RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR CORPORATION FOR
NATIONAL SERVICE AMERICORPS VISTA AND AUTHORIZE CHAIR TO SIGN -
COLORADO YOUTH CORPS ASSOCIATION (CYCA) AND WELD COUNTY YOUTH
CONSERVATION CORPS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
Corporation for National Service AmeriCorps Vista among the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Human Services, Employment Services of Weld County, the Colorado Youth Corps Association
(CYCA), and the Weld County Youth Conservation Corps, commencing July 27, 2009, and ending
July 26, 2010, with further terms and conditions being as stated in said memorandum , and
WHEREAS, after review, the Board deems it advisable to approve said memorandum , a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for Corporation for National Service
AmeriCorps Vista among the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Human Services,
Employment Services of Weld County, the Colorado Youth Corps Association (CYCA), and the
Weld County Youth Conservation Corps be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said memorandum .

Enclosed for Board approval are a variety of Workforce Investment Act Expenditure Authorizations
(EA). The ARRA EA's were reviewed by the Board at the March 23, 2009, Work Session and the
DVOP Operating and WIA 10% Credentialing EA's were reviewed at the April 27, 2009, Work
Session. The Expenditure Authorizations include the Budget Information Summaries for the programs
and request the following funds:
PY 08 ARRA WIA Adult - $213,221.00; PY 08 ARRA WIA Dislocated Worker - $442,413.00; PY 08
ARRA WIA Youth - $634,959.00; PY 08 ARRA Wagner Peyser - $121,037.00; PY 08 ARRA Wagner
Peyser Re-employment Services (RES) - $210,729.00; FY 09 WIA 10% Credentialing/Infrastructure -
$11,620.00; FY 09 DVOP Operating EA Modification adding - $2,582.00.
The major Provision of the EA's are as follows:
Adult- Targets low income for services utilizing the ARRA funds although services will not be
limited to only that that group of individuals. Unemployed adults who need and can benefit
from additional assistance in obtaining a job will also be targeted and served. Targets for
services will be to provide occupational skills training (typically 1 year certificates or less
although some 2 year programs will be considered) as well as increased placements in work
experience activities, and/or on-the-job training placements. Green jobs, positions within
renewable energy fields, or jobs identified as growth occupations for Weld County will be
targeted for occupational skills training as appropriate to the participants' employment goals.
Dislocated Workers — Employment Services will serve those individuals who meet the
eligibility requirements for the Dislocated Worker programs as outlined in the Workforce
Investment Act. I Targets for services will be to provide occupational skills training (typically
1 year certificates or less although some 2 year programs will be considered) as well as
increased placements in work experience activities, and/or on-the-job training placements.
Green jobs, positions within renewable energy fields, or jobs identified as growth occupations
for Weld County will be targeted for occupational skills training as appropriate to the
participants' employment goals.
Youth — 75% of the ARRA funds will be targeted towards summer employment work
experiences for eligible youth. Remaining funds will be used for services to eligible out -of -
school youth and eligible in -school youth. The primary focus of services will be towards the
out of school youth population, particularly those who have dropped out of school.
Wagner Peyser and Wagner Peyser RES - Provides basic labor exchange services to
employers and job seekers with priority of services given to veterans and Unemployment
Insurance Recipients. Based on an analysis of the most recent Greeley MSA labor market
data, Weld County will continue to focus its employer relations efforts in the Energy,
Manufacturing, Healthcare, and Transportation sectors.

