THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of
the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance
with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect.
Section 22-4-140.A EP.Goal 2. states: "Mineral resource exploration and production waste
facilities should be planned, located, designed and operated to encourage compatibility with
surrounding land uses in terms of items such as general use, scale, height, traffic, dust, noise
and visual pollution."
Section 22-4-140 EP.Policy 2.1. states "In reviewing the operational and reclamation

plans for solid and brine waste disposal facilities, the County should impose such
conditions as necessary to minimize or eliminate the potential adverse impact of the
operation on surrounding properties and wildlife resources."
The applicant is required to make improvements to County Road 34 and County Road 49
to address traffic safety and dust impacts generated by the facility. In addition, the
applicant is required to submit a Lighting Plan and a Screening Plan to address
compatibility and mitigate impacts on surrounding properties.
B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A
(Agricultural) Zone District. Section 23-3-40.A.2 of the Weld County Code provides for Oil
and Gas Support and Service as a Use by Special Review in the A (Agricultural) Zone
District.
C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the
existing surrounding land uses. The facility is located immediately west of the Horton
Feedlot (USR-1152 for up to 5,000 head approved in 1999). The nearest residence is
located approximately 825 feet to the west of the site (north of County Road 34). There
are approximately 7 residences along County Road 49 located approximately 2,300 feet
to 3,300 feet from the site. Oil and gas improvements (tanks batteries) are located
immediately to the north of the proposed facility. Vacant land (with oil and gas
improvements) are located immediately to the north and south of this site. The applicant
is proposing to place the facility in a location that is lower in elevation than the adjacent
battery tanks located immediately to the north. Attached Conditions of Approval and
Development Standards (screening plan, lighting plan...) will help to ensure that the
proposed use is compatible with the surrounding area.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the
future development as projected by Chapter 22 of the Weld County Code and any other
applicable code provisions or ordinances in effect, or the adopted Master Plans of
affected municipalities. The existing site does not lie within the three mile referral area of
any municipality.
E. Section 23-2-220.A.5 -- The application complies with Section 23-5 of the Weld County
Code. The existing site is not within a recognized overlay district, including the Geologic
Hazard, Flood Hazard or Airport Overlay District. Effective January 1, 2003, Building
Permits issued on the proposed lots will be required to adhere to the fee structure of the
County Road Impact Program. (Ordinance 2002-11). Effective August 1, 2005, Building
Permits issued on the proposed lots will be required to adhere to the fee structure of the
Capital Expansion Impact Fee and the stormwater/drainage impact fee. (Ordinance 2005-
8 Section 5-8-40)
F. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The proposed site
is designated as "other" per the 1979 Soil Conservation Service Important Farmlands of
Weld County Map.
G. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code),
Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and
Development Standards ensure that there are adequate provisions for the protection of
health, safety, and welfare of the inhabitants of the neighborhood and County.

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the following:
1. Prior to recording the plat:
A. The plat shall be prepared per Section 23-2-260.D of the Weld County Code.

B. All sheets of the plat shall be labeled USR-1708. (Department of Planning Services)
C. The plat shall be amended to delineate the following:
1) The attached Development Standards. (Department of Planning Services)
2) The approved Screening Plan. (Department of Planning Services)
3) County Road 34 is designated on the Weld County Road Classification Plan as a
local paved road, which requires 60 -feet of right-of-way at full build -out. The
applicant shall verify the existing right-of-way and the documents creating the
right-of-way. Existing and/or future right-of-way shall be identified. (Department of
Public Works)
4) WCR 49 is classified by the County is a Strategic Roadway, which requires a 140 -
foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This
road is maintained by Weld County. An additional 40 feet from the centerline of
County Road 49 shall be delineated on the plat as future County Road 49 right-of-
way. The applicant shall verify the existing right-of-way and the documents
creating the right-of-way. Existing and/or future right-of-way shall be identified.

5) The landscaping (seeding) plan. (Department of Planning Services)
6) The approved Lighting Plan. (Department of Planning Services)
7) Add a note stating "Weld County shall not be responsible for the maintenance of
drainage related structures." (Department of Public Works)
D. All required Air Emissions Permits must be filed with the Air Pollution Control Division,
Colorado Department of Public Health and Environment. Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services. (Department of

E. A Ground Water Monitoring Plan shall be submitted to the Weld County Health
Department of Public Health and Environment for review and approval. Evidence of such
shall be submitted in writing to the Weld County Department of Planning Services.

