RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JUAN SOTO FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Juan Soto, ZCV #0900217, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of November, 2009, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Juan Soto, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until January 10, 2010, to allow adequate time for the property owner to submit an
application for a Use by Special Review permit.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900217 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Juan Soto to remedy the violation of the Weld County Code, and any
other persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until January 10, 2010, to allow adequate time for the property owner to submit
an application for a Use by Special Review permit.

- A letter from Mr. Soto indicating that all public rodeo events have ceased and that no future public
rodeo events will be held on his property.
- A complete Use by Special Review application for the public rodeos shall be completed and
submitted to the Department of Planning Services.
For questions, I recommend you speak with one of our On -Call Planners. Please call ahead
(970-353-6100 Ext. 3540) so a sufficient amount of time can be set aside to discuss this

This letter is to follow up on the conversation that occurred at our pre -application meeting with you on
August 27, 2009. There is a pending zoning violation on the property (ZCV09-00217) for operation of a
public rodeo without an approved use by special review permit. A letter dated August 4, 2009 was mailed
to Mr. Soto giving a deadline of September 4, 2009 to correct this zoning violation. Therefore we will need
one of the following by Tuesday, September 29th
• A letter from Mr. Soto indicating that all public rodeo events have ceased and that no future
public rodeo events will be held on his property.
• A complete Use by Special Review Permit application for a public rodeo shall be submitted to
the Department of Planning Services.
If this information is not received by Tuesday, September 29th, Bethany Salzman will proceed with
scheduling xou for a zoning violation hearing before the Board of County Commissioners on Tuesday,

I asked that your department be included in the forwarding. The case number is WC09-2943.
They want to have this throughout the summer. There was a liquor violation, and I wrote
for an MIP, but they were selling shots to people as they came in. I have also asked for
the Health Department, and the State Liquor enforcement to be copied. I have spoke with
our Animal control unit, but we have no proof of any animal violations.

If they become re -occurring I can initiate a violation for this type of activity without
the required zoning permit (Use by Special Review). If it was a one time only deal, as
long as they don't exceed 350 people (requiring a Temporary Assembly Permit), I do not see
any enforceable issues. Since these events seem to happen during off hours, people call
you. In the past I have used some deputies reports (witness accounts) in prosecuting
these cases. They typically note the date, time and what type of event they witnessed.
They also have noted approximately how many people and a guesstimate on the number of
vehicles. I would also want to know if they saw liquor or any type of gambling. It is
also my understanding if you witness the "tail tipping" this is a cruelty to animals case,
but I would recommend you speak to Gary Schwartz about that for sure. Please forward the
address if this latest and greatest event. Did you ask records to forward a copy of your
report to me? Thank -you
