Your property has an existing special use permit (USR- 486 approved in March of 1982) for a supply and salvage yard. The USR-486 application materials stated it "specializes in making used farm equipment (trucks, tractors and farm machinery) and equipment parts available to local farmers. The yard also reclaims metal such as iron, brass copper, tin, etc. for recycling purposes." The USR-486 application does not refer to "used car sales" as one of the specific uses to be allowed. In addition to not having used car sales specified as a use in the original USR-486 application, your letter indicates that more car sales will likely require more staff (a total of 10 employees was stated in the original USR-486 application) and there is also the potential for a considerable increase in customer trips to the site. The proposed sign (in which you are applying for a variance) appears to be associated with the cars sales component of the property and should be addressed through the use by special review application versus through a variance application. The Department of Planning Services is willing to either refund your variance application fee or credit your application fee to the use by special review application. We would like to schedule a pre -application meeting with you to discuss the proposed changes to your site and provide you information and feedback about the use by special use permit process prior to submittal of a formal use by special review application. Martin, retired from the farming industry because of a severe hail storm and began a salvage operation in Milliken, Colorado. He called this operation the Milliken Junk Yard. He successfully operated this business until the spring of 1959 when he decided to move it out of Milliken to its current location on Hwy 34 and changed the name to Martin Supply and Salvage. At the time of this move there was little concern about zoning. As time passed, the business grew and Weld County became more organized, so we decided that our location should be addressed through a special use permit instead of relying on a grandfather exemption that is allowed by Weld County. So, in 1981 we applied for and received a special use permit which described the primary purpose of our business which included the sale of trucks, tractors, farm equipment and parts. It also included the collection of ferrous and non-ferrous materials for the purpose of recycling. It should be noted that we have sold cars and trucks to the public and are and have been a licensed dealer through the state of Colorado since 1951. The omission of cars on our special use permit was an error on my part and should have been included. In regard to the planning commission's concern that the overall function of the business would change if we advertise to sell more cars, I disagree, by advertising we will most likely sell more cars and trucks which will require us to employ more staff and we will have to pay more taxes but we will still recycle just as much material in a smaller space. Over time the quantity of used parts may decline because more space will be taken up by quality used cars and trucks but the overall operation of the business will not change. If you would like us to include an advertisement for merchandise recycling on the new sign, we will do so. Increasing any part of our business is welcome. Over time he invested all of his energy and finances into the business so by the time Highway 34 became a well traveled road in the mid 60's the salvage operation had become very successful. During the late 60's the Colorado Department of Transportation decided to lessen the visual impact of the salvage yard on travelers of Highway 34 by planting trees along the yard frontage and then allowing my father to put up a sign above the trees. This worked well until the trees grew above the sign and made it difficult for customers to see it. In the meantime, a cell tower was built with proper permits from the county next to our existing sign and has been used for communication ever since. As of late, the staff at Martin Supply Inc. has decided that we would like to improve the overall looks of the yard by moving the salvage operation further from the road and expand our used car sales across the front. To do this, we must increase the number of used cars in our inventory and would like to put up a sign on the cell tower to encourage auto sales. We are therefore requesting that the county give permission for Martin Supply Inc. to erect a two-sided sign at the top of the existing cell tower pole. As part of that project, a safety assessment was conducted. One of the recommendations of the study was the removal of the median crossover located at your eastern most access. As a result of that recommendation and pursuant to Section 2.6(7) of the State Highway Access Code, it is our intention to remove that crossover and limit your accesses to right turns only. In an effort to provide your eastbound customers with reasonable ingress, beginning the week of July 14th, CDOT's contractor will construct a left turn deceleration lane at 131S` Avenue. This deceleration lane will enable your customers to make a safe u -turn to get to your site. Your customers wishing to travel east will be able to make a u -turn at the WCR 17 intersection. The left turn lane at 131St Avenue will be completed prior to any removal of the median crossover. Signs will be placed advising your customers of this impending change.
