RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DAVID AND BILLIE REED FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, David and Billie Reed, ZCV #0900032, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, David Reed, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 14, 2009, to allow adequate time for the property owners to have the tenants remove the brick company and all the equipment to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Business?? David Reed (587-2321) called. He said he was just trying to allow a friend to store some equipment and supplies out there. He said they don't really run the business from this property, they just store some stuff. I explained they could apply for a permit to continue. After he heard the possible fees, he said he thinks the guy will just remove the stuff. He said he would try to get ahold of him this week. I told him to call me right back after he got in touch with him. He said he would. He then said he has another friend that he allows to park his semi out there. I explained that the Code allows 1 (one) Commercial Vehicle (since he isn't in a subdivision) without any permits. He said boy there are alot of rules. I tried to explain them as best as possible. David & Billie Reed came to the Greeley Planning Office. They met with Kim Ogle, Chris Gathman, Kris Ranslem and I to discuss their business/commercial activities. Sorry for the delay, we have been out of Colorado. We don't have any plans for changing the grade or drainage. This is farm land draining onto farmland. We have a company located in Johnstown who is primarily in the brick laying business. They needed a place to keep their scaffolding, some brick. and associated trucks, forklifts, etc. and we agreed to allow them to store the equipment behind our barn. We have asked for a date of April 16th to discuss this at a preliminary hearing. Most of the six acres is planted in winter wheat or pasture grass at the present time and this is a small plot behind the barn which is not suitable for farming. Please call if you have questions or need anything further from me. I don't know why we need a permit for a small storage area; we are not located in any city, just farm land. Since I do not know how you intend to proceed, this next letter is being sent.
