SUBJECT: Proposed Amendments to USR-1708 resolution
Department of Planning Services proposes the following amendments to the USR-1708
resolution:
1) Move Condition of approval 6.G (page 6) to "Prior to recording the plat" and
renumber as condition 1.M.
This condition shall be modified to state: "A detailed design of the "concrete
unloading pad" shall be submitted to the Weld County Department of Public
Health and Environment, for review and approval. The design shall demonstrate
how all spilled wastes, storm water, and wash down water will be contained within
the receiving area and concrete sump. The design shall also include the method
in which seams will be sealed to prevent leakage through the pad. A leak
detection system shall be designed and installed beneath the "concrete unloading
pad". The "concrete unloading pad" shall be constructed and operated in
accordance with the approved design. Written evidence of Department of
Public Health and Environment approval of the "concrete unloading pad"
design and "leak detection system" design shall be provided to the
Department of Planning Services."
2) Move Condition of approval 6.H (page 7) to "Prior to recording the plat" and
renumber as condition 1.N.
Condition 6.H reads: "A copy of the drilling log shall be submitted to the Weld
County Department of Public Health and Environment."
3) Move Condition of approval 6.J (page 7) to "Prior to recording the plat" and
renumber as condition 1.O.
This condition shall be modified to state: "Solids and sediment will accumulate in
the storage tanks. The facility shall submit a detailed plan which describes the
method those solids will be removed, including all on -site handling procedures
and disposal Any amendments to the approved plan shall be submitted, in
writing, to the Weld County Department of Public Health and Environment, for
review and approval. Written evidence of Department of Public Health and
Environment approval shall be provided to the Department of Planning
Services."

submitted to the Department of Public Health and Environment and the Colorado

well as specific details regarding reclamation of the property. No structures or
equipment associated with the facility shall remain on the property following
closure. Written evidence of Department of Public Health and Environment
approval shall be provided to the Department of Planning Services."

SUBJECT: USR-1708, Lonestar Saltwater Disposal Facility Comments
Weld County Public Works has received the submittal application on July 24, 2009. Comments made during
this phase of the process will not be all-inclusive, and will address the critical issues of concern including but
not limited to the Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. All issues of concern and critical issues shall be resolved with the Public Works
Department.
WCR 34 is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most recent
AADT count for WCR 34 reflects 279 vehicles taken in 2007. The 85th percentile indicates that the average
speed is 53 miles per hour with 48% of the traffic being trucks.
WCR 49 is classified by the County is a Strategic Roadway, which requires a 140 -foot right-of-way at full build
out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future
right-of-way line. The most recent ADT count for WCR 49 reflects 3720 taken in 2009. The 85th percentile
speed is 71 miles per hour with 35% truck traffic.
Improvements Agreement: The applicant shall enter into an Improvements Agreement According to Policy
Regarding Collateral for Improvements (Lonestar Saltwater Disposal Facility USR-1708). Please refer to Rich
Hastings, Engineering, to finalize this item.
Haul Route: WCR 34 between the intersections of WCR 49 and WCR 53
Improvements: In reviewing the traffic study, the applicant is identifying approximately 180 round trips (total)
per day. Improvements required with the heavy hauling and hauling volume are:
➢ Triggered paving of CR 34 between WCR 51 and WCR 53
➢ Paving of the internal roadway (truck circulation pattern) parking lot and widening of the site access
radiuses to 60 feet shall be required.
➢ A stop sign will be required to be installed at the access before traffic will enter onto WCR 34
➢ A right turn acceleration lane on CR 49
➢ A right turn deceleration lane on CR 49

