WHEREAS, a public hearing was held on December 6, 1976 in the Chambers of the Board of County Commissioners , Weld County, Colorado, for the purpose of hearing the petition of Henry Schaefer, 2514 20th Street Road, Greeley, Colorado 80631, Greeley, Colorado, requesting a Special Use Permit for a cattle feedlot located on a parcel of land in the East Half of Section 7, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast Corner (NE Cor) of said Section 7, and considering the North Line of said Section 7, as bearing North 90°00 ' 00" East, with all other bearings contained herein relative thereto; Thence South 90°00 ' 00" West, along said North line, 1509 . 87 feet to the True Point of Beginning; Thence South 19°48 ' 38" East, 557. 98 feet; Thence South 13°40 ' 31" East, 417. 09 feet; Thence South 81°29 ' 01" West, 38 . 98 feet; Thence North 43°40 ' 14" West 301. 66 feet; Thence North 40°10 ' 27" West, 293.14 feet; Thence North 29°22 ' 56" West, 177. 09 feet; Thence North 15°27 ' 21" West, 352 . 24 feet to a point on the North Line of said Section 7; Thence North 90°00 ' 00" East, along said North Line, 328. 99 feet to the True Point of Beginning. Mr. Lind stated that the berms and ponds could be developed as the lots were sold. `this work would be done by the developer so that they would all be done by one engineer. The developer would do the grading them- selves. RESOLUTION: Be it therefore resolved to recommend to the Board of County Comm. approval of this preliminary plan with the following stipulations: 1 . The applicant must sign and notarize the preliminary plat application. 2. As requested by the City of Brighton, the plans must be amended to show the water line in Great Western Road as a 10" line and not a 8" line as shown. 3. Another valve must be added at the junction of N. 5th Ave. and Ida Road. 4. As requested by the County Engineer, the plans must be amended to pro- vide a street plan and profile for Great Western Road and corrections must be made in the dollar amounts submitted for the street base, street paving, and culverts for Great Western Road in the subdivision improvements agreement. 5. NEQ of Sec. 7, T6N, R66W SUBJECT: Cattle Feedlot APPEARANCE: Henry Schaefer DISCUSSION: Mr. Schaefer explained that he would like to have approximately 700 head of cattle on this feedlot. Tom Honn read the staff comments as follows: The Weld County Planning Commission staff recommends that this request be approved for the following reasons: (1 ) The proposed cattle feedlot agrees with the Weld County Comprehensive Plan. Said Plan states: "Expansion and development of agri-business and agriculturally oriented industry will be encouraged, provided the enterprises do not adversely affect the total economy or environment." It is felt that with the design of this operation, there is little chance of adverse impact on the surrounding en- vironment. (2) It is the opinion of the Planning Commission staff that this proposed operation is in compliance with the provisions of Section 3.3(E)(2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with future development in the PC 1956 Planning Commission October 19, 1976 area, and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county for the following reasons: (a) The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominatly agricultural . (2) The applicant shall obtain approval from the County Engineering Department for the method and materials to be used in crossing the ditch adjacent to County Road 72. DEVELOPMENT STANDARDS: (1 ) The cattle feedlot permitted by this SUP on the hereon described parcel shall be limited to the facilities shown which are desgned to handle approximately 750 cattle. (2) The Special Use Permit area shall be maintained in such a manner so as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. (3) Access to the Specia Use Permit area shall be limited to one access point. Said access is des;gnated on the plans as the 20 foot proposed access road which runs roughly down the center of the SUP area. At no time can the county right-of-way be used for a driveway in and around said feedlot. Design of the 20' access shall be approved by the County Engineer prior to installation. Such design shall include a description of the method and materials to be utilized in crossing the ditch adjacent to County Road 72. (4) All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health Regulations. (5) The Special Use Permit shall be limited to the plans submitted and governed by the Development Standards stated above and all applicable Weld County regulations. Any changes to the plans and/or Development Standards shall require approval of another Special Use Permit before such changes shall be allowed. Gary read the letter from the Engineer's Office stating the