RE : APPLICATION FOR CHANGE OF ZONE, RICHARD GEISERT.
WHEREAS, a public hearing was held on September 20, 1976,
in the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing a petition of Richard Geisert,
care of Gary Sears, 818 12th Street, Greeley, Colorado, requesting
a change of zone from C (Commercial) to I-UD (Industrial Unit
Development) on a parcel of land involved in a subdivision located
in part of Lot 6 and in part of Lot 5 of the Southeast Quarter
of the Northeast Quarter of Section 5, and Lot 3 of the Southwest
Quarter of the Northwest Quarter of Section 4, Township 5 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, according
to the Union Colony Subdivision, Weld County, Colorado, and
WHEREAS , the petitioner was present, and
WHEREAS , there was no opposition to the change of zone,
and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request of the petitioner and studied the recommendations of
the Weld County Planning Commission as submitted, and having
been fully informed and satisfied that the proposed change of
zone conforms in all respects to the requirements of Sections 8. 2
and 8 . 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the petition of
Richard Geisert, care of Gary Sears, 818 12th Street, Greeley,
Colorado, for a change of zone from C (Commercial District)
to I-UD (Industrial Unit Development) on the above described
parcel of land be, and hereby is, granted.

I hereby certify that pursuant to a notice dated August 16, 1976
duly published August 20, 1976 and September 10, 1976 in the Greeley
Booster, a hearing was held on the request of Richard Geisert for
a Change of Zone at the time and place so specified. After discussion,
Commissioner Carlson made a motion and Commissioner Jacobucci seconded
it to approve the Change of Zone. Motion carried unanimously.
A motion was then made by Commissioner Jacobucci and seconded by
Commissioner Moser to approve the Preliminary Plat. Motion carried
unanimously.
All five commissioners were present.

Be it Resolved by the Weld County Planning Commission that the
application for rezoning from C ( Commercial District ) to
I -UD ( Industrial UniRi3l>zMEQbbmettering the following described

1 . Although the Colorado Geological Survey has indicated that the
mineral deposit under the subject property is a deposit of com-
mercial value , the Planning Commission does not feel that it is
commercially feasible to extract the gravel resource for the
following reasons :
A. The existing land use ( residential and commercial ) in the
immediate area would not be compatible with gravel extraction
on the subject property.
B . Extraction would not be compatible with the existing zoning ,
( Estate , Commercial and Industrial ) in the adjacent areas
especially with regards to the extensive Estate District
located immediately to the north. (Continuted )

C. Development of a gravel pit operation on the subject property
would not be in conformance with the permitted uses proposed
for the area under the City of Greeley Comprehensive Plan .
The subject property is proposed to be a light industrial
district. Gravel extraction is permitted only in conservation
districts .
2. The Weld County Utility Advisory Board has recommended approval
of the utility plat on July 29, 1976.
3. The Weld County Health Department has indicated the subject area
can support individual on-lot sewage disposal systems .
4. The Western Hills Fire Department has indicated they have no
objections to the proposal provided the fire protection provisions
are followed as shown on the plans .
5 . The Weld County Building Inspection Division indicated they have
no objections provided there is adequate floodproofing design for
the proposed development.
6. The City of Greeley Planning Commission has recommended approval
of the zone change and preliminary plat.

Dear Mr. Sears:
SUBJECT: GEISERT'S INDUSTRIAL P.U.D. , PROJECT NO. 76 1 ENG 0161
We have reviewed the Colorado Open Mining Land Reclamation Act with respect to
commercial mineral deposits and have concluded that the area is prohibitive to
mineral extraction due to its size, approximately 16 acres.
In order to have a safe operation, side slopes of an open pit would have to be
maintained at approximately a three foot to one foot slope which would limit
the area to be mined appreciably. It would be economically feasible if a
much larger area, say in excess of 100 acres, were considered. In addition,
this area is subject to possible inundation from flood waters of the Cache La
Poudre River, thus constituting an extreme safety hazard.
Another factor which would be prohibitive to mining this area is the land use
of adjacent areas which at the present time is zoned light industrial. It
would appear to be very restrictive to a land owner to maintain this land for
a long period of time until the demand is such that this area would be attract-
ive for the procurement of mineral resources.

REQU�STI'BE tabled FOR THE FOLLOWING REASONS :
1 . The Colorado Geological Survey has indicated the subject property is
underlain with a floodplain gravel deposit. Sec. 34-1-305 C.R.S. 1973,
as amended, states, "After July 1 , 1973, no board of county commissioners,
governing body of any city and county, city, or town, or other govern-
mental '6'uthority which has control over zoning shall , by zoning, rezoning,
granting a variance, or other official action or inaction, permit the
use of any area known to contain a commercial mineral deposit in
a manner which would interfere with the present or future extraction
of such deposit by an extractor." The applicant has not shown that
the mineral deposit under the subject property is not a commercial
mineral deposit.
2. The Weld County Utility Board voted unanimously on July 15, 1976 to
recommend disapproval of the utility plat. Revised plats will be sub-
mitted at the July 29th Utility Board meeting.

