RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800325 AGAINST RANUIFO ARIAS-LUJAN FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ranuifo Arias-Lujan, ZCV #0800325, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of March, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Ranuifo Arias-Lujan was not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Ranuifo Arias-Lujan to remedy the violation of the Weld County Code, and any
other persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

REMEDY
As we discussed the parking or maintenance of more than 1 (one) COMMERCIAL VEHICLE (at any
time) or the storage of commercial materials or equipment (such as Agricultural implements) requires
a Use by Special Review (USR) permit. My records indicate that a Pre -Application Meeting was held
on December 11, 2008. As indicated during that meeting, if a complete Use by Special Review (USR)
application is received before March 9, 2009, the above referenced Violation Hearing will be cancelled.

Upon a visual inspection of the property, the following
items were noted: 1+ Commercial Vehicles and NCJY
consisting of Derelict Vehicles and Miscellaneous debris.
NO pictures were taken during this inspection.
During an on -site inspection with Ranulfo, the following
items were discussed. The Noncommercial Junkyard is
not part of this violation, it actually pertains to the
property immediately West of and adjacent to this one,
but NOT this property. There are mostly 2
COMMERCIAL VEHICLES that park on this property. A
Dump truck and a propane truck (truck and trailer).
Ranulfo indicated that he wished to proceed with the
USR application so he can park 2 or more commercial
vehicles on this property at any time. I told him I would
send him the application and a 30 day letter to turn in the
Pre -Application Request form.

Greeley Planning Office - See notes in file.

hearing to request additional time from the Board.

Thank you -- I met with Mr. Arias and also spoke to Kim today -- Mr.
Arias plans to cure the violation by removing one of the commercial
vehicles and any farm implements. He will continue to park one
commercial vehicle (his semi truck -- always empty when parked at this
site), his personal vehicles (sounds like there is only one pick up),
and the tractor that he uses for yard maintenance and snow removal at
this property. Otherwise, everything else goes away.
It will take him a little time to find storage space but he should be
able to get this cured by the end of February / early March.

USR for truck parking

On Thursday, December 11, 2008 an informal discussion took place at the Greeley
Administrative Offices Conference Room regarding the proposed truck parking. (The legal
description is part of the SW4NE4 Section 25, Township 1 North, Range 67 West of the 6`" P.M.;
Situs Address is 1563 Caroline Ave, Wattenburg CO.)
Background Information:
The property is currently in violation (ZCV08-00325) for the parking of 2 commercial vehicles.
The applicant wishes to park the vehicles on his property due to previous vandalism at another
location. The applicant does store some farm equipment on a short-term basis until the
equipment can be hauled off and sold. The site encumbers approximately 0.88 acres. There
are no employees which come to the site.
Parking area is fenced by chain link fencing. There is currently no lighting on the parking area,
however the applicant indicated his intent to have some lighting in the future.
The applicant stated that the neighbors have expressed no opposition of the parking of his
vehicles. The applicant mainly utilizes the route to the south of the Town of Wattenburg;
however he indicated that he will use the route through the Town but respects the speed limit.
The applicant expressed concerns over his neighbor to the north who will store steel beams on
the property and enters onto an adjacent property to access his neighbor's site.
Public Works
Due to the minimal traffic impact, no Traffic Study will be required.
No Drainage Report will be required, however Public Works will require a water quality feature
for the site if there will be additional buildings in the future.
No Flood Hazard Development Permit will be required as the site is not in a floodplain.
Planning Department
The applicant will need to install opaque screening around parking area.
Staff presented two options to the applicant: 1) USR application, and 2) Home Occupation with
only storing one (1) commercial vehicle on site. The applicant indicated his desire to proceed
with the USR application as he wishes to keep both commercial vehicles on site.
Staff stated that the USR application will need to be submitted prior to February 16, 2009 to
avoid a violation hearing with the Board of County Commissioners.
Staff explained the USR process - that the applicant shall submit 4 packets for our 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the applicant complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