reasons for the two accesses not being acceptable for ingress and egress. The existing road could be used for farm access, just not for feedlot. Mr. Schaefer stated that he had put the tile in the ditch that was made reference to. He explained that he put the tile in and covered in up and PC 1957 October 19, 1976 Planning Commission it is good for the road and good for his property. Mr. Schaefer explained that the ditch is on his property, he runs his own water in it, and he could see no reason why he couldn't do it. Gary Fortner explained that when Gil Olson, County Encineer went out to inspect the problem, he saw part of the county right-of-way being used as more or less a particular route from the access on one side to the access on the other side. Mr. Heitman explained that if you took the dedication of that road, the width of the road that is dedicated, that R1r. Schaefer was probably driving on part of the county dedication. Mr. Schaefer stated that that ditch is covered up and is on his property and it is his ditch. RESOLUTION: Be it therefore resolved to recommend to the County Commissioner approval subject to the two conditions, if they exist, and the development standards. Motion by Mr. Bill Elliott. CASE NUMBER: SUP 319:76:24 LOCATION: 4 miles E of Ft. Lupton LEGAL DESCRIPTION: NW AWE of Section 12, T1N, R66W SUBJECT: Oil Field Fluids Recycling and Disposal Site APPEARANCE: J. Lee Sears, Ron Succo, Mr. Kyle, and Mr. Harvey DISCUSSION: Mr. Sears presented his request by reading the Statement of Intent which was presented to the Planning Commission. I1r. Sears stated that there was a definate problem in the disposal and storage of oil drilling fluids. He explained that this would be a service that is badly needed in the county. Tom Honn read the recommendations of the staff as follows: The Weld County Planning Commission staff recommends that this request be approved for the following reasons: (1 ) It is the opinion of the Planning Commission staff that this proposed facility is in compliance with the provisions of Section 3.3(E) (2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with future develop- ment in the area, and will not adversely affect the health, safety, and wel- fare of the inhabitants of the area and the County for the following reasons: (a) Adverse impacts on the surrounding environment appears to be minimal since the pits shown on the plans shall be sealed with bentonite to prevent seepage and possible contamination of ground water resources in the area. (b) The Weld County Health Department has recommend approval of this request in- dicating the proposal is in compliance with all applicable Weld County and State Health standards and regulations, and that ground water resources will not be adversely affected if the plans are carried out as specified. (c) Pits 1 and 3 as shown shall be screened with a 1 " wire mesh to prevent the landing of water fowl and their contamination by hydrocarbons as requested by the State Division of Wildlife and the Colorado Oil and Gas Conservation Commission. (d) The Ft. Lupton Fire District has indicated they have no objections to the proposed operation. (e) The Weld County Engineering Rapartment has indicated that there are no engineering problems with the application as proposed. The Special Use Permit area shall be maintained in such a manner so as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. 3. There shall be two accesses allowed within the Special Use Permit area The existing 15' farm access which is located at the northwest corner of the Special Use Permit area shall be permitted continued use as a farm access, but shall not be used as ingress and egress to the com- mercial feedlot. The proposed 20' access road shall be utilized for ingress and egress to the commerical feedlot. At no time can the county right-of-way be used for a driveway in and around said feedlot. 4. All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health regulations. 5. The Special Use Permit shall be limited to the plans submitted and governed by the Development Standards stated above and all applicable Weld County regulations. The existing farm access and the proposed farm access , as shown on plat , are not acceptable for ingress and egress to a feed lot due to the terrain being such that the sight distance is practically nil . The access road to the feed lot , as shown on plat , can be approved if a proper structure or a large pipe be put in the existing irrigation ditch. Under no circumstances shall the ditch in the County right of way be piped and covered over without an engineering study being made to be sure grade is sufficient and to determine the size of conduit to be used. At no time can the County right of way be used for a driveway in and around said feed lot .