We are requesting industrial PUD zoning on approximately 15 acres
immediately east of the by-pass on East Fifth Street. The total area,
which is owned by Richard and Francis Geisert, shall be used by light
industrial users.
At the present time, there is the office and garage of Dick's
Excavating, and also, a mechanics garage located on the property.
We plan to offer for sale, lots in said subdivision to be used
for light industrial purposes, which shall include wholesale and retail
business uses.
We have applied for and expect to be able to use domestic water
from the city of Greeley. It is necessary at this time for each user
to have a septic system, because there is no sewer available, or will
there be in the immediate future. Because of the large size of the
lots, l} acres or larger, and because of the light use by the types
of businesses by the intended purchasers, we feel septic systems will
be adequate.
Upon receiving approval from the County on the zoning and platting
request, we will immediately start development and offer for sale those
lots which have not already been contracted for.
We feel the zoning we are applying for will be compatible with
the surrounding area. To the east, the property is agricultural , and
to the north, south and west, there are presently businesses. We have
chosen this particular area because of its central location, and also,
because it does provide highway access.
The particular soil in this parcel is not condusive to farming.
Because of the property being immediately adjacent to the by-pass and
also being surrounded by business zones , residential zoning is undesirable.
For these reasons, we feel that this Industrial PUD is the most desirable
use for the property and compatible with the surroundings.

1 . We are requesting a zone change because we feel it necessary for
a light industrial zone, in order to utilize the property for its
best use.
2. Under the city of Greeley's comprehensive plan, this particular
area has been designated for industrial use. Because of other
commercial and industrial uses in this area of Greeley, we feel
it important to maintain the industrial use.
3. The proposed rezoning will cause up-grading of utilities serving
the area. For this reason, we feel that this development will
benefit other lands adjoining the area.
4. The property in question has been land filled as much as 4 feet
in some areas, in order to raise the property above the 100-year
flood plain. The surrounding areas probably should be utilized in
a commercial or industrial use at the time that they are also brought
up to development standards.
5. At the present time, I am unaware of any County industry zoned
property which is available. The Greeley area has had need for more
industry zoned ground.
6. There is no proof of any faulty zoning in the area. However, there
has been many requests for light industry zoned ground, and we
have been unable to locate property for these companies .
7. At the present time, Sears and Company Realtors have two contracts
from other companies, to purchase lots in this subdivision, in
the event that Weld County approves the zone change and plat.
Because of other requests, we feel that there is a need for as
much as 150 to 200 acres additional industrial zoning in the area.
8. The companies which have signed contracts with us to purchase lots
on this property will use said property for, one a truck repair
facility, and the other, a welding s-upply wholesale office and
warehouse.

UTILITY INSTALLATION AGREflI NT
THE Mountain Bell Company and the
Greeley Gas Company
hereinafter collectively called "Utility Companies", and
Richard H. Geisert , hereinafter called "Developer",
enter into the following agreement this 12th day of July
19 76 •
WITNESSET H:
1. The Developer is the owner or builder of a certain subdivision,
planned unit development, planned building group or other commercial,
residential or industrial real estate development (hereinafter
called "Development") known as Geisert's Industrial P.U. D.
2. Developer desires to have telephone, electric, gas,
and services available to the future purchasers
or tenants of his development as soon as practically possible.
3. Developer desires to have the utility cables, wires, pipe, conduits,
etc. , underground.
4. In order to provide telephone, electric, gas,
, and , service at the
earliest practical date, it is necessary for the Utility Companies to
commence installation of underground facilities during the con-
struction of the develolauent.

5. The placing of cables, wires, pedestals, pipes, conduits, meters,
etc. , by the Utility Companies prior to completion of all construc-
tion, grading, or other work results in a substantial risk that
these facilities may be damaged, cut, injured or otherwise destroyed
in whole or in part. The damage may be occasioned by the action of
the Developer, his Contractor and/or his Subcontractors, or third
persons not employed by or working for the Developer. The risk of
injury to Utility Companies' property could be virtually eliminated
by installing aerial plant or waiting until all other construction,
grading and other work has been completed.
6. It is understood that Developer is selling sites iwthin the Develop-
ment, and once ownership is transferred to a third party purchaser,
Developer shall be released from any responsibility arising by virtue
of the acts of said third party purchasers which result in damage to
the facilities of the Utility Companies.
NOW, THEN, in consideration of the above and the mutual convenants herein-
after set forth the Utility Cmpanies and the Developer agree as follows:
PROCEDURES:
A) The Developer shall develop a utility plan with the Utility Companies
in reference to the location of utility lines and easements during pre-
liminary planning of land usage. Such a utility plan will be reduced
to writing, signed and dated at an appropriate time by the signatories
of this contract. Changes in such plan after this tine will be agreed

upon by the parties to this contract. It is understood that the sub-
ject utility plan shall consist of Developer's recorded plat together
with any written easements agreed to by the parties.
B) The Utility Companies will assign contacts that will be responsible
for the coordinating of planning, engineering and construction work.
Names and telephone numbers of the assigned contacts will be exchanged
between Utility Companies and Developer.
C) The Developer will provide a preliminary plan to the utility contacts.
The utility contacts will be responsible for the layout of compatible
distribution plans, agree to egsement specifications and set up joint
meeting with the Developer with the purpose of finalizing the utility
plan. The preliminary plan shall consist of Developer's plat.
D) The Developer will dedicate or grant adequate easements agreed upon
with the utilities under Paragraph (A) and will grant additional
easements not anticipated at that time but which are reasonably re-
quired to provide adequate and necessary service to the development.
All such additional easements shall require the prior mutual consent
of the parties.
E) The Developer will furnish each utility contact a tentative develop-
ment schedule and keep the Utility Companies advised of change in
the schedule which should include the following:

1. Date grading will be completed and property pins installed.
2. Date subdivision will be ready for utility installations.
3. Date curbs, gutters and sidewalks will be constructed.
4. Date for start of street and parking area paving.
F) The Utility Companies will keep the Developer informed of any changes
in utility schedules that could affect the services for his project.
G) When the final development plans are approved, they should include
the following information:
1. Typical cross-section of streets and easements.
A. Width of street
B. Location for curb, gutter and sidewalk with relation to right-
of-way.
C. Water, serer, telephone, electric and other utility locations
and method of installation (Aerial and Buried).
D. Width and location of easements as agreed in utility plan.
2. A copy of soil reports.
H) Installation of telephone, electric, gas,
, and
will be scheduled and completed within a previously agreed to length
of time, upon receipt of written notice that the final grades in
easement areas have been established and that the easements are free
of all obstructions, prior to the placing of driveways, curbs, paved
parking areas, sprinkling systems, etc. , except by special agreements
with the Utility Companies and written into this agreement as a part

same was occasioned by the act or acts of the Utility Companies or
their agents. Furthermore, if grading or landscaping is changed by
Developer, its employees or sub-contractors sufficiently to endanger
the continued use of utility facilities, the facilities will be re-
located by the Utility Companies to a new agreed upon location and
the Developer agrees to reimburse the Utility Companies for the cost
of relocations.
B) The Utility Company will advise the Developer, at an early date, of
the type of service available. If service is not available, the De-
veloper will be advised in accordance with the Public Utility Com-
missions regulations, of the anticipated date service will be avail-
able, if known.
C) This agreement does not cover telephone facilities normally handled
by the Building Industry Consulting Group.
ADDITIONAL AGREEMENTS:
A) This agreement covers construction specification requirements appli-
cable to the Utility Companies participating, but may not fulfill
financial and other requirements of individual Utility Companies.
Separate agreements may be required to satisfy these requirements.
B) In the event the Developer initiates changes after establishing and
agreeing upon a proposed utility plan with the signatories of this
contract, the Developer shall pay the additional costs including en-
gineering costs incurred by the Utility Gmpanies to accommodate
such changes. In the event a Utility Company initiates changes after

thereof. The Developer will be responsible for the actual locating
and staking of utility easements upon request and prior to the in-
stallation of utilities within the easements.
I) The Utility Companies will locate facilities for anyone excavating in
the easements or streets occupied by the Utilities. Telephone numbers
of Utility Locators will be provided.
J) Compaction will be to 95% of original undisturbed ground.
REPRESENTATIONS:
A) After Utilities (Gas, Electric, and Telephone) have been installed in
accordance with the Utility plan and until the Developer has completed
his work in the areas of the installation, the Developer agrees to
indemify, hold harmless and reimburse the Utility Companies for any
and all loss, injury, or damage including the cost of replacement of
repair to the Utility Companies' property within the development when
such loss, injury or damage is caused by persons or parties other than
the undersigned Utility companies, save and except as to acts of
vandalism, acts of God, acts beyond the control of Developer other
than acts of the contractors, sub-contractors, electricians, plumbers,
or others performing work for the Developer and acts by or under the
direction of third party purchasers within the Development . Similarly,
the Utility Companies agree to indemnify, hold harmless and reimburse
the Developer for any and all loss, injury or damage to the Developer's
property within the development, including the cost of replacement or
repair of its property arising from any damage, injury or cut where

agreeing on such a plan, the Utility Company will reimburse the De-
veloper and/or other Utility Companies for costs incurred in accom-
modating such changes; as well as, relocating service facilities with
all reasonable dispatch. Signatories of this contract may unilateral-
ly or mutually agree in writing to relieve the other of this liability
in specific or general cases.
C) This Agreement shall be binding upon and inure to the benefit of the
signatories, their successors, assigns and legally appointed repre-
sentatives.