The applicant shall provide the County with construction drawings that detail the required improvements. The
plans shall consist of, at a minimum, main entrance intersection layout and grading, cross section, approach
road, internal truck circulation pattern, and adequate turning radiuses. A geometric recommendation on depth
of asphalt overlay and base to accommodate heavy truck traffic shall be provided. These plans will require
approval by the Public Works Director/County Engineer or his representative. A registered professional
engineer registered in the state of Colorado must prepare the construction plans. The plans, when reviewed
and approved, will constitute a section of this agreement. They will be attached hereto and referenced as
Exhibit "A."
The applicant shall warrant and guarantee all improvements for a period of one year from completion.
Maintenance: Lonestar agrees to excavate, repair, or patch any damage of said road that has been created
by heavy truck hauling from this USR site. The type and method of repair will be determined by the Public
Works Director/County Engineer or his representative. The repairs shall commence within thirty (30) days of
receipt or our written notice.
There will be an annual road inspection in the spring to determine actual conditions and what work is to be
preformed that summer if any repairs are needed.
In the future if road damage has increased beyond the point that repair of damage can reasonably restore the
road, Lonestar will pay a proportional share for reconstruction of those parts of said road.
Traffic Study: Weld County Public Works has received a Traffic Study for USR-1708 Lonestar Saltwater
Disposal Facility prepared and stamped by Matthew Kruse. After reviewing the submitted traffic study I have
prepared the following comments:
- There are sight distance issues at the intersection of WCR 34 & 49 due to rolling hills in the area.
- The applicant has indicated that this site will produce 180 trips per day.
-No parking or staging of commercial vehicles on the county road is allowed. Use on -site parking area.
- A stop sign will be required to be installed at the access before traffic will enter onto WCR 34.
-The access will have 45' radius to accommodate the larger trucks entering and existing the site.
- Although turn lanes are not warranted on WCR 49 based on the proposed trip volumes supplied in the Traffic
Study Public Works is requesting a right turn acceleration lane and a right turn deceleration lane on WCR 49 to
account for:
• The heavy trucks in use which require longer acceleration and deceleration times and lengths as
compared to passenger vehicles
• Public safety the 85th percentile is 71 mph on WCR 49 and there have been 6 accidents in the past 4
yrs.
• Also for consistency with similar projects in the county which had the requirement of acceleration and
decelerations lanes.
Preliminary Drainage Report: A preliminary drainage report stamped, signed, and dated by Daniel Dean
Hull, P.E. number 39337, was submitted for review.
1. Please provide a final drainage report which addresses all redline comments in the preliminary report
and on the drawings associated with the preliminary drainage report.

2. Please ensure that the final drainage report and all associated drawings are stamped, signed, and
dated by a registered professional engineer licensed in the State of Colorado.
3. Please provide an in-depth discussion regarding the off -site flows and how they will impact the site if
WCR 34 is overtopped.
4. Weld County's experience with the detention pond outlet design provided by the applicant is that they
are difficult to maintain and clog easily. Please design an orifice plate and trash for the outlet instead of
the riser pipe.
5. It should be noted that a grading permit will not be issued until all issues have been resolved and a set
of acceptable construction plans have been provided to Public Works. An early grading permit will
not be issued. Prior to the issuance of a grading permit, the applicant must submit evidence of
approval of a stormwater construction permit from the Colorado Department of Public Health and
Environment.
Geotechnical Report: The applicant has submitted a Geotechnical Report for the onsite conditions which
was stamped, dated, and signed by Joels C Malama, P.E. # 42184. The report does not contain a design for
the on -site asphalt pavement. A pavement design pavement design shall be submitted for review.
Flood Hazard Development Permit: Not required.
Comments made during this stage of the review process will not be all inclusive, as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.

