HomeMy WebLinkAbout20092943.tiffRESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONER REGARDING VIOLATION VI #0500271 AGAINST CATHERINE MARTIN-SAMPSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Catherine Martin -Sampson, VI #0500271, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of November, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Catherine Martin -Sampson and Stephen Sampson, property owners, were present at said hearing, and WHEREAS, the Board deems it advisable to refer said matter back to the Department of Planning Services, in order to allow the property owners adequate time to provide proof that horses have been present on the property since the year 1996. No location adjustment was deemed necessary, as, at the current time and the foreseeable future, there is very limited use other than residential acreages in this area. Sale 1 is surrounded by commercial/industrial property, possibly inferior to subject; Sale 2 is zoned agricultural but has same neighborhood influence as subject; Sale 3 is located between two large feedlots, which could be considered similar to subject's commercial location. The sales utilized herein offer varying degrees of similarity and I was able to bracket the sales in terms of sale price and size. All sales had either irrigation water or a well, similar to subject. Sale 1 is given most consideration due to site size - - this sale would best compete with subject for a buyer looking for a small acreage looking for site large enough for housing of and pasture for large animals. ANALYSIS OF CURRENT AGREEMENTS OR PRIOR SALES: The DOM and L-S/P ratio are consistent with the data in this report. No sales of subject or Sales 1 and 2 have occurred within past year. Sale 3 sold within the past year - - purchased for $90,000; owners did considerable updating (reflected in condition adjustment), then resold at a minimal profit (after closing costs). FINAL RECONCILIATION: Sales Comp. Approach is considered to be the best indicator of value, as it best reflects current market trends and buyer attitudes; Cost Approach is analyzed but not considered relevant when evaluating older residences - -physical depreciation of residences the age of subject is difficult to measure, as it is often offset by its appreciation due to remodeling. Income Approach not considered relevant, as most homes in this area are owner occupied. We also discussed that the zoning for this property was changed in the mid 70's from Agricultural to Commercial because the owners at the time were running a truck farm. He also stated that the zoning should not have been changed because the use fit the zoning requirements. Todd also stated that we wouldn't have to change the zoning for the horses.
