"ANNEXATION IMPACT REPORT
Gray's Annexation"
1. A statement setting forth the plans of the municipality for extending to or otherwise
providing for, within the area to be annexed, municipal services performed by or on
behalf of the municipality at the time of annexation;
"The Town of Johnstown has adopted general master plans for the extension of water
lines and appurtenant facilities, sanitary sewer mains and treatment facilities, stormwater
facilities, road maintenance, police protection, parks and recreation and library services to
the area proposed for annexation, which is within the Johnstown Planning Area as
described on exhibit A."
2. A statement setting forth the method under which the municipality plans to finance the
extension of the municipal services into the area to be annexed;
" Johnstown plans to finance extension of the above mentioned municipal services to the
area proposed for annexation through a variety of means, including subdivision
improvement requirements, impact fees capital improvement programs, and arrangements
with special districts."
3. A statement identifying existing tax districts within the area to be annexed;
4. A statement on the effect of annexation upon local public school district systems,
including the estimated number of students generated and the capital construction
required to educate such students.
The project is in the Weld County RE -5J school district.
At a gross density of 3 du/acre, it is anticipated 320 may be built. At .71 students
per house, a total of 227 students will be generated by the project.
5. A map (or maps) of the municipality and adjacent territory to show the following
information:
a. The present and proposed boundaries of the municipality in the vicinity of the
proposed annexation;
b. The present streets, major trunk water mains, sewer interceptors and outfalls,
other utility lines and ditches, and the proposed extension of such streets and
utility lines in the vicinity of the proposed annexation (from Town master plans)
c. The existing and proposed land use pattern in the areas to be annexed (Outline
Development Plan);

Background and setting
The Gray Property contains approximately 133.9 acres, and is located on the northeast
corner of Country Road 17 and County Road 44. The property to be annexed is vacant,
except for one well located on the northwestern portion of the land. The land is gently
rolling, and provides excellent views of the Rocky Mountains to the west.
County Road 17, also known as Parish, forms the western boundary of the property. It is
a paved road. On the west side of Parish is Riverbend Estates. The entire Riverbend
Estates is approved for a total of 388 units. Riverbend Estates Filing One, which is
currently built, is made up of 123 single family homes. The zoning for Riverbend Estates
is PUD-R, which is the same zoning designation being requested for the Gray
Annexation.
Country Road 44 forms the southern boundary of the property. It is currently a dirt road.
The property to the south, Pioneer Village, also known as the Rohmsdahl Annexation, is
currently annexed, and undeveloped. It is also zoned PUD-R. The northern boundary
abuts annexed land, and is also undeveloped. Property to the east is not annexed, and is
currently farm land.
The property to the north of this Grays Annexation is also annexed to the City of
Johnstown. This property is known as Red Mountain 3 & 4. That property consists of
approximately 144.7 acres and is currently undeveloped.
Land Use
At this point in time, the Johnstown Parish is going to be locating their new church
facility on the 10 acre parcel at the corner of County Road 17 and County Road 44. The
church will ultimately seat approximately 600 parishioners. Preliminary size of the
church is anticipated to be approximately 10,800 square feet. Parking of approximately
200 spaces will also be located on the site.
Density
The balance of the property, which is approximately 108.9 acres, is anticipated to be low
density residential development. At a general gross density of approximately 3 dwelling
units per acre, that would allow 320 single family homes.
Access and Circulation
Primary access into the Gray Property from the west will be opposite the existing
intersection of Country Road 17 and Mallard Drive to the west. The main access from
the south (on County Road 44) will be on the eastern edge of the church parcel. It will be
located over 600' to the east of County Road 17. Please see the ODP Master Plan for
road and land use layout.
Open Space
The Gray Property, once developed, will meet all open space requirements required by
the City of Johnstown. At this point, it is premature to identify exact locations of parks,
trails, and other public open space areas.
Substantial Benefit of Annexation
The annexation of the Gray Property will provide substantial benefit to Johnstown. It
will bring into the town limits a parcel that is currently surrounded on three sides by the
Town of Johnstown. This will allow for a more compact development pattern, and allow
more efficient use of water, sewer, roads, and public services.
At the time a final plan is determined in the future, there will be parks included in the
development as required by the Town of Johnstown. There is no plan at the moment for
the balance of the land outside of the 10 acre church parcel, and it is premature to
determine the exact layout and nature of the development, and the location of parks. It is
anticipated that any parks improvements will be reviewed by the Johnstown staff to
insure all requirements are met.

PUBLIC HEARING NOTICE
NOTICE IS HEREBY GIVEN that a petition for Annexation of territories hereinafter
described as the Grays Annexation has been presented to the Town Council of
Johnstown, Colorado and found to be in apparent compliance with the applicable
provisions of law and the Town Council has adopted a Resolution to set a public hearing
to be held at 7:00 p.m. on Monday, November 2, 2009 in the Council Chambers of the
Town of Johnstown, 450 South Parish, Johnstown, Colorado to determine if the proposed
annexation complies with the applicable requirements of law.
The Resolution adopted by the Town Council for such purposes is in words, letters
and figures as follows:
TOWN OF JOHNSTOWN
RESOLUTION NO. 2009-13
WHEREAS, a written petition, together with five (5) prints of an annexation map,
was heretofore filed with the Town Clerk requesting the annexation of certain property to
be known as the Gray's Annexation, more particularly described as situate in the County
of Weld, State of Colorado, to wit:

WHEREAS, The Town Council desires to initiate annexation proceedings in
accordance with the law.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF JOHNSTOWN. COLORADO:
Section 1. That the Town Council hereby accepts said annexation petition, finds and
determines that the annexation petition and accompanying map are in substantial
compliance with CRS 31-12-107. and desire to initiate annexation proceedings in
accordance with law.
Section 2. The Town Council shall hold a hearing to determine if the proposed
annexation complies with CRS 31-12-104 and 31-12-105 or such parts thereof as may be
required to establish eligibility for annexation under the terms of Part 1, Article 12, Title
31, CRS. A hearing shall be held on the 2°d day of November, 2009, in the Council
meeting room of the Town ofJohnstown, 450 South Parish, Johnstown. Colorado, at 7:00
p.m.
Section 3. The Town Clerk shall publish notice of such hearing once per week for
four (4) successive weeks in the Johnstown Breeze, with the first publication at least
thirty (30) days prior to the date of the hearing. The Town Clerk shall also send a copy of
this resolution and the petition for annexation to the Clerk to the Board of County
Commissioners, the County Attorney and to any special district or school district within
the area proposed for annexation.
PASSED, APPROVED AND ADOPTED this 21st day of September, 2009.

A public hearing to zone the property will also be held at this time. The owners are
requesting a PUD-R (Planned Unit Development -Residential) zoning of the property.