a USR for brine water disposal facility

On Thursday, November 13, 2008 an informal discussion took place at the Greeley
Administrative Offices Conference Room regarding the proposed brine water disposal facility.
(The legal description is part of Section 18, Township 3 North, Range 64 West of the 6th P.M.; Situs
Address is 15988 CR 49, LaSalle)
Background Information:
The applicant is proposing a brine water disposal facility. The site encumbers approximately
37.327 acres.
There will be an office building located on site and will be manned 24/7. The applicant is
proposing one employee on site and an additional two employees during normal operating
hours.
Due to the topography of the land the applicant is proposing to gate the existing access to the
Noble Energy wells and install a new access to the east of the existing access for safety
precautions. The applicant has visited with Curt Moore of Noble Energy in regard to this matter
as well as some adjustments to the layout of the proposed facility.
The applicant is proposing 4 off-loading bays. The injection well will be located outside the
drilling envelopes; but close to the proposed tank farm.
The applicant indicated that this proposed facility mirrors the existing Conquest facility on CR 39
and CR 28.
The closest neighbor is located south of and adjacent to the site. According to the applicant he
has attempted to contact the neighbor on two occasions without any success to date.
The applicant has had discussions with Art Gutterson of Gutterson Ranches with regard to
gaining their traffic and to keep the traffic off of CR 49. The applicant stressed that he will
decrease the amount of traffic on CR 49 by working with Gutterson Ranches on this project.
Health
The applicant indicated that there is a well for the house and buildings located west of the
proposed facility. Previously the buildings were utilized for a dairy operation and the applicant is
not sure at this time if the well was classified as domestic or commercial use. If approved by the
state the applicant intends to pipe water over from this well to his proposed facility.
The applicant indicated that he would like to self -monitor the operation. Staff commented that
the Health Department would like the applicant to consider having a third party monitoring
system.
Public Works
Access is from CR 34. Applicant is proposing 60 trucks or 120 trips per day. Public Works will
require a 60 foot radius at the access point as well as pave the first 100 foot into the site and
double cattle guards for full tire rotation.
A Site Plan identifying the circulation and parking will be required.
A Traffic Study will be required. Xcell/decell lanes will also be required at the intersection of CR
49 and CR 34. The applicant expressed some concern on the xcell/decell lanes as he proposes
to decrease the amount of traffic on CR 49.
Public Works will require a Preliminary Drainage Report and a Geotechnical Report if they need
to do retention ponds.
The site does not appear to be a in a FEMA designated floodplain; therefore no Flood Hazard
Development Permit will be required.
Planning
The applicant indicated that he has an Oil and Gas Permit to drill and is proposing to drill at the
end of the first quarter 2009. He expressed that he would really like to expedite the process to
fulfill his expected timeline.
Staff explained the USR process - that the applicant shall submit 4 packets for our 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the applicant complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

Weld County Public Works has received the submittal application for the 7 Day Completeness Review. This phase of the
planning process is a content review of the submitted materials, NOT a technical review. Comments made during this
phase of the process will not be all-inclusive, and will address the critical issues of concern including but not limited to the
Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit.
The Public Works Department will perform a detailed technical review of the project once the submittal application is
deemed acceptable and is promoted to the review phase of the planning process.

Seld County Strategic Roadway: (December 2002) WCR 49 is classified by the County is a Strategic
Roadway, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27,
37, 49 and 74)
Our most recent ADT count for WCR 49 reflects 4,000 ± taken in 2009. The 85th percentile speed is 71 miles per hour
with 35% truck traffic.
Improvements Agreement: There will be two improvements agreements with this proposal. The first will be a
designated haul route associated with truck traffic. The second will be an improvements agreement according to policy
regarding collateral for improvements. This will be on -site improvements.
Site Plan: If the facility is going to be fenced, the entrance gate needs to be recessed the length of a typical WB50 semi
truck. There will be staging or parking on WCR 34 prior to entering the facility. A stop sign will be placed in the
appropriate location prior to entering on to the county road.
Traffic Study: The applicant has submitted a Traffic Study that was signed, stamped, and dated by Matthew L. Kruse,
P.E. # 41484. A technical review was not performed on this Traffic Study. A technical review of the study will occur when
an official application is submitted. Although turn lanes are not warranted based on the proposed traffic volumes Public
Works is requesting acceleration and deceleration lanes to account for:
• The heavy trucks in use which require longer acceleration and deceleration times and lengths as compared to
passenger vehicles
Public safety the 85th percentile is 71 mph on WCR 49 and there have been 15 accidents in the past 3 yrs with 3
injuries.
Also for consistency with similar projects in the county which had the requirement of acceleration and
decelerations lanes.

Preliminary Drainage Report: The applicant has submitted a preliminary drainage report that was signed, stamped, and.
dated by Daniel Dean Hull, P.E. # 39337. A technical review was not performed on this drainage report. A technical
review of the report will occur when an official application is submitted.
Geotechnical Report: The applicant has submitted a Geotechnical Report for the onsite conditions which was stamped,
dated, and signed by Joels C Malama, P.E. # 42184. The report does not appear to address offsite conditions for the
county roads bordering the site. If upgrades are required to the county roads, it will be necessary to provide a
Geotechnical Report that addresses the offsite conditions so the design of the roadway improvements can be reviewed.