F. A Storm Water Discharge Permit for construction activities shall be submitted to the
Colorado Department of Public Health and Environment for review and approval.
Evidence of such shall be submitted in writing to the Weld County Department of Planning

G. The applicant shall address the requirements (concerns) of the Weld County Department
of Public Works, as stated in their referral response dated August 13, 2009. Evidence of
such shall be submitted in writing to the Weld County Department of Planning Services.
These requirements and concerns include but are not limited to:
• Providing the construction drawings acceptable to the County for the requested
road improvements which include:
o Paving WCR 34 between WCR 51 and WCR 53
o A westbound left turn deceleration lane on WCR 34
o A southbound left turn deceleration land on WCR 49 onto WCR 34
o A right turn acceleration land on WCR 49
o A right turn deceleration lane on WCR 49
o Paving the internal roadway and parking lot and widening of the site
access to 60 foot radiuses.
Providing an updated traffic study
Providing a final drainage report and final site grading plan
Providing an offsite geotechnical report acceptable to the County that includes
pavement designs for offsite paving improvements. (Department of Public

H. Evidence that the existing well has been converted from residential to commercial use for
this facility shall be provided to the Department of Planning Services. (Department of
Planning Services)
The applicant shall enter into an Improvements Agreement (On -site and Offsite)
According to Policy Regarding Collateral for Improvements (Lone Star Saltwater Disposal
Facility USR-1708). Collateral will be posted for both the on -site and offsite work to be
completed. The agreement and form of collateral shall be submitted for and reviewed by
the Departments of Planning Services and Public Works and accepted by the Board of
County Commissioners prior to recording the Use by Special Review plat. Or the applicant
may submit evidence that all work has been completed and approved by the Departments
of Public Works and Planning Services. (Departments of Public Works and Planning

J. The applicant shall submit a Screening Plan to the Department of Planning Services for
review and approval. (Department of Planning Services)
K. A lighting plan, including cut sheets of the intended lights, shall be provided to the
Department of Planning Services for review and approval. The lighting plan shall adhere
to the lighting requirements for off-street parking spaces per Section 23-4-30.E of the
Weld County Code and shall adhere to the lighting requirements in accordance with
Section 23-3-360.F and 23-2-250.D of the Weld County Code. Further, the approved
lighting plan shall be indicated on the plat. (Department of Planning Services)
L. The applicant shall submit an agreement between the surface developer and the mineral
owners and/or lessees or provide evidence that an adequate attempt has been made to
mitigate their concerns. (Department of Planning Services)
2. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. (Department of Planning Services)

3. The Special Review activity shall not occur nor shall any building or electrical permits be issued on
the property until the Special Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder. (Department of Planning Services)
4. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office
of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall
be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from
the date of the Board of County Commissioners resolution. The applicant shall be responsible for
paying the recording fee. (Department of Planning Services)
5. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files
format type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable).

6. Prior to the Release of Building Permits:
A. A building permit shall be obtained prior to the construction of any new building, tanks or
support facilities. (Department of Building Inspection)
B. A building permit application must be completed and two complete sets of plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report performed by a
registered State of Colorado engineer shall be required. (Department of Building
Inspection)
C. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following codes have been adopted by the County and
are being enforced: The 2006 International Building, Residential, Plumbing, Mechanical,
Fuel Gas and Energy Conservation Codes, the 2008 National Electrical Code.

D. A plan review shall be approved and a permit must be issued prior to the start of
construction. (Department of Building Inspection)
E. A letter is required from the Platte Valley Fire Protection District as to whether a fire
permit will be required. (Department of Building Inspection)
F. A concrete secondary containment structure (floor and walls) surrounding each tank or
battery of tanks shall be constructed. The volume retained by the structure shall be 150%
greater than the volume of the largest tank inside the structure. A registered professional
engineer shall design the structure. The structure shall prevent any release from the tank
system from reaching land or waters outside of the containment area. The operator shall
provide evidence from the engineer to the Weld County Department of Public Health and
Environment and Planning Services that the structure has been constructed to meet this

G. A detailed design of the "concrete unloading pad" shall be submitted to the Weld County
Department of Public Health & Environment for review and approval. The design shall
demonstrate how all spilled wastes, stormwater and wash down water will be contained
within the receiving area and concrete sump. The design shall also include the method in
which seams will be sealed to prevent leakage through the pad. A leak detection system
shall be designed and installed beneath the "concrete unloading pad". The "concrete

unloading pad" shall be constructed and operated in accordance with the approved

H. A copy of the drilling log shall be submitted to the Weld County Department of Public
Health and Environment. (Department of Public Health and Environment)
An individual sewage disposal system (I.S.D.S.) permit is required for sewage flow from
the proposed operations building. The system must be designed by a Colorado
Registered Professional Engineer and in accordance with Weld County I.S.D.S.
regulations. The design must be submitted to the Weld County Department of Public
Health and Environment for review and approval prior to installation. (Department of

