The parcel of land is described as part of the NEa of Section 3, T4N, R68W of the 6th P.M. , Weld County, Colorado. Said property is located at the southwest corner of the junction of Interstate 25 and State Highway 60. The subject property contains 129.97 acres of predominately Class II irrigated soils. The request is to split the property into parcels of 3.77 acres and 126.20 acres. Each of the two resulting parcels would contain an existing set of improvements. As stated by Mr. Lebsack in a letter dated July 26, 1976, Mr. Lebsack' s intent is to demolish the labor house located on Lot B of the recorded exemption in order to clear the land for agricultural production. Mr. Lebsack' s farm improvements are located across the road where he owns 360 acres. Based upon the information submitted and the adopted policies in the County, the Planning Commission staff recommends the request be approved for the following reasons: 1 . The proposed split conforms with the intent clause of the recorded exemption procedure (Sec. 9-2 of the Weld County Subdivision Regulations), the intent clause of the agri- cultural zone district (Sec. 3.3A of the Weld County Zoning Resolution), and the Weld County Comprehensive Plan since each resulting parcel would have an existing set of improvements and the stated intent is to promote agricultural production on Lot B of the recorded exemption. In'l. _.. t .. 23 July 1976 Planning Department of Weld County Gentlemen: This letter is in support of my application to parcel off approximately three and one-half acres, and the improvements thereon, from a farm I have just purchased in Section 3, Township 4, Range 68 West, Weld County, Colorado. This property is purchased for agricultural production uses and fits in with my farming program. With inflationary trends, I desire to sell off the three acres and improvements in order to reduce the capital investment required without substantially affecting the productive capacity of the farm. I do not, at this time or in the foreseeable future, expect to request further sub- division of the property and have contracted to sell the parcel and improvements subject to your approval. Gregg, Jr. is hereby authorized to sign the application for recorded exemption in my behalf. Additional information regarding myself and my proposed use of the remaining land is in order. You should know that I am a lifelong resident of Larimer County and I have farmed the property adjoining this property and it has been my home for over 25 years. Further, my father before me operated in the same area. You should also be aware that I have farmed the subject property as a tenant for a number of years and it is my intention to continue this farming operation as an owner. This farm purchase and the request for the recorded exemption fit in with my farming program. It is my present intention to demolish the remaining set of improvements, known as the help house, in order to clear that land for agricultural production. My residence and main set of farm improvements are adjacent to this property, across the road, and will continue to be my place of residence. My wife and I have been staunch supporters and leaders in the 4-H program for many years and are sensitive to the needs of the agricultural community in our area. I am also a member of the Thompson R2-J school board. We have no immediate or future plans for subdivision of the remaining land. It is simply a matter of the improvements being surplus to our needs for agricultural purposes. We will look forward to a favorable ruling on the part of the County Commissioners. Right of Way Due consideration should be given to the preservation of at least 150 feet of minimum right of way (75 feet each side of center line) that will be needed for improvement of the highway system. Any additional right of way needed to meet this requirement should be protected by reservation, setback or dedication (preferably the latter) as local zoning laws and regulations permit. Approaches Driveway Permits will be required by the Division if: 1. additional driveways are wanted 2. existing driveways are relocated These Permits are available through Mr. Dave Fraser, District Maintenance Superintendent, P. 0. Box 850, Greeley, Colorado 80631. Requests for Driveway Permits should include a sketch of the proposed location indicating width of driveway, distance from property lines, and distance in miles from a prominent land mark (road intersections, bridges, towns, etc.) as well as the State High- way number. It should be noted that this is an application for a permit and all requests are cleared through the local entity prior to the Division's approval. Drainage A change in drainage patterns which will result in an increased runoff or rate of runoff onto Highway right of way will not be allowed. H. 256 Watson-Exemption DOH FILE 04-41 Mr. Kenneth McWilliams Page Two July 29, 1976 Environmental Due consideration should be given to what impact the traffic on the high- way will have on noise and air pollution levels at the site of any development. As a general rule for meeting Noise Standards, residental improvements should generally be setback a minimum of 160 feet to 210 feet from centerline and business improvements should generally be setback a minimum of 110 feet to 160 feet from centerline, unless some other type of noise abatement measures (walls, earth berms, noise insulated walls and windows, etc.) are constructed. A more specific determination can be made only after the parameters for the highway involved are evaluated. As might be expected, the degree of air pollution decreases as the dis- tance from source increases. Although this item consists of so many variables, such as meterology, emission valves, etc. , there are presently no definite parameters to so by.
