HomeMy WebLinkAbout20091684.tiffRESOLUTION RE: APPROVE NON -FINANCIAL AGREEMENT FOR VARIOUS SERVICES PROVIDED TO REFUGEES AND AUTHORIZE CHAIR TO SIGN - LUTHERAN FAMILY SERVICES OF COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Non -Financial Agreement for Various Services Provided to Refugees between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, and the Lutheran Family Services of Colorado, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Non -Financial Agreement for Various Services Provided to Refugees between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, and the Lutheran Family Services of Colorado be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of July, A.D., 2009. Griego, Direc RE: n Servifts Department Non -Financial Agreement between the Board of Weld County Commissioners, Weld County Department of Human Services' Employment Services and Lutheran Family Services of Colorado Enclosed for Board approval is a Non -financial Agreement between the Board of Weld County Commissioners, on behalf of the Weld County Department of Human Services', Employment Services of Weld County and Lutheran Family Services of Colorado. This Non -Financial Agreement was presented at the Board's March 3, 2009, Work Session. The purpose of the Non -financial Agreement is to outline a variety of functions that Lutheran Family Services will provide to Somali and Burmese refugees with employment support services at Employment Services. Lutheran Family Services staff will be on site at Employment Services 2-3 days per week and provide assistance in the following areas: I. Assist with workforce registration of refugees. 2. Provide support within the Employment Services Resource room for online registration, online job searches, etc. 3. Provide translation support for application information and forms that assist Employment Services in improving communication with the refugee populations. 4. Provide interpretation for ongoing job search activities and workshops. 5. Provide and coordinate outreach activities to the Refugee community that informs the refugees of the services available through the workforce center. The Non -financial Agreement becomes effective upon signature of the parties and shall be reviewed annually to determine continuance or need of modification. If you have questions, please give me a call at extension 6510. 2009-1684 NON -FINANCIAL AGREEMENT THIS AGREEMENT, made this 29th day of April, 2009, by and between the Board of County Commissioners of Weld County, Colorado on behalf of the Weld County Department of Human Services' employment Services of Weld County, hereinafter referred to as "Employment Services" and Lutheran Family Services of Colorado (LFS), hereinafter referred to as "Agency". WHEREAS, Employment Services and the Agency offer employment services to various employers and applicants seeking employment, and WHEREAS, the Agency encourages its clients to utilize the services offered by Employment Services as a means of obtaining employment, and WHEREAS, the Agency seeks verification on the employment status of its clients, and WHEREAS, Employment Services and the Agency desire to work together to meet both the needs of the employer and the client, NOW, THEREFORE, in consideration of these goals, the parties agree to the following: A. The Agency agrees to: 1. make available a bilingual/bicultural (with focus on a refugee language/cultural groups) Employment Specialist/Navigator at Employment Services for a designated period of time weekly to assist shared (refugee) clients 2. provide job referral screening information to Employment Services on each client prior to client's referral to employment 3. follow established procedures and policies of Employment Services in regard to temporary/short term jobs, part-time employment, full-time employment, Federal bonding, registration and referral and placement functions and requirements 4. additionally, the Agency Employment Specialist/Navigator may be involved in any or all of the following Employment Services activities: client reception area support, services registration assistance for refugee clients as necessary, assistance to clients in resource room, participation in selected Employment Services -sponsored employment fairs, participation in selected Employment Services -sponsored workshops, translation/interpretation when available, and other activities as agreed upon by designated contact persons of the Agency and Employment Services. 5. designate a contact person to whom all matters regarding this agreement may be channeled 6. provide an endorsed release of information form from each client for whom the Agency seeks verification B. Employment Services agrees to: 1. host a bilingual/bicultural (with focus on a refugee language/cultural groups) Employment Specialist/Navigator at Employment Services for a designated period of time weekly to assist shared (refugee) clients 2. provide training and orientation to Agency Employment Specialist/Navigator, concerning Employment Services policies, procedures, service delivery protocols and available employment resources 3. provide verification of client registration with Employment Services 4. provide verification of referral and/or placement of the Agency's client(s) upon written request from the Agency 5. refer client to job openings based on client skills and abilities 6. designate a contact person to whom all issues regarding this agreement may be channeled 7. provide bonding services according to the guidelines of the Federal Bonding Program 8. contact Agency with any concerns or questions regarding a client's status in the employment process or placement C. Denial of Services Employment Services has sole authority to deny services to any job applicant who fails to follow the established rules and policies of Employment Services. D. Assurances: 1. The Agency agrees that it is an independent contractor and that its officers, employees and clients do not become employees of Weld County, and therefore, are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement 2. Weld County, the Board of County Commissioners of Weld County, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Agency, or its employees, volunteers, or agents while performing functions as described in this Agreement. The Agency shall indemnify, defend and hold harmless Weld County, the Board of County Commissioners of Weld County, its officers and employees for any loss occasioned as a result of the performance of this agreement by its employees, volunteers, clients and agents. The Agency shall provide workers' compensation insurance for all employees of the Agency engaged in the performance of this Agreement, as required by the Colorado Workers' Compensation Act. 3. No officer, member or employee of Weld County, and no member of their governing bodies, shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. 4. The Agency understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Department of Human Services and the results provided to the Board of County Commissioners of Weld County and the Weld County Workforce Development Board. 5. The Agency and Employment Services assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. E. Mutual Agreement: The Agency and Employment Services mutually agree to abide by the terms and conditions herein specified. F. Termination: This Agreement may be terminated at any time by either party giving thirty (30) days written notice, and is subject to the availability of funding G. Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and may not be changed or modified without prior agreement of both parties and their governing bodies.