Credentialingllnfrastructure - Used to purchase a one year site license for Key Train and
the remaining amount to purchase equal numbers of WorkKeys assessments in Math,
Reading for Information, and Locating Information to support the Colorado CareerReady
Certificate (CRC). The Key Train site license and the WorkKeys assessments will be used to
provide program participants and workforce customers the opportunity to acquire Colorado
CareerReady Certificates which they can provide to potential employers.
DVOP Operating Modification - This modification requests adding funds in accordance with
the Colorado Department of Labor and Employment, Notice of Fund Availability #08-13 dated
March 27, 2009. The additional funds will be used to support the administrative and
operational costs associated with the Disabled Veterans Outreach Program (DVOP) staff
person.
The goal of each of the programs is to provide participants with the appropriate mix of services
they require to assist them in obtaining and retaining employment.
Additionally included for Board approval and signature are two Memorandum of Understanding
(MOU) both of which were presented at the March 2, 2009 Work Session. The MOU's are as
follows:
Memorandum of Understanding (MOU) between the Colorado Department of Labor and
Employment and Employment Services of Weld County - The purpose of this MOU is to
establish an agreement between the above mentioned entities concerning respective roles
and responsibilities for implementation of the provisions of Section 121(c)(2) of Title] of the
Workforce Investment Act of 1998. Additionally, this agreement coordinates resources to
prevent duplication and ensure the effective and efficient delivery of workforce development
services in Weld County. This agreement also establishes joint processes and procedures to
enable partners to integrate services resulting in a seamless and comprehensive array of
workforce development services to Weld County residents.
Memorandum of Understanding between the Colorado Youth Corps Association and
Employment Services of Weld County and the Weld County Youth Conservation Corps
(WCYCC) regarding the placement of a Vista Volunteer (Financial) - This MOU
establishes an agreement between the above mentioned entities conceming the placement of
a Vista Volunteer to perform the duties of fundraising and marketing of the WCYCC. The
position will enhance the sustainability of the WCYCC by developing additional fee for service
projects and recruiting viable AmeriCorps members to serve with the WCYCC. The duties of
the volunteer will include enhancing marketing materials to recruit both potential members
and prospective project sponsors to generate addition fee for service work projects. Financial
costs under this agreement include a maximum of $2,700 of non-federal cash match for
member support costs and any mileage reimbursement costs associated with required travel
in the performance of the duties under the agreement.

MEMORANDUM OF UNDERSTANDING
between

This document defines the responsibilities of the Sponsor and the Host Site with respect to the
assignment of up to 1 AmeriCorps*VISTA members to perform services to strengthen and supplement
efforts to eliminate poverty and poverty -related human, social and environmental problems as
specified in the AmeriCorps*VISTA Project Application and project plans. The obligations of the
parties hereto are subject to the terms and conditions of the Memorandum of Agreement between
the Corporation for National Service and the Sponsor, dated November 15, 2007, which is
incorporated herein by reference, and federal laws and regulations and Corporation policies applicable
to the project, or which may become applicable to it subsequent to the execution of this Agreement.
1. The Sponsor will:
a. Comply with the provisions of the Memorandum of Agreement between the Corporation and
the Colorado Youth Corps Association.
b. Assist Host Sites in developing Position Descriptions and Volunteer Assignment Descriptions
(VAD) for each assignment.
c. Assist in the provision of pre -service, and in-service training offered to VISTA members by the
Corporation. In addition the Sponsor will host an annual training for VISTA members with
topics including: statewide goals for the project, peer exchange and sharing of best practices,
poverty in Colorado, environmental impacts on the poor and preparing the poor for
emergencies and disasters.
d. Assist in enrolling AmeriCorps*VISTA members at Host Sites, support and guide host sites,
implement a national and statewide recruitment plan, assist host sites with recruiting,
monitor progress toward achieving project plan goals, assure compliance with VISTA

regulations, and host networking calls and training sessions for VISTA members and
supervisors.
e. Provide support to AmeriCorps*VISTA members in administrative matters such as enrolling in
AmeriCorps, in-service benefits and accessing their education awards.
f. Retain full responsibility for the management and fiscal control of the project.
2. The Host Site will:
a. Provide CYCA with the agreed upon cost -share contribution of $1,700 per VISTA within 30
days of the VISTA(s) placement at the Host Site. Payment plans are available. Contact CYCA
for details.
b. Submit Position Descriptions and Volunteer Assignment Descriptions (VADs) to CYCA for
approval prior to the hire of an AmeriCorps*VISTA member. The Position Description and
VAD will be available for use by the AmeriCorps*VISTA member during their term of service.
c. Recruit, locally and nationally, an AmeriCorps*VISTA member.
d. Provide daily supervision and designate a site supervisor who will be responsible for guiding
the VISTA through their term of service. This supervisor, if they have not done so already, will
attend a four -day Supervisor Orientation sponsored, and paid for, by the Corporation.
e. Provide an in-depth, on -site orientation for all VISTA members at the beginning of their term
of service.
f. Participate in quarterly conference calls with the Sponsor at which they can share best
practices for garnering community input and raising funds to support their program.
g. Provide day-to-day supervision of the activities of the AmeriCorps*VISTA members.
h. Provide on-the-job transportation for AmeriCorps*VISTA members. Host Sites that own
employee vehicles can allow VISTA members to use the vehicles for business travel.
Otherwise, Host Sites will reimburse the member for mileage at the current Federal Mileage
Rate. If travel is required, the VISTA member must have a clean driving record, a current
driver's license and a willingness to travel to fulfill the goals of their VAD.
i. Provide a work station, phone, computer, materials and supplies to allow AmeriCorps*VISTA
members the ability to perform their assigned duties.
j. Be responsible for ensuring their VISTA member submits quarterly progress reports to the
Sponsor.

