I have attached the Board of County Commissioners meeting minutes and Resolution. You will also be mailed a copy of it from the Clerk to the Board. Public Works and I have reviewed the paper plat. Public Works has no comments and I have the following 1. I have spoken with Tim B. with CDOT and he said that Highway 85 in that area is 160 feet of existing right- of-way (80 feet from the centerline). This will need to be shown on the plat map. 2. When making the copy a couple of the signature blocks were cut off and there is a lot of faint drawing marks on the drawing. You will need to make sure that this doesn't occur on the final submitted drawing. 3. Once the right-of-way for highway 85 is delineated please show the sign location that is 20' from the edge of the right-of-way (using a dot/star/circle with a line to it stating 'sign location'). 4. please rotate the legend to read left to right 5 please change the legend for the dumpster location to a square and make the same change on the plat 6. five parking spaces are required plus one handicap accessible spot (6 total). 7. please label the overflow parking area as gravel Once these changes are made you can print the map onto mylar paper. The mylar along with the recording fee of $11.00 for one page can be submitted once the remaining two Conditions of Approval have been addressed. Condition of Approval 1.B — regarding an agreement with the mineral owners of the property. Condition of Approval 1.1— regarding the improvements on site. I recall that you didn't want to post collateral for the improvements and were actually going to do all the work prior to recording the mylar. Regarding your sign question below, CDOT has no setback requirements whatsoever. So long as the sign is fully on private property and only advertises the coffee shop available on -site there are no additional steps you must complete on CDOT's end. We regulate on -premise signage but do not issue permits for it like counties/towns do. THANKS! 5/20/2009 May 15, 2009 Jacqueline Hatch c/o Weld County Planning Dept. 4209 CR 24.5 Longmont, Colo. 80504 Jacqueline, regarding the conditions for USR 1693 as requested on pages 2, and 3 of the resolution recommended after the May 5th 2009 meeting with the planning commission. 1. A. Photograph of actual sign provided. B. Certified letter was sent to and received by Rod Peterson of the Union Pacific Railroad in Omaha Nebraska. He indicated that they have no problem with the development. C. All concerns have been addressed with the State of Colorado Division of Water Resources. On May 1, 2009 a new well permit was issued. Permit #280528. D. CDOT has issued access permit # 408136. Overflow parking is directly north of the paved area and is a road base material. E. An Evaluation of Existing Individual Sewage Disposal System was conducted by John Batka P.E. with the Division of Water Resources, Division 1. The report was submitted to the Weld County Dept. of Public Health and Environment to their satisfaction. Septic system permit # SE -0900009. All issues regarding the use of a cistern have been addressed. A letter was sent to the Department on May 14, 2009 to the attention of Denise Carter asking to vacate the cistern permit numbered CP09-001. F. The area around the site is planted in native grasses and fescues. There is a paved parking area. Adjacent to the paved area is an overflow parking area. This area is covered with a hard packed road base material. There is very little if any dust generated in this area. G. A letter was sent requesting vacating cistern permit # CP09-001 to the attention of Denise Carter. H. 1. The primary waste will be paper products and the volume on a daily basis will be minimal. 2. The only chemicals kept on site will be typical household cleaning agents for use in cleaning floors, countertops, tables, glass etc. Also we will be controlling weeds with Round Up weed killer. 3. The waste handler will be Flyte Sanitation Inc, 410 County Rd. 128 A, Cheyenne Wyoming 82007. 307-635-0184. Waste will be disposed into the Laramie County Landfill, Cheyenne, Wyoming. I was under the impression that I would receive my bldg permit on or near the date of the county commissioners meeting. In reading through this letter it looks as though I have a lot of preliminary work to do before that happens referenced by section #1, prior to recording the plat, and section #6. Is it possible to get all of this done within the required 30 days after the boards resolution to avoid another $50.00 fee? Are all of these delineations going to be required or is it possible to waive some of them? I would hope that you and I can meet, or over the phone go over everything line by line so I know exactly what I have to do. I'm running out of money and know I have substantial fees yet to pay and am hoping that I can get this store open by the end of June. I appreciate your thoughts.