J. Solids and sediment will accumulate in the storage tanks. The facility shall submit a
detailed plan that describes the method those solids will be removed, including all on -site
handling procedures and disposal. Any amendments to the approved plan shall be
submitted in writing to the Weld County Department of Public Health and Environment for
approval. The plan shall be reviewed and approved by the Department of Public Health
and Environment. (Department of Public Health and Environment)
K. A detailed closure plan shall be submitted to the Department of Public Health and
Environment and the Colorado Oil and Gas Conservation Commission. The closure plan
shall include a description of the manner in which the well will be plugged and abandoned,
as well as specific details regarding reclamation of the property. No structures or
equipment associated with the facility shall remain on the property following closure.

L. The facility shall post financial assurance with the Colorado Oil and Gas Conservation
Commission (COGCC). The financial assurance shall be adequate to cover a third -party
closure of the facility, including the plugging and abandonment of the well, in accordance
with industry standards, and the removal of all structure (including concrete) on the
facility. The site shall be returned to its original grade. In the event the COGCC does not
have the authority to require financial assurance for the entire cost required for third -party
closure, the facility shall post the remainder of the financial assurance with Weld County.
The facility shall submit evidence to the Weld County Departments of Public Health and
Environment and Planning Services that the appropriate financial assurance has been

6. Prior to Final Approval of Building Permits:
A. The applicant shall submit evidence to the Weld County Department of Public Health and
Environment, Weld County Planning Services and the Colorado Oil and Gas
Conservation Commission (COGCC) that the facility was constructed in accordance with

1. The Site Specific Development Plan and Special Review Permit for an Oil and Gas Support
Facility (Class II Oilfield Waste Disposal Facility) in the A (Agricultural) Zone District and subject to
the Development Standards stated hereon. (Department of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur. (Department of Public Health and Environment)
4. A manager, knowledgeable in operating an injection well, shall be on site when the facility is
receiving waste. (Department of Public Health and Environment)
5. Any individual sewage disposal system (I.S.D.S.) on the property shall be permitted, installed,
maintained and operated in compliance with all provisions of the Weld County Code, pertaining to
I.S.D.S. (Department of Public Health and Environment)
6. Adequate drinking water, hand washing, and toilet facilities shall be provided. (Department of

7. No disposal of waste other than Class II, as defined by the Environmental Protection Agency, is
permitted. Any changes from the approved Class II use would require an amendment to this
Special Review permit. (Department of Public Health and Environment)
8. Any wastes generated on the facility shall be disposed in accordance with the Colorado solid
Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation, or law. (Department

9. The maximum permissible noise level shall not exceed the industrial limit of 70 dB (A), as
measured according to Section 25-12-103, CRS. (Department of Public Health and Environment)
10. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of
Public Health and Environment)
11. All chemicals stored on -site must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations. (Department of Public Health and Environment)
12. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air
permits issued by the Colorado Department of Health and Environment Air Pollution Control
Division. (Department of Public Health and Environment)
13. All liquid wastes received at the facility shall be unloaded on the unloading pad. The concrete
unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building
up on the pad. At a minimum, the pad shall be pressure washed daily to remove any waste build-
up. During winter months, the facility shall maintain the unloading pad free of ice. (Department of

14. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental
Health Services Division. The Division reserves the right to require additional, more extensive
monitoring at a later date. (Department of Public Health and Environment)

15. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-
100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination. (Department of Public Health and

16. Any petroleum -contaminated soils on the facility shall be removed, treated or disposed in
accordance with all applicable rules and regulations. (Department of Public Health and

17. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the Permit by the Board of County Commissioners. (Department of

18. The facility shall comply with the approved groundwater monitoring plan. (Department of Public
Health and Environment)
19. All storm water, which has come into contact with waste materials on the site, shall be confined on
the site. In the event that storm water is not adequately controlled on the site, upon written
notification from the Weld County Department of Public Health and Environment or the Colorado
Department of Public Health and Environment, a comprehensive site -wide storm water plan shall
be developed and implemented. The plan must be approved, in writing prior to implementation by
the Weld County Department of Public Health and Environment and the Colorado Department of

20. The operation shall be comply with all applicable rules and regulations of the State and Federal