SUBJECT: USR-1708, Lonestar Saltwater Disposal Facility Comments
Weld County Public Works has received the submittal application on July 24, 2009. Comments made during
this phase of the process will not be all-inclusive, and will address the critical issues of concern including but
not limited to the Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. All issues of concern and critical issues shall be resolved with the Public Works
Department.
WCR 34 is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most recent
AADT count for WCR 34 reflects 279 vehicles taken in 2007. The 85th percentile indicates that the average
"peed is 53 miles per hour with 48% of the traffic being trucks.
WCR 49 is classified by the County is a Strategic Roadway, which requires a 140 -foot right-of-way at full build
out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future
right-of-way line. The most recent ADT count for WCR 49 reflects 3720 taken in 2009. The 85th percentile
speed is 71 miles per hour with 35% truck traffic.
Improvements Agreement: The applicant shall enter into an Improvements Agreement According to Policy
Regarding Collateral for Improvements (Lonestar Saltwater Disposal Facility USR-1708). Please refer to Rich
Hastings, Engineering, to finalize this item.
Haul Route: WCR 34 between the intersections of WCR 49 and WCR 53
Improvements: In reviewing the traffic study, the applicant is identifying approximately 180 round trips (total)
per day. Improvements required with the heavy hauling and hauling volume are:
Upgrading to pavement of WCR 34 between WCR 51 and WCR 53, one mile
Paving of the internal roadway (truck circulation pattern) parking lot and widening of the site access
radiuses to 60 feet shall be required.
A stop sign will be required to be installed at the access before traffic will enter onto WCR 34
A westbound left turn deceleration lane on WCR 34
A southbound left turn deceleration lane on WCR 49 on to WCR 34 EXHIBIT

The applicant shall provide the County with construction drawings that detail the required improvements. The
Sins shall consist of, at a minimum, main entrance intersection layout and grading, cross section, approach
Wad, internal truck circulation pattern, and adequate turning radiuses. A geometric recommendation on depth
of asphalt overlay and base to accommodate heavy truck traffic shall be provided. These plans will require
approval by the Public Works Director/County Engineer or his representative. A registered professional
engineer registered in the state of Colorado must prepare the construction plans. The plans, when reviewed
and approved, will constitute a section of this agreement. They will be attached hereto and referenced as
Exhibit "A."
The applicant shall warrant and guarantee all improvements for a period of one year from completion.
Maintenance: Lonestar agrees to excavate, repair, or patch any damage of said road that has been created
by heavy truck hauling from this USR site. The type and method of repair will be determined by the Public
Works Director/County Engineer or his representative. The repairs shall commence within thirty (30) days of
receipt or our written notice.
There will be an annual road inspection in the spring to determine actual conditions and what work is to be
preformed that summer if any repairs are needed.
In the future if road damage has increased beyond the point that repair of damage can reasonably restore the
road, Lonestar will pay a proportional share for reconstruction of those parts of said road.
Traffic Study: Weld County Public Works has received a Traffic Study for USR-1708 Lonestar Saltwater
Disposal Facility prepared and stamped by Matthew Kruse. After reviewing the submitted traffic study I have
prepared the following comments:
here are sight distance issues at the intersection of WCR 34 & 49 due to rolling hills in the area.
- The applicant has indicated that this site will produce 180 trips per day.
-No parking or staging of commercial vehicles on the county road is allowed. Use on -site parking area.
- A stop sign will be required to be installed at the access before traffic will enter onto WCR 34.
-The access will have 45' radius to accommodate the larger trucks entering and existing the site.
- A westbound left turn deceleration lane is warranted on WCR 34 into the project site access based on the
turning movement figures in the traffic study.
-A southbound left turn deceleration lane is warranted on WCR 49 onto the WCR 34 based on the turning
movement figures in the traffic study.
- Although turn lanes are not warranted on WCR 49 based on the proposed trip volumes supplied in the Traffic
Study Public Works is requesting a right turn acceleration lane and a right turn deceleration lane on WCR 49 to
account for:
• The heavy trucks in use which require longer acceleration and deceleration times and lengths as
compared to passenger vehicles
• Public safety the 85th percentile is 71 mph on WCR 49 and there have been 6 accidents in the past 4
yrs.

