HomeMy WebLinkAbout790365.tiff RESOLUTION RE: RENEWAL OF LEASE BETWEEN WELD COUNTY, COLORADO AND THE GREAT WESTERN RAILWAY COMPANY CONCERNING CERTAIN PROPERTY LOCATED IN MEAD, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County, Colorado is currently leasing a machinery storage yard located in Mead, Colorado as per a lease agreement entered into between Weld County, Colorado and The Great Western Railway Company on February 1, 1937 , and WHEREAS, said machinery storage yard is located on a parcel of land more particularly described as follows : Beginning at a point which is the Southeast corner of Block 5, in the Town of Mead; thence North along the East line of said Block 5 for a distance of 100 feet to a point; thence West for a distance of 190 feet to a point which is 40 feet distant, measured at right angles, from the center line of the main line of the Great Western Railway; thence southwesterly along a line which is 40 feet distant from and parallel to the centerline of The Great Western Railway Company' s main line for a distance of 107 . 8 feet to a point on the South line of said Block 5 ; thence East along the South line of said Block 5 for a distance of 230 feet to the place of beginning; which said leased premises contain 21,000 square feet, more or less. WHEREAS, the current lease rate is $1 . 00 per year, and WHEREAS, The Great Western Railway Company has informed the Board of County Commissioners of Weld County, Colorado that their leases have been appraised and the rental for said machinery storage yard would now be $313 .00 per year, and WHEREAS, the Board desires to renew the lease agreement with The Great Western Railway Company for a period from February 1, 1979 to February 1, 1980 at the rate of $313 .00 per year. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the lease agreement between Weld County, Colorado and The Great Western Railway Company con- l= G 1 f 790365 cerning the abovedescribed parcel of land shall be renewed for a period from February 1 , 1979 through February 1, 1980 at the rate of $313 . 00 . No doubt the propor- tion of taxes we pay to Weld county for that property exceeds that amount. We have had all of our leases appraised and the fair rent- al on that land would be $313.00 a year. It has also come to my attention that you were going to eliminate that facility. It is our policy to develop business along the railroad that will use the railroad. We feel that if we located some- one else to use that site that was going to utilize the rail- way that we would ask you to vacate the property. Lease from GWRC for Mead Grader Shed (LHR #133) By letter of August 22, 1979, the GWRC advised Weld County that the land we lease at Mead was recently appraised for lease at $313.00 per year, and requested the County to advise of our wishes. We currently lease the property for $1.00 per year. On it we have a grader shed with two graders and have for several years permitted one grader operator to live in his own trailer on the property at no charge. This is beneficial to the County for security, since Mead has no police force. It is recommended that the County retain the lease even if it is necessary to re-negotiate the annual fee.
