RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DIXIE, TAMMY AND RODNEY DE FOE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Dixie, Tammy and Rodney De Foe, VI #0500359, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of February, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Rodney De Foe, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 10, 2009, to allow adequate time for the property owners to remove the mobile home or to submit a Use by Special Review Permit, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. The extra mobile home would either need to be permitted (if even applicable) or removed from the property. 2.) The headquarters of Defoe Roofing - My records indicate a Home Occupation application along with a Zoning Permit for a Commercial Vehicle application have both been submitted and are being processed accordingly. 3.) While the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and miscellaneous debris is an allowed use within an Agriculturally zoned subdivision, such as Aristocrat Ranchettes, it must be completely SCREENED from all adjacent properties and public rights -of -ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this office. 4.) Lastly, during my last inspection I noted the presence of a camper/trailer-RV which appears to be connected to utilities, this shall be disconnected from all utilities and if being utilized as a dwelling unit abated as such immediately. RECOMMENDATION The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for immediate legal action. When I returned her phone call, I spoke to a Rodney De Foe. He stated that no one lives on the Violation Summary Report property except them. He said that that the mobile home was previously used as a Medical Hardship and when his mother passed away he simply converted into a shop/storage shed. I explained that he would have needed a permit to do that and therefore, the mobile home was going to need to be removed from the property. He said he understood. He asked what about the 'derelict vehicles'. I explained that he could have 'derelict vehicles' they just needed to be screened from all adjacent properties and public rights -of -ways. I explained that he could perhaps use a side of his shop as 1 side and build 3 other sides and that he didn't need to fence his whole property. He said that didn't sound so bad. I asked him to let Tammy know I called. He said he would. 10/27/2008 Phone Call Tammy De Foe (303-857-6308) called. She said they needed a little more time in order to install a privacy fence. I asked how much time she thought they would need. She said she thought they could have the fence installed within 30 days. I explained that I would grant the 30 day extension and would send a letter out reflecting that. She said she had some other questions. She said regarding the office. She said they had filled out some paperwork a while back. I asked if she paid a fee with that paperwork. She said no. I explained the Home Occupation application and $50 fee. She said well that kind of did make sense. I explained that if she could find a processed check. I told her that I could not find any evidence of ever recieving an application or fee. She said she would look. I told her I would go ahead and fax her a copy of the Home Occupation application. Her fax number is 303-857-6398 fax. We also briefly discussed the commercial vehicles. She said they only had 2 commercial vehicles related to their roofing operation. I told her that 1 of them would have to be removed and they would need to apply for the 1 that would be staying on the property. I told her I would fax that application as well. She said the mobile home was converted to a storage unit when the medical hardship went away. I told her I would look into it. 12/22/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: All 3 (three) mobile homes are still present. (2 as dwellings) I also noted only 1 (one) Commercial Vehicle present on the property. The Noncommercial Junkyard shall be restored, removed or completely screened from all adjacent properties and public rights -of -ways.