Preliminary Drainage Report: A preliminary drainage report stamped, signed, and dated by Daniel Dean
Hull. P.E. number 39337, was submitted for review.
1. Please provide a final drainage report which addresses all redline comments in the preliminary report
and on the drawings associated with the preliminary drainage report.
2. Please ensure that the final drainage report and all associated drawings are stamped, signed, and
dated by a registered professional engineer licensed in the State of Colorado.
3. Please provide an in-depth discussion regarding the off -site flows and how they will impact the site if
WCR 34 is overtopped.
4. Weld County's experience with the detention pond outlet design provided by the applicant is that they
are difficult to maintain and clog easily. Please design an orifice plate and trash for the outlet instead of
the riser pipe.
5. it should be noted that a grading permit will not be issued until all issues have been resolved and a set
of acceptable construction plans have been provided to Public Works. An early grading permit will
not be issued. Prior to the issuance of a grading permit, the applicant must submit evidence of
approval of a stormwater construction permit from the Colorado Department of Public Health and
Environment.
Geotechnical Report: The applicant has submitted a Geotechnical Report for the onsite conditions which
was stamped, dated, and signed by Joels C Malama, P.E. # 42184. The report does not contain a design for
the on -site asphalt pavement. A pavement design pavement design shall be submitted for review.
Flood Hazard Development Permit: Not required.

Dear Ms. Carter:
Thank you for meeting with Jim Lee and me the other day to discuss the public improvements to
Weld County Road (WCR) 49 and WCR 34 requested by the County. From that meeting, I
believe we have begun completing the steps necessary to make this project successful for both
the County and Lonestar, LLC. However, that success hinges on the magnitude of the
improvements that will be required. I would like to restate our concerns and point of view as we
continue to work towards a resolution of the requests for public improvements that the County
has made.
1. The cost of the requested public improvements has increased tenfold from the original
pre -application meeting and pre -submittal. The original estimated order of magnitude
was approximately $100,000. The current estimated order of magnitude is
approximately $1,300,000.
2. The magnitude of the currently requested public improvements presents an undue
hardship on Lonestar.
3. While the paving of WCR 34 that the County is requesting may be warranted, we feel
that the request to have Lonestar absorb the cost for this improvement is not warranted.
The majority of the truck traffic expected to use the facility will come from the Guttersen
Ranch. This is existing "produced water" truck traffic that has historically used this
section of WCR 34. The Lonestar facility intends to capitalize on this existing "produced
water" truck traffic. In essence, we anticipate a "no net increase" in truck traffic. To
support the "no net increase" statement, further analysis will be completed using the
traffic counts the county has provided, traffic counts that will be gathered at the gate to
the Guttersen Ranch, revisions to the traffic study, and future data collection.
4. The requested improvements to WCR 49 are unnecessary since the warrants, based on
the traffic study and the County's Code, are not met. In addition, the facility will capture
truck traffic coming from the east and that traffic will return to the east during operating
hours reducing the truck traffic at the intersection of WCR 49 and 34.
5. The requested left turn lane on WCR 34 is unnecessary since the warrant based on the
traffic study and County's Code is not met.

6. As a possible alternative to the requested public improvements, Lonestar, LLC would
like to propose wording in the development agreement that would require the requested
public improvements to be constructed only at such time that agreed upon thresholds for
"net truck traffic increase" are met. This provision will provide the time needed for the
County and Lonestar to gather traffic data over a longer period of time to truly
understand the impacts the facility is having.