k. Provide funds for the VISTA member to engage in professional development activities during
their term of service. In addition, Host Sites will budget for additional travel and training
costs for their members' professional development.
I. Provide a 60 -day performance review and exit interview of their AmeriCorps*VISTA member.
m. Notify the Sponsor immediately regarding unscheduled termination of AmeriCorps*VISTA
members and unscheduled changes of status and conditions of AmeriCorps*VISTA members,
such as arrests, hospitalization, and absence without leave.
n. Maintain such records and accounts, and make such reports and investigations, concerning
matters involving AmeriCorps*VISTA members and the project as the Corporation may
require. The Host Site agrees to retain such records as the Corporation may require for a
period of three years after completion or termination of the project, or longer if required for
administrative proceedings and/or litigation purposes, and to provide access to such records
to the Corporation for the purpose of litigation, audit, or examination.
o. Allow AmeriCorps*VISTA members to participate in local emergency disaster relief efforts if
needed.
p. Allow AmeriCorps*VISTA members to participate in (or organize) Days of Service, i.e., Martin
Luther King, Jr. Holiday, National Volunteer Week, Make A Difference Day, should activities
be organized in the communities where the members are in service.
q. Not supplement monetary subsistence allowances directly to AmeriCorps*VISTA members.
3. Joint Responsibilities
Both parties to this Memorandum of Understanding shall:
a. Make every reasonable effort to ensure that the health and safety of the AmeriCorps*VISTA
members are protected during the performance of their assigned duties. Neither the Sponsor
nor the Host Site shall assign or require AmeriCorps*VISTA members to perform duties which
would jeopardize their safety or cause them to sustain injuries.
b. Ensure that persons selected as AmeriCorps*VISTA members are not related by blood or
marriage to project staff, sponsor staff, officers or members of the sponsor's Board of
Directors, or responsible Corporation program staff.
4. Non -Discrimination
No person with responsibilities in the operation of the project shall discriminate against any
AmeriCorps*VISTA member, or member of the staff of, or beneficiary of the project, with respect

to any aspect of the project on the basis of race, religion, color, national origin, sex, age, disability,
or political affiliation.
5. Legal Restrictions
The Host Site agrees that no AmeriCorps*VISTA member assigned under this Agreement shall
participate in or funds from the Corporation used in, the following activities when they would
result in the identification of such programs with:
a. Partisan and non-partisan political activities, including voter registration.
b. Direct or indirect attempts to influence passage or defeat of legislation or proposals by
initiative petition.
c. Labor or anti -labor organization or related activities.
d. Religious instruction, worship services, proselytization, or any other religious activity as an
official part of their duties.
6. The Host Site further agrees not to:
a. Carry out projects resulting in the identification of such projects with partisan or non-partisan
political activities, including voter registration activities, or providing voters transportation to
the polls.
b. Assign AmeriCorps*VISTA members to activities that would result in the displacement of
employed workers, or impair existing contracts for services.
c. Accept, or permit the acceptance of compensation from the AmeriCorps*VISTA members or
from beneficiaries for the service of the AmeriCorps*VISTA members.
d. Approve the involvement of any AmeriCorps*VISTA member assigned to it in planning,
initiating, participating in, or otherwise siding or assisting in any demonstrations whatsoever.
7. Modifications
This Memorandum of Understanding may be amended at any time by an agreement in writing
executed by authorized representatives of the Sponsor and the Host Site.
8. Duration
This Agreement is for one year, and shall become effective on July 27, 2009, after execution of this
Agreement. The date of execution of this agreement is the date that the final signatory for either

party signs and dates this Agreement. This Agreement is subject to performance of the terms as
set forth in this Agreement, in Part 2. Activity on the project shall be deemed to have begun on
7/27/2009 and shall end thereafter on 7/26/2010, unless terminated sooner by either of both
parties.
9. Termination
The Sponsor or Host Site may terminate, suspend, or decline to renew this Agreement at any time
by giving 30 days notice in writing to the other of its intent. In addition, the Corporation may
terminate, suspend, or decline to renew this Agreement in accordance with applicable terms and
procedures set forth at 45 CFR Part 1206 or 42 W.S.C.§ 4953(g).
Any termination of the Memorandum of Agreement between the Sponsor and the Corporation will
result in the termination of all provisions of this Memorandum of Understanding except for
paragraph 2.h.
