Environmental Health Services has reviewed this proposal for dog agility and obedience
training for up to 35 dogs and a kennel for up to 5 dogs. The applicants will utilize the
septic system at the home for client usage. An evaluation was received by the
applicants' engineer who indicated the existing septic system is adequate for the small
business usage. However, the engineers report stated that there would not be any
dogs boarded over night. If dogs will be boarded, the report must be resubmitted to
include the number of dogs that may be boarded over night. The application indicates
that there will be up to 4 part time trainers. There was not an indication in the engineers
report that the septic system is sufficient for those employees. The additional hydraulic
load, for boarding and employees, must be taken into account when the engineer
evaluation is updated.
Water is supplied by Central Weld Water District. The waste handling plan should
indicate that waste is cleaned on a daily basis and picked up weekly by a sanitation
company.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
The following requirements are recommended to be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan (on site dust) for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment (WCPHE).
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.

3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
4. In the event the applicant intends to utilize the existing septic system at the
existing home for boarding sanitation needs and employee usage, the septic
system shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load from the
boarding and employee usage. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code..
9. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
10. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11. The facility shall utilize the existing public water supply. (Central Weld County
Water District)
12. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
Weld County Road Classification Plan
WCR 19 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.

controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum

There are two historical Building permits attached to this parcel; BC -9600114 single family dwelling,
and COC-990088 sheep barn
1. A building permit shall be obtained for all new buildings and the change of use of any
structure.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld
County Code.
4. Plans shall be submitted to Brighton Fire District Fire District for review and approval prior to
issue of Building Permits,

Upon review of my case files and computer, an active Zoning Violation (ZCV08-00346) was noted. This
violation was initiated due to the operation of Skyline Kennels without first obtaining the necessary Weld
County Zoning Permits. This case has not yet been presented to the Board of County Commissioners
through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
remove all commercial storage and operations from the property.

Dear Mr. & Mrs. Coyne:
This letter is in response to a request for water service to serve the following property described as follows:
Lot A Recorded Exemption No. 1311 -27 -3 -RE 1796 recorded February 6, 1996 in Book 1531 at
Reception No. 2475236, being part W1/2 Section 27, Township 2 North, Range 67 West, Weld
County, Colorado
Water service is presently available to the above described property by tap number 1476 located at Weld
County Road 19 between Weld County Roads 16 & 18. Additional water service can be made available to
this property, provided all requirements of Central Weld County Water District, Northern Colorado Water
Conservancy District and the Bureau are satisfied. Please note that you are responsible for confirming
that this property has met the requirements of Northern Colorado Water Conservancy District and
the Bureau of Reclamation. To do this, you may contact Marilyn Conley with Northern Colorado
Water Conservancy District at 970.532.7700. Central Weld cannot issue a tap until all requirements are
satisfied. The District is aware of the special use permit for the small dog training business and has no
opposition.
Central Weld County Water District requires that contracts be consummated within one (1) year from the
date of this letter or this letter shall become null and void unless extended in writing by the District. Please
contact the Central Weld office for further information about water service. Due to the rapid cost increase of
raw water, existing tap fees may not apply for water service to this property. The District will not notify, by
separate letter, any prospective landowners or land purchasers of tap fee or line extension cost increases. The
cost of a tap fee and/or improvements will have to be paid in advance to the District by the prospective
customer in accordance with District policy.
It is your responsibility to confirm with your local Fire Protection Authority if fire flow water capacity is
required for your project.