In unincorporated Weld County (such as this property) a property owner is allowed 1 (one) COMMERCIAL
VEHICLE without a Use by Special Review being required. This property requires a Use by Special Review
(USR) permit for the following reasons:
1.) Ranulfo's Commercial Vehicle is on the property and his father's dump truck (comes and goes) — If more
than 1 (one) Commercial Vehicle is associated with a property (even if temporary) a USR permit is
required.
2.) Ranulfo indicated during his meeting last week (which I was not present for) that he purchases Ag
Equipment (from auctions) storing it on this property until it can be taken where ever it needs to go — this
use would also require a USR.
All current and foreseeable future uses should be called out under this USR application and can be permitted in
one fail swoop.
As long as he stays in compliance with what he submits on his USR application (and whatever he is approved
for), he will not need to renew this permit (but it is tied to this property — meaning if he moves, the USR does not
go with him).
He is not considered part of Wattenberg instead his property is in unincorporated Weld County with Agricultural
Zoning.

Hi — it's Judy Svendson that lives at 15339 Nancy Avenue.
I am trying to help one of my friends that lives at 1563 Caroline Avenue, Fort Lupton. We are confused about
what needs to be done in order for him to keep his business trucks (2) parked at his residence. Most of the time,
these trucks are gone & on the roads and highways. He received a bunch of papers from your department, but
what is exactly involved in getting this resolved for him.

Does he need to pay a one time fee or renewal fee each year? If you could explain part of this, it would be most
helpful.
When he purchased the property 5 years ago, Ranuifo was told by the county that he was in rural zoning and
not Wattenburg town/city limits. His address is even Fort Lupton not Wattenburg_
Any information you can give me would be helpful in this matter. We will be waiting for your answer.

PRE -APPLICATION REVIEW REQUEST
I
The pre -application request Is the preliminary review of a land use proposal, Pre -application reviews ere required
prior to beginning the application process: however, this review Is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second end fourth Friday of any given month pre-epplicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
Information, a brief narrative and a map delineating the property location, in addition to the other items listed.

Approved With Conditions
The Subdivision Exemption is approved in accordance with information submitted in the application and the policies
of the county. The Department of Planning Services has determined through its review that the standards of Section
11.17 of the Weld County Subdivision Ordinance have been met.
1. Prior to recording the plat:
A. The SE Lot shall utilize the existing access point. No circle drives or additional accesses shall be
granted.
The approved accesses shall be clearly shown on the plat.
WCR 23 3/4 (Caroline Ave.) is designated on the Transportation Plan Map as a local gravel road, which
requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30
feet from the centerline of Weld County Road 23 3/4 shall be delineated on the plat as right-of-way.
This road is maintained by Weld County.
D. The SE Lot shall comply with the one (1) acre minimum lot size required by Section 11.8.5 of the Weld
County Subdivision Ordinance.

All proposed or existing structures will or do meet the minimum setback and offset requirements
for the zone district in which the property is located. Pursuant to the definition of SETBACK in the
Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured
from the future right-of-way line.
Any future structures or uses on site must obtain the appropriate zoning and building permits.
RE -2588 was approved in conjunction with this subdivision exemption for the purpose of dividing
off a second set of existing improvements from the parcel.
Prior to the release of building permits on the SE Lot, the applicant will be required to submit a
recorded deed describing the lot upon which the building permit is requested with the building
permit application. The legal description on such deed shall include the lot and subdivision
exemption number.
Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
2. This Subdivision Exemption was approved to bring an illegal parcel into compliance with the State of
Colorado and Weld County's minimum lot size requirements.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of
Section 11.15.9 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)
days from the date of approval by the Department of Planning Services. The applicant shall be responsible
for paying the recording fees.
4. Planning Staffs approval of this subdivision exemption is based upon satisfying the above conditions. Should
an applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, then this
case will be forwarded to the Board of County Commissioners with a recommendation for denial.

23-3-40.R Any use permitted as a Use by Right, an Accessory Use, or a Use by Special
Review in the commercial or industrial zone districts, provided that the property is not a lot in
an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of
any regulations controlling subdivision. PUD development proposals shall not be permitted to
use the special review permit process to develop.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used to
facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A (Agricultural) Zone District. A COMMERCIAL VEHICLE shall include,
but is not limited to, semi -trailers, dump trucks, construction equipment, railroad cars and
cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate to the
condition of a DERELICT VEHICLE.

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.

42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road
rights -of -way or otherwise not equipped with lamps and other equipment, as required in
Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of
Planning Services.

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.
