of at a permitted facility or designated collection point (e.g., for solid waste, a utility or construction company's own dumpster). If pre-existing solid waste or hazardous materials contamination (including oil or gasoline contaminated soil, asbestos, chemicals, mine tailings, etc.) is encountered during the performance of work, the permittee shall halt work in the affected area and immediately contact the CDOT Regional Permitting Office for direction as to how to proceed. DATE: OCTOBER 28, 2009 Environmental Health Services has reviewed this proposal for a two story office building and paved parking lot. Potable water will be provided by Central Weld County Water District and sewage disposal will be provided by St. Vrain Sanitation District. Documentation by both St. Vrain Sanitation District and Central Weld County Water District must be provided indicating that sewer and water are available. There will be a concrete truck/equipment washout area provided to contain concrete waste during construction of the facility. The concrete washout area is detailed on the site plan and the stormwater management report provided with the application. . The stormwater management report also indicates that any chemicals used during construction will be stored in enclosed storage areas, such as a covered shed or trailer. Vehicle and equipment maintenance and fueling to occur during construction will be done within a designated staging area and is noted on the site plan. The application indicates that a water truck will be brought in to control on site dust during construction, as necessary. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit documentation from Central Weld County Water District indicating that water service is available. 2. Submit documentation from St. Vrain Sanitation District indicating that sewer is available. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Once we return the package to you with all of the comments addressed, is there another review time? How long does the actual recording take? I have attached a draft of the revised plat, please review and respond with any comments that you may have and the final signature blocks that we need to include then we can get this one out of the way. Also, I had mentioned a while ago a couple of improvements that the owner would like to complete while they are doing the construction of this building. The first of which would be to construct a monument sign similar to the existing sign on PUD 2 lot 2 on the NW corner of PUD 2 lot 1 along the frontage road. I have attached pictures of the current sign, there is currently no signage on lot 1.
