Environmental Health Services has reviewed this proposal for a custom seeding
business. There are two existing structures on the property. The equipment storage
building will be utilized for maintenance and storage of equipment. The
office/warehouse will initially contain 4 employees with the option to expand to 8
employees. The adjacent warehouse will be used for seed as well as equipment
storage.
Water is provided by an individual well and a change in use application has been
submitted to the Colorado Division of Water Resources. This department does not have
a copy of the commercial well permit.
Employees would utilize the office for drinking and restroom facilities. There will be 35
employees in the summer and 20 during the winter months. An individual sewage
disposal system (SP -0800021) provides sewer for the site. The septic system shall be
evaluated by a Registered Engineer to ensure there is adequate capacity for the
proposed use. In addition, the system was redtagged on July 29, 08 for a broken tank
lid so the ystem has not received final approval.
There ar several people associated with the business who are licensed pesticide
applicators and are regulated according to the Pesticide Section of the Colorado
Department of Agriculture.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.

2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
3. If the applicant intends to utilize the existing septic system, for employee use,
the septic system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical
review describing the systems ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations.
4. All: septic systems located on the property shall have appropriate permits. Septic
permit SP -0800021 must receive a final approval from the Weld County
Department of Public Health & Environment.
5. A copy of the pesticide applicators license, from the Colorado Department of
Agriculture, shall be provided to Environmental Health Services, Weld County
Department of Public Health & Environment.
6. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing areas shall capture all effluent and prevent discharges from
the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
7. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
8. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.

9. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge
permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment.
10.The applicant shall submit evidence to Environmental Health Services, Weld
County Department of Public Health & Environment, from the Colorado Division
of Water Resources, demonstrating that the well is appropriately permitted for the
commercial use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at alftimes.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
8. The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.

10. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
12. Any vehicle washing areas shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.
13.The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
14. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
16. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information the water for drinking and sanitary purposes will be
provided by existing Well Permit No. 279052. That well is permitted for use in one
commercial business, domestic purposes inside one single-family dwelling, domestic animal
watering, livestock watering and the irrigation of 1 acre of lawn and garden. The existing
well can be used to serve the proposed commercial seeding business as long as the well is
operated in accordance with the terms and conditions on the well permit.

Upon review of my case files and computer, an active Zoning Violation (ZCV08-00125) was noted. This
violation was initiated due to the operation of a custom seeding/storage business and/or the processing or
sale of the seed or seeding operations without first obtaining the necessary Weld County Zoning Permits.
This case has not yet been presented to the Board of County Commissioners through the Violation
Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
ensure that custom seeding operation/storage has been removed from the property.

There are 3 historical building permits listed for this parcel .Two are active, BCR08-00209, a
structural steel building for storage, and BCR08-00057, office/storage building.
1. A building permit shall be obtained prior to the change of use, or construction of any new
structures
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld
County Code.

The Weld County Public Works Department has reviewed this proposal. This project
falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements
are as follows:
COMMENTS:
The most current road counts for WCR 65 are 456 AADT taken to the north of the site
access, and 333 AADT to the south of the site access, both taken in September of
2008. The applicant will add an additional 40 counts from their site per day.
REQUIREMENTS:
1. Please include water quality calculations per Weld County Code Ordinance
2008-9.
a. Calculations shall be done for three separate areas:
i. The office building and visitor/employee parking area
ii. The truck/equipment parking area
iii. The equipment storage and maintenance shop area
b. Calculations should be done according to the Urban Drainage & Flood
Control District's Criteria Manual, Volume 3, Stormwater Quality
Management, Section 4.4.
c. Please show the water quality areas on the final plat as a drainage
easement.
2. A 60' radius is required for the site access onto WCR 65 to accommodate truck
traffic.
3. The applicant shall indicate how oil and gas traffic will access the existing gas
well to the east of the USR area and obtain any necessary access agreements.
4. Please include the width of the access road on the final plat as well as
approximate dimensions for all existing and proposed buildings.
5. Please include all line types in the legend on the final plat.
6. A private improvement agreement will be required to be signed and Exhibits A &
B filled out.

in the right-of-way on WCR 65. A special transport permit will be required for any
oversized or overweight vehicles that may access the site and may be obtained
by contacting Amy as well.
8. Please indicate how parking stalls will be delineated and show on plate. Please
use stop blocks to delineate stalls next to the office building.
The appli ant shall address the comments listed above for this review process. Comments made during
the USR st ge of the review process may not be all-inclusive, as revised materials must be submitted and
other co terns or issues will arise during further review. Issues of concern must be resolved with the
Public Works Department prior to recording.

After the site visit today the applicant shall place Truck and Trailer Parking signs on
the light poles east of the south building and south of the north building to indicate
this area as semi truck parking.
In the employee parking area west of the north building the applicant shall place Parking
signs on posts. The stop blocks will be required adjacent to the building.

Michelle,
Please have the applicant include the exiting CR-65 roadway bridge located about 80 -feet
north of the propose access driveway into the facility and large existing irrigation ditch
on the east of CR-65 from the existing roadway bridge to State Highway 52 adjacent to the
USR property shown on the site plan map. These are critical features to be shown to
understand the complete picture of the area.