Dear Mr. Geisert:
The following drainage report was prepared for Geisert Industrial P. U.D. , a
proposed development near the eastern edge of Greeley. The site is within
the three-mile radius of the city limits and, therefore , within the control
of the Greeley Flanning Commission. The City of Greeley currently has a
policy of requiring all developers to store the difference between the 5-year
undeveloped flood, and the 100-year developed flood. Under this policy, the
5-year (or 20% probability of occurrence in any year) flood becomes the max-
imum release rate for any storm up to a 100-year (or 1% probability of occur-
rence in any year). The requirements of this report are for local drainage
only, and are in addition to the flooding problems from the Cache la Foudre
River.
The decision has been made to require each lot owner to store the excess water
on his property and construct the necessary retention ponds and controlled
outlet structures. The complete design of retention ponds and outlet struc-
tures is impossible without knowing the type of facility that will be con-
structed on each lot and area of paved and grass areas. A maximum release
,rate for the subdivision, however, can be computed for the 5-year undeveloped
storm and this release rate can be prorated to each lot on an area basis.
Storage was then computed on the allowable release rate from an acre and
based on a totally paved or totally grassed area. A "C" factor of 0.90 was
used for roofs and paved areas and a "C" factor of 0.20 was used for grass
areas. From Exhibit No. 1 it is apparent that the maximum storage is obtained
by dividing the total storage required for one acre by the square feet in one
acre. For paved areas and roofs , the storage rate is 0.154 cubic feet of
storage per square foot of paved area. For grassed areas, the rate is 0.016
cubic feet per square foot of grass area. The total storage requirement can
be obtained by multiplying the respective rates by the areas of paved and
grassed areas and adding the two volumes to obtain the required capacity of
the retention ponds.
This method has built in approximations that prohibit precise computation of
runoff from each lot. The time of concentration for the undeveloped site was
assumed for a 10.14 acre basin that drains most of the tract to the east. The

concentration time for this area was calculated to be 33 minutes. The time
of concentration of 11 minutes for the developed areas was computed from the
length of an average lot with paving. These assumptions are conservative,
but should not present a problem for any lot owner to provide the required
storage.
Recommendations
It is recommended that a 12-inch storm sewer be constructed from the draw at
the eastern edge of the property, between Lots 5 and 6 to the inlet in the
east end of the cul-de-sac on East 5th Street Road. This inlet shall have a
weir in the inlet to control the release rate from the street to 0.26 cubic
feet per second. The 12-inch storm sewer will then travel west along East
5th Street Road with tees and laterals to the low corner of each lot. The
storm sewer will provide a lower drainage outlet and a convenient place to
mount an outlet control device for each lot owner.
The following table should be included with the subdivision covenants, and
include the maximum release rate from each lot and the storage requirement
rates.

WATER MAIN EXTENSION AGREEMENT
NO. 19
This Agreement, made and entered into this _ day of
, 1976, by and between the City of Greeley,
Colorado, a municipal corporation, hereinafter referred to as
"City" and Richard Geisert, hereinafter referred to as "Geisert",
WHEREAS, Geisert is presently the owner of certain real
property located in Weld County, Colorado, the description of
which is attached hereto as Exhibit "A" which is incorporated
herein by reference and made a part of this Agreement, and
WHEREAS, Geisert has obtained approval of the authorities
of Weld County, Colorado, for a zoning change of said real pro-
perty subject to the obtaining of water service from the City,
and
WHEREAS, the City does not presently have water service
available to the property owned by Geisert;
NOW, THEREFORE, in consideration of the mutual promises,
covenants, and conditions as hereinafter set forth, the parties
hereby agree as follows:
1, Geisert shall cause to be constructed at his
own expense an eight (8) inch water line from
the existing water line shown on Exhibit "A"
on Eighth Street to the northern boundry of
the property to be served as designated on
Exhibit "A",
2. The line shall be constructed from a point
designated by the City and shall be built
in conformity with any and all City stand-
ards pertaining thereto.
3. Geisert shall keep an accurate record of
all construction costs incurred with the
building of the aforesaid eight (8) inch
line including, but not necessarily limited
to materials, labor, engineering and acquisi-
tion of right-of-way. All such records shall
promptly be remitted to the City for its
approval and copying in order that the
Director of Water and Sewer may determine
a cost per foot of construction based on the
cost of the construction of the entire exten-
sion. In determining the cost per foot of
construction, the Director of Water and Sewer
will divide the total construction costs as
described above by the front footage total of
property that will, in the future, receive
water service from the constructed line.
4. The City shall keep an accurate record of all
water users connecting onto the eight (8) inch
line extension constructed by Geisert as said
connections are made on or before December 31,
1982. As the taps are made by these subsequent
users, the City shall collect from each user
the cost per foot of line, as determined by the
Director of Water and Sewer, for each front foot
of property owned or otherwise utilized by the
connecting user which abuts on the Geisert line
extension. Any new line extension from the
Geisert extension which is built in accordance
with.the City of Greeley's Planning Commission
Regulations, will not be subject to the collec-
tion fee described in this paragraph.
5. Within sixty (60) days after the conclusion of
each calendar year, the City shall furnish to
Geisert an itemization of all connecting fees
received by the City from the above described
connecting users together with a remission of
the fees to Geisert, less fifteen dollars ($15.00)
per collection transaction . The fifteen dollar
($15.00) collection fee will become part of the
revenue of the Water Department. This procedure

shall be followed until the total construction
costs of the extension line, not abutting the
original Geisert property, is refunded to him
in full or until December 31, 1982, whichever
occurs first. In no event shall the City be
held accountable for not collecting the above
fee as long as such failure to collect is inno-
cent. Fees collected as a result of this agree-
ment shall be collected in addition to all other
established tap fees and service charges normally
collected by the City.
6. Geisert agrees to neither assign his rights under
this agreement nor delegate his duties to any
other party without the express prior written
approval of the City.
7. This agreement shall be binding upon the City
only upon the approval thereof by the Mayor
and City Council of the City of Greeley, Colorado
and upon its execution by the Mayor and attesta-
tion by the City Clerk.
Executed in duplicate by the parties hereto on the day
and year first above written.

