HomeMy WebLinkAbout20090967.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 22, 2009 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, April 22, 2009, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William H. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of April 20, 2009, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PROCLAMATIONS: NATIONAL CRIME VICTIMS' RIGHTS WEEK - APRIL 26 -MAY 2, 2009: Chair Garcia read the certificate into the record, proclaiming April 26 -May 2, 2009, as National Crime Victims' Rights Week. Representatives from various departments were in attendance to demonstrate their support for the proclamation. Commissioner Conway thanked all of the attendees for being there and for all that each of the departments has done to assist victims of crime. Chair Garcia stated at the time the Bill of Rights and the Constitution were drafted, the founding fathers considered government excesses and protections for those who are accused of committing crimes; however, protections for victims are not similarly listed in those documents; therefore, the services provided by the various County departments to assist victims are of high importance. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway stated the amendment for Senate Bill 3, the Enhanced Emissions Bill, which is intended to confine the ability of the Enhanced Emissions 2009-0967 BC0016 Program to municipal areas made it out of committee yesterday. He stated it was a very close vote, and he acknowledged the hard work of Glenn Vaad, House Representative and former County Commissioner, who spoke eloquently on behalf of the amendment. He also expressed his appreciation to Buffy McFadden, Committee Chairperson, who was receptive to the concerns being raised. Commissioner Conway stated the Board remains fundamentally opposed to the Program in Weld County because it believes Weld County is in compliance; however, the goal of the amendment is to lessen the burden of the Program on Weld County citizens, since the legislation for the Program is moving ahead. He stated there is a long fight ahead and the State Department of Health made it clear it will try to remove the amendment from the Bill. Commissioner Kirkmeyer thanked Commissioner Conway for remaining at the meeting throughout the entire evening to ensure the Board's position was expressed. Commissioner Kirkmeyer stated she was at the capital yesterday and she spoke to the lobbyist for the District Attorney's Association and the Executive Director of the District Attorney's Council regarding Senate Bill 286, which is regarding a change in sentencing. She stated the Bill is still alive; however, it will be sent to the Criminal Justice Committee for study. She explained the Bill, if passed, will create the need for another pod at the Weld County jail, due to more people being in jail as a result of the change in sentencing. She stated Senate Bill 288 is regarding putting a cap on the number of beds at the Department of Corrections and both Bills will likely be killed. In response to Commissioner Conway, Commissioner Kirkmeyer stated the Governor took a clear position on Bill 286 and indicated the Bill needs to be considered by the Criminal Justice Committee; however, she is unsure of his position on Bill 288. BIDS: PRESENT BID QBP #60900070, ENGINEERING SERVICES FOR ROAD IMPROVEMENTS ON CR 13 (CR 50 TO US HWY 34) - DEPARTMENT OF PUBLIC WORKS: Monica Mika, Director, Department of Administrative Services, stated said bid will be presented for approval at a date not yet determined. She stated the bid is a Quality Based Proposal bid and a work session will be conducted with the Board to discuss it, and interviews have been conducted with the thirty-five vendors listed. She stated staff will make a recommendation regarding which vendor to award the bid to at the work session. Don Warden, Director of Finance and Administration, stated staff may recommend the bid not be awarded to a vendor and that the project be completed by County staff. APPROVE BID #0900055, WINDOW CLEANING - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Mika stated acceptance of the low bid from The Everclean Company is recommended to provide window cleaning services for all of the buildings in the City of Greeley area. In response to Commissioner Conway, Ms. Mika stated The Everclean Company is located in the City of Loveland. Commissioner Rademacher inquired if separate vendors provide window cleaning services for the Southeast and Southwest Weld County buildings. Ms. Mika stated this is the first time in a long time that the County has contracted with a company to clean its windows; previously it was performed by County staff and Useful Public Assistance; therefore, based on this information, she assumes the Southeast and Southwest Weld County Offices do not employ a vendor to perform the service. Toby Taylor, Department of Buildings and Grounds, concurred with Ms. Mika. In response to Commissioner Rademacher, Ms. Mika stated the cost will be $10,782.00 and the next lowest bid is $13,820.00. Commissioner Rademacher moved to accept said low bid from The Everclean Company, based on staff's recommendation. Seconded by Commissioner Conway, the motion carried unanimously. APPROVE BID #6003-09, FUEL (UNLEADED, DIESEL, E-85, AND PROPANE) - DEPARTMENT OF PUBLIC WORKS: Ms. Mika stated acceptance of the bid from Agland, Inc., is recommended by staff and it is the vendor the County currently holds a contract with for fuel. Commissioner Long moved to accept said low bid from Agland, Inc., based on staff's recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. Minutes, April 22, 2009 2009-0967 Page 2 BC0016 NEW BUSINESS: CONSIDER RENEWAL APPLICATION FOR 3.2 PERCENT BEER RETAIL LICENSE AND AUTHORIZE CHAIR TO SIGN - CIRCLE K STORE #2709846: Mr. Barker stated the Sheriff's Office, Department of Public Health and Environment, and the Department of Planning Services have no concerns regarding the establishment. In response to Commissioner Rademacher, Mr. Barker stated the store is located on the 1-25 access road. Commissioner Kirkmeyer moved to approve said renewal application and authorize the Chair to sign. Seconded by Commissioner Rademacher, the motion carried unanimously. CONSIDER APPOINTMENT TO JUVENILE COMMUNITY REVIEW BOARD: Commissioner Conway moved to appoint Valerie Duran-Gurule to the Juvenile Community Review Board, with a term to expire November 1, 2011. Seconded by Commissioner Rademacher, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