This addendum is In response to the telephone conference call held on Wednesday September 9,2009
between Lamp, Rynearson & 'Associates,, Inc., (LRA) and Weld County Public Works in regard to the
proposed Lonestar Disposal Facility along WCR 34, between WCR 49 and WCR 61, in Weld County, CO,.
This addendum is to provide additional Information from. this phone conversation and to serve. as an
additional resource to the previously submitted traffic study. There were a few items brought up•in the
conference call that are hopefully clarifled.below,
Anticipated Generated Trips
The site is limited to a daily total of 60 round trips based on the size of the site. This would mean that
there could be the possibility of 60 trucks entering the facility and 60 trucks exiting the facility. There have
been different totals quoted 'and discussed and the terminology differs, but there would only be a
maximum of 60 round trips or a total of 120 vehicle trips (60 entering/60 exiting)
Peak Hour Trips
Due to the unique nature of the site; It is difficult to estimate the peak hour trip totals for the site. The
trucks and operation of the site.wl!l be spread oiit elrnost evenly throughout the entire daily hours of
operatloris beoause of the time need to fill and unload the water Into the trucks. With this in mind, Weld
County. has•conimented that the traditional 10% of the daily traffic would be seen in the peak hour traffic
often times used at other land uses and roadways could be used for this site. For the'10% this would
equate to 6 trucks entering the.site in the peak hour arid 6 trucks exiting the site in the peak hour.
Trip btstributlon
Similar to estimating the 'peak hour trips for the site, due to the land use, it is difficult to estimate a trip
distribution pattern that wquld•be seen daily for the site. The trip distribution. included In the traffic study
estimated that approximately. 33% of the trucks would be headed and coming from the west via WCR .49
and 66% of the trucks would be coming from and heading to the east. This distribution was based on
conversations with the owner and the fact that the Guttersen Ranch is located to the oast of the proposed
site. There are, already wells in operation on this rahch and, most likely, the disposal of the water from
those wells would use the proposed facility. Using this split and the revised peak hour volumes from,
above, in the peak hour, 2 trucks would be entering the site from the. west and 4 trucks would be entering
the site from the east. in the same peak hour there could be 2 trucks exiting the site and heading to the
west and 4 trucks exiting the site and heading to the east.

volumes; acceleration' and, deceleration •lanes are notiwarranted at the proposed Site 'entrance or at. the
• Intersection of WCR 34 and WCR 49 in the year 2009;and year/2914 design years. Based on :the revised
peak hour, warrants are hot anticipated to be met at'either of these two intersections In the year 203,0 as
well: Actually, based on the latest traffic :counts that were conducted, there was an hour in the AM
collection period,<from.8:00 am to 9:00 am that experienced. 11• left turning movements, this didn't show
up in the peak hour diagram because the peak hour for the entire intersection was from•7:00 am to 8:00,
am.:This volume appears to show that the :intersection already heeds a •left turn deceleration lane at this
ihtersection, without any traffic from the proposed development; ..

Amend Planning Commission Resolution, paragraph 1.G as follows:
The Applicant and the Weld County Department of Public Works shall enter into an
Improvements Agreement (On -site and Off -site) which shall set forth the following road
improvements to be performed by the Applicant:
(i) The Applicant shall construct a right turn acceleration lane on WCR 49;
(ii) The Applicant shall construct a right turn deceleration lane on WCR 49;
(iii) The Applicant agrees to pay maintenance of Weld County Road (WCR 34)
between WCR 51 and the gate of the Gutterson Ranch, which is approximately
one (1) mile, for the life of the disposal or until said portion of WCR 34 is paved
pursuant to paragraph (ii) below. The County shall bill the Applicant once per
year for all maintenance performed on said portion of WCR 34 in that year. The
bill shall be the actual cost of the maintenance, not to exceed $10,000.00, and it
shall include a dated itemized list of materials and labor;
(iv) The Applicant agrees to pay its pro rata share for paving WCR 34 between WCR
51 and the gate of the Gutterson Ranch at the County's request, but only when the
total trips on said portion of WCR 34 exceeds three hundred (300) vehicles per
day, as documented by a traffic study performed in accordance with acceptable
engineering practices. The Applicant's pro rata share shall be determined by
dividing the actual trips generated by the disposal facility by the total vehicle trips
per day on said portion of WCR 34 . The Applicant shall be provided with a
copy of the traffic study at least prior to performance of its
obligation under this paragraph;
(v) The Applicant shall pave the internal roadway and parking lot and widen the site
access to 60 foot radiuses;
(vi) The Applicant shall provide a final drainage report and final site grading plan;
(vii) The Applicant shall provide construction drawings acceptable to the County for
the improvements to WCR 49;
(viii) The Applicant shall provide an offsite geotechnical report to the County that
includes pavement designs for offsite paving improvements.