FLOOD PLAIN INFORMATION
IN
PROPOSED EAST GREELEY INDUSTRIAL PARK
The proposed Industrial Park under study lies just east of U. S. Highway 85
Bypass and 5th Street near Greeley, Colorado. The site does not lie within
Greeley's City Limits, therefore the governing body is Weld County. However,
Weld County has a policy whereby it seeks a city's comments on any proposed
development within three miles of the city's limits.
The proposed site lies in the 100-year flood plain as delineated in the 1974
study prepared by the Omaha District of the Corps of Engineers , entitled
"Flood Plain Information, Cache la Poudre River, Colorado, Volume II, Greeley,
Weld County." Since the site lies in the flood plain, it is subjected to Weld
County regulations. The following exerpts the specific regulations from page
50 of the County's 1972 Subdivision Regulations:
1. Construction of buildings shall not be permitted in a designated floodway
with a return frequency more often than a one-hundred (100) year flood,
based on a six hour continuous storm.
2. Any use of land is prohibited where flooding would create a public health
problem. This includes shallow wells, uncased deep wells, sanitary dis-
posal systems, water treatment plants, and also sewage disposal systems
not completely protected from inundation.
3. Trailer parks, mobile home and similar uses shall not be permitted in
any designated floodway.
4. Any contemplated flood plain encroachment or channeling shall be
thoroughly analyzed and its effect on stream flow determined before it
is undertaken. Any construction, dumping, and filling operations in a
designated floodway constitutes an encroachment.
5. Floodlands. No lot one (1) acre or less in area shall include floodlands.
All lots more than one (1) acre shall contain not less than forty thousand
(40,000) square feet of land which is at an elevation of the one hundred
(100) year recurrence interval flood or, when such data is not available,
five (5) feet above the elevation of the maximum flood of record.
Item No. 4 above is the critical point to a developer. The site is located
a relatively large distance from the Cache la Poudre River. It might lire in
what the Corps recognizes as a floodway fringe area (see Exhibit No. 1).
According to this concept, the fringe area of the 100-year flood plain can
be filled in such that the designated floodway water surface elevation is not
surcharged more than one foot. Any such encroachment must first be approved
by the governing body and/or the Corps prior to construction.

Weld County Planner, Tom Hohn, has requested that a map of the proposed site
and its location in the flood plain (see Exhibit No. 2) and a topographic map
of the site along with the water surface elevation of the 100-year flood (see
Exhibit No. 3) be submitted to the County. Along with these exhibits , the
plan(s) of how the developer intends to remove the site from the flood plain
should also be submitted. This entire packet will be analyzed by the County
and the Corps and a decision will be made on allowing development.
Possible methods of getting the site out of the flood plain include:
1. Filling the entire site to minimum elevation of one foot above the 100-year
flood elevation. Under this assumption, it will be important to maintain
positive drainage of the tributary areas.
2. Filling building locations only to the same elevations stated above. The
problem with this is that storage areas and septic tanks will still be
subject to flooding.
3. Construction of a berm around the site. On site drainage would be stored
in a holding pond and discharged at a reduced rate. At times of major
flooding, the pond outlet will automatically close to prevent a backflow
into the site. Due to the flatness of the land in this area, water may
have to be pumped from the pond.
The above, along with more specific information concerning the site planning
(building locations, types , etc. ) , should be submitted to the Weld County
Planning Department so that a decision can be made on the feasibility of
building on the site. It is important to understand that the above information
is concerned only with the flooding hazard; there may be other constraints con-
cerning zoning, water and sewer service, etc. that need to be investigated also.

As indicated by our boring logs no impervious layers of clay were encountered;
however, ground water is relatively high. Weld County Health Department requires
absorption beds to be at least four feet above the highest anticipated ground
water. Consequently, special provisions should be made in the construction of
absorption beds, such as sump puris in septic tanks discharging into absorption
beds that are constructed on a raised area that will assure no encroachment by
ground water.
In addition, septic systems for areas that display percolation rates of less
than five minutes per inch and more than 30 minutes per inch will have to be
designed by a registered engineer competent in this phase of sewerage disposal.
The percolation rate tests were performed in accordance with guidelines estab-
lished in the Public Health Service Publication No. 526 of the U. S. Department
of Health, Education, and Welfare.

engineer, H,H.P.Q. , has submitted a text including proposed methods for
removing floodplain designation of said property.
Attached is a portion of the Weld County Subdivision Regulations regard-
ing floodplains. This office would desire any comments regarding appli-
cants request and its compliance with Weld County's regulations. The re-
quest would appear to be a reasonable one with respect to the fact that the
area lies in a fringe (by elevation) area. According to the applicant's
engineer, the location would receive back up flood water not the direct

