RESOLUTION
RE: APPROVE CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 0233/2000)
FOR PARCEL # 053933113007
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from the office of the Weld County Treasurer
to cancel one (1) Tax Lien Sale Certificate (TS CERT 0233/2000) for parcel #053933113007, and
WHEREAS, the facts as set forth on Exhibit A, a copy of which is attached hereto and
incorporated herein by reference, require the cancellation of the of TS CERT 0233/2000, and
WHEREAS, the facts as set forth on Exhibit A further authorize the denial of a refund to the
holder of TS CERT 0233/2000, and
WHEREAS, after review, the Board deems it advisable to cancel the Tax Lien Sale
Certificate (TS CERT 0233/2000) for the property described above and to authorize denial of a
refund to the holder of the Certificate.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Treasurer's request to cancel the Tax Lien Sale Certificate
(TS CERT 0233/2000) on parcel #053933113007 be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 2nd day of February, A.D., 2009.

MEMO TO: WELD COUNTY COMMISSIONERS
On November 2, 2000, Tax Lien Sale Certificate 0233/2000 was sold to John J Sauter for the
following property:
ACCOUNT# R0541386
PARCEL # 053933113007
LEGAL DESCRIPTION: 2614 L3 & 5 BLK6 1ST ADD BUCKINGHAM
I am hereby asking for TS CERT 0233/2000 to be canceled because of a second tax lien sale
certificate of purchase was sold on November 4, 2004 to Johnny M Perdue. Johnny M Perdue
assigned TS CERT 0336/2004 to Johnny M Perdue & Frankie J Perdue on September 12, 2008.
Johnny M Perdue & Frankie J Perdue made application for a Treasurer's Deed to the property
and at that time John J Sauter was notified and given the opportunity to endorse all subsequent
taxes onto his certificate and make application for a Treasurer's Deed himself John J Sauter
chose not to take any action. The Treasurer's Deed was issued to Johnny M Perdue & Frankie J
Perdue. This created the need of a resolution by the Board of County Commissioners to cancel
TS CERT 0233/2000.
No authorization of refund to John J Sauter due to the circumstances described above.