In response to your May 28, 1976, letter, requesting a
flood hazard review of a proposed Industrial Planned Unit Develop-
ment, Project No. 76-1-Eng-0161, I offer the following comments
for your consideration.
As you are aware, the Corps of Engineers, Omaha, Nebraska,
made a Flood Hazard Study of the Cache la Poudre River Basin. As
a result of this analysis, the 100-year flood hazard information
has been determined; and, by resolution, the Colorado Water Conser-
vation Board designated the 100-year floodplain for the Cache la
Poudre River.
Weld County ' s regulation, Section D, Flood Plains, Par. 4,
requires a thorough analysis of any flood plain encroachment. From
the information that has been provided by the developer ' s engineer,
it appears that this requirement has not been fulfilled because
the proposed development is located in the 100-year floodplain.
However, the engineer did offer three conceptual plans . Plan 2,
which is basically filling only the building sites, has the most
merit because this would provide for some valley flood storage,
which is good in a wide, unchanneled floodplain. Before approving
or permitting any particular encroachment planned, the effects to
neighboring properties should be determined. This will provide
information on any increased damage liabilities during times of
flood. �.

This responds to your 28 May 1976 request for technical assistance re-
garding a proposed 15-acre industrial development located east of U.S.
Highway 85 and about 1,000 feet north of Ogilvy Ditch.
The site is in a backwater zone and the loss of the area from the
active flood plain would not directly raise flood stages. The only loss
would be from the loss of a flood storage area which is not greatly sig-
nificant since it is near the mouth of the river. As table 3 of the
Flood Plain Information report indicates, the flood peaks attenuate in
a downstream direction from a tributary until another tributary is en-
countered which again increases the flood peak. The reason for the
attenuation is that the flows on the flood plain are stored or move at
a slower rate than the flows in the channel and the desynchronization
cause the flood peaks to lessen. If all of the valley storage were
lost, then there would be essentially no attenuation between tributaries
and the flood peaks would become significantly larger. When developing
in the flood plain, it is, therefore, theoretically desirable to fill
the flood plain only under the buildings or flood-proof the buildings
so the remaining flood plain area stays available for valley storage.
A close study of the detailed mapping shows that the flooding in the site
area is very shallow and portions of the site are actually above the
flood elevations. There is a culvert through Highway 85 between reference
points G and H. During a 100-year flood, flow would pass through the
highway from west to east. Provisions for carrying this flow and any
localized drainage through the site area would apparently be required
by your Subdivision Regulations, section 8-11.
In summary, since site development is in a backwater area, the proposed
development would not raise flood stages in the adjacent area providing waft

Bob Britzman abstained from discussion and action on this item since he had provided

Mr. Sasaki presented the proposal. The property is unannexable. Staff concerns were
regarding the property's being flooded and with water service to the property.
The property has been filled and the County should require engineering information as to
the floodplain.
The City could extend a line to the property or the developer could contact North Weld
Water District. There was a question whether North Weld could meet the fire standards. i..
Other properties in the area are serviced by North Weld and one owner has a well.
Darryl Alleman, Director of the Water and Sewer Department, stated that the City has
adequate pressure to service the area. The City cannot provide sewer service to the
property. The request for water taps would have to be referred to the Water Board and
the City Council.
Mr. Sears commented that his prospective clients interested in the property propose
warehouse-type uses, light industrial with not much water use. He reported that the
State was not concerned about gravel deposits in the property due to the size of the
lot and its closeness to a major highway.
Clifford Clift made a recommendation of approval to the County of the zone change,
subject to water, sewer, and fire standards being met and subject to Water Board and
City Council approval of the water tap. All commissioners present, Bob Britzman
abstaining, were in favor of the recommendation.
VII. DISCUSSION OF HALF STREET RESOLUTION
Mr. Sasaki reviewed past action by the Planning Commission on this item and read a draft
of a resolution changing the subdivision regulations to the Planning Commission.
Mr. Charles felt all members of the Commission should be preset.. and asked that a copy
of the resolution be sent to all members for their review prior to the next meeting.
VIII. STAFF REPORT
Mr. Sasaki outlined a proposed study regarding acquisition of greenbelt- and open space
along the Poudre River. The study would include long-range considerations and would
consider private versus public ownership of the land. Mr. Sasaki reported that the
study would probably involve a year's time and hoped to use an intern program for part
of the manpower needed for the study. The outline will be sent to Planning Commission
members for their review.
The staff has been considering the possibility of requiring less right-of-way widths
in future local streets. A reduction from 40 feet to 34 feet would reduce speed of
traffic. Staff felt it would promote more efficient use of the land.
Mr. Bud Smead, City Engineer, commented that it would decrease the cost of street
maintenance. Right-of-ways 34 feet wide would he wide compared to many cities in
Colorado. Staff feels this size would he adequate to cirry traffic well and yet reduce
speed. More lots could be produced from proposed subdivisions. If there were two-way
parking, problems might arise for police and fire vehicle access.

Mr. Gary Sears visited our office last week and asked that the Division
of Highways' comments pertaining to the proposed Geisert Industrial P.U.D.
be sent to your office.
The Colorado Division of Highways has reviewed the above proposal, as
submitted for Utility Approval, and has the following comments.
The exact location of the farmer's access road through Lot 10, Outlet "B",
. and Lot 8 is not shown. Mr. Sears stated the existing access road is to be
moved to the area along the south property line. The Division will require
a Driveway Permit be issued for the relocated approach and that the existing
one be abandoned.
The Division will also require Driveway Permits for the proposed entrance
to the P.U.D. and driveways to Lots 1 and 10. These permits are available
through Mr. D. N. Fraser, District Maintenance Superintendent, whose office
is located at 1420 Second Street, Greeley. He may also be reached by mail
addressed to P. 0. Box 850, Greeley, Colorado 80631.
The Division would request that access to Lots 2 and 9 be from East Fifth
Street Road and that the other lots adjacent to the frontage road be limited
to one access since the lots are large enough to provide internal circulation
of vehicles.
Surface water runoff in this area is of particular concern to the Division.
We would request that we review the drainage plan for the development once it
has been prepared. Historically, the drainage in this area is to the east -
away from our right of way. The Division would request that no more surface
water enter our right of way than it has in the past.

The County may want to give consideration to extending Fifth Street Road
to the east rather than ending in a cul-de-sac. Since there are few east-west
roads in this area, extending Fifth Street Road will provide for a better
circulation of traffic as the area develops to the east.

Development Standards
1 . Permitted Uses:
All those uses as listed in the Weld County Zoning Regulations,
Sections 3.9 and 3.10 in effect at the date of approval of this P.U.D.
by the Board of County Commissioners. All uses must be consistent
with the City of Greeley Light Industrial Zoning Codes and Require-
ments. The use shall be reviewed for compliance at the time of the
final site plan review.
2. Signs:
Signs must comply with applicable requirements of Weld County Zoning
Resolution. Applicable permits shall be obtained.
3. Access:
Access shall be restricted onto the frontage road as designated on the
plat as follows:
(a) One access for lot 1 onto the frontage road;
(b) One new access for lot 10 in addition to the existing access
through lot 10; and
(c) One access for East 5th Street Road as shown hereon.
Driveway permits from the State Department of Highways shall be obtained
for each of the above accesses onto the frontage road.
Lots 2 through 9 shall be limited to access on East 5th Street Road;
access for these lots shall not be permitted from the frontage road.

More than one access per lot for lots 2 through 9 onto East 5th
Street Road may be allowed subject to approval in the final site plan
review.
4. Parking:
All parking will be on site, furnished by the individual lot owners.
Such parking facilities must comply with the Weld County Zoning Reso-
lution requirements and applicable requirements of the City of Greeley
which may be in force at the time of construction upon the site.
5. Interim Land Use
Until such time as a lot is sold said lot shall not be used for other
than its present use. The owner shall be responsible for maintaining
the premises so as to eliminate weed growth in excess of 12 inches
in height.
6. Landscaping:
(a) No more than 85% of the area of any lot shall be covered by
buildings, asphalt, or gravel .
(b) A minimum of 15% of each lot shall be maintained as landscaped
area.
(c) A minimum of 10' adjacent to the public right of way shall be
landscaped.

8. Sewage Disposal :
Individual on-lot disposal systems shall be allowed on each lot
subject to County and State Health Regulations. The proposed dis-
posal systems shall be reviewed for compliance and approval at the
time of final site plan review. Upon availability of City of Greeley
sewer service to the subject property, known as Geisert Industrial
P.U.D. , the owner or owners of the lots shall be required to connect
onto the City sewer system and be responsible for extending the sewer
lines to the outer boundaries of the property known as Geisert In-
dustrial P.U.D. upon request by the City of Greeley. All construction
of sewer lines shall meet the specifications and requirements of the
City of Greeley. If City of Greeley sewer service is available adjacent
to the Geisert Industrial P.U.D. property at this time when a lot
owner submits a final site plan for review, then it shall be required
that the lot owner connect onto the City sewer system at that time
and an individual on-lot sewage disposal system shall not be allowed.
9. Lot Standards:
(a) 30 foot front setback
(b) 20 foot rear setback
(c) 60 foot maximum height

11 . Building Standards:
All structures shall be constructed at elevations known to be above
the 100 year flood elevation; said elevations to be noted on the
Final Plat prior to retardations. Construction details to be re-
viewed for compliance at the time of final site plan review.
12. Site Plan Review:
Prior to the issuance of any building permits for any individual lot
of the Geisert Industrial P.U.D. , a final site plan shall be reviewed
by the Weld County Planning Commission for a recommendation and the
Board of County Commissioners for their approval . Any change of
use on a lot which has been approved in a final site plan review
shall be subject to review again for the new use. The final site
plan review shall include the following:
(a) Identification in detail of the proposed use;
(b) The number, type, and frequency of traffic of traffic generated;
(c) The number of employees;
(d) A drainage study for the lot;
(e) Indication of the number and location of the proposed accesses and
the internal traffic flow pattern;
(f) Information on measures to be utilized to prevent construction below
the 100 year floodplain level ;
(g) Indication of landscaping proposed;
(h) Information on what provisions shall be made for fire protection;
(i ) Indication of the water requirements and the proposed water system;

(j ) Indication of the sewage requirements and details on the
proposed system;
(k) Identification of the number of parking spaces to be provided;
(1 ) Submittal of front, side, and back elevations for the proposed
structure.
This required information shall be submitted in a combination of written and
map form.
13. All utilities shall be installed underground within the subject property.

conducting the study and developing the master plan for extraction.
(3) (a) A county planning commission shall certify its master plan for extraction to
the board of county commissioners or the governing body of the city or town where
the county planning commission is acting in lieu of a city or town planning
commission.. A planning commission in any city and county, city, or town shall
certify its master plan for extraction to the governing body of such city and county,
city,or town.
(b) After receiving the certification of such master plan and before adoption of such •

plan, the board of county commissioners or governing body of a city and county, '
city, or town shall hold a public hearing thereon, and at least thirty days notice of
the time and place of such hearing shall be given by one publication in a newspaper .
of general circulation in the county,city and county,city,or town.Such notice shall
state the place at which the text and maps so certified may be examined.
(4) The board of county commissioners or governing body of a city and county.

GEOLOGIC HAZARD INVESTIGATION
SCOPE
This report will present the results of our geologic hazard investigation of
the Geisert's Industrial P.U.D. which is located in Sections 4 and 5 of
Township 5 North, Range 65 West of the 6th Principal Meridian in Weld County,
Colorado. The purpose of this investigation was to find which, if any, of
the geological hazards identified in H. B. 1041, or in guidelines of the
Colorado Geological Survey, are present at this site, and to determine their
effects on the proposed development as an industrial park. Consideration is
also given to conditions which can be expected to change with the change in
land use.
LOCATION
The approximate 15 acre site is located at the east edge of Greeley, just
east of the U. S. 85 ByPass. This location is less than one mile from down-
town Greeley. The specific location is shown on the accompanying map.

TOPOGRAPHY
The site is nearly flat and of an elevation of approximately 4,635 feet. The
general slope is to the southeast at 0.5 to 1.5 percent. The total relief is
approximately four feet.
GEOLOGY
The surface geology of the area consists almost entirely of river sands and
gravels which occupy the Cache La Poudre River valley. This alluvial material
contains some silt and other organic materials as noted in the logs of the test
holes. Some fill has been placed on the site. During drilling, the gravel was
never completely penetrated. The deepest hole was 28 feet. The logs of these
holes and their location will be found in the soils report which comprises a
part of this report.
The bedrock was not encountered and no exposures were observed in the general
vicinity. At this site the bedrock is inferred to be near the contact between
the Pierre Shale and Fox Hills Sandstone as shown on the accompanying map. The
exact location of the contact was not identified and could vary from that shown.
GEOLOGIC HAZARDS
— Geologic hazards are defined by H. B. 1041 as "a geologic phenomenon which is so
adverse to past, current or foreseeable construction or land use as to consti-
tute a significant hazard to public health and safety or to property". Several
of the specific hazards usually considered, such as rock fall, slippage or creep-
- age, are not applicable to this site because of the gentle topography.
A. Seismic Activity - All of Colorado is in Seismic Risk Zone 1 (minor damage).
There is no history or evidence of seismic activity in this vicinity.
B. Ground Subsidence - Ground surface collapse can occur in soils as a result
of excessive wetting of dry soils with a high void ratio. Since there are
not any clay soils, but only granular sandy material, this is not a problem.
There are no subsurface excavations such as mine workings known in this area.
C. Water Table - The depth to the water table as observed during drilling is
noted on the logs. In general, it was approximately five feet below the
existing surface. Due to the porous material, it is expected that the water
table will fluctuate with the seasonal level of the Cache La Poudre River.
Since the holes were drilled at the end of May, the level found is likely near
the normal seasonal upper limit. The porous nature of the material will result
in significant problems associated with excavation below the water table eleva-
tions for utility lines or building foundations. This is discussed more fully
in the soils report. The development itself is not foreseen to change the
elevation of the water table.
D. Expansive Soil - The soils found on this site are not expansive. No problem
from this condition is expected.
E. Flood Plain - The site is shown to be in an area designated as flood prone by
the U. S. Geological Survey. The exact extent and depth of possible flooding
has not been determined in this investigation.
F. Gravel Resource - The site is located within an area identified as having poten-
tial'as a future source of gravel for use as cement aggregate and road material.
It is understood some of this material has been recovered from the site and
replaced with other material. This condition does not constitute a hazard.
CONCLUSIONS
A. The geology of the site is a relatively deep alluvial deposit of sand and gravel.
Bedrock was not encountered in drilling.
B. The geologic hazards at this location include the shallow water table and loca-
tion in a flood prone area.
C. Dewatering of excavations can permit construction of utilities and foundations
below the water table. Filling all or part of the site can reduce the hazard
from flooding.
D. If the recommendations are followed, the site can be made suitable for use as
an industrial park.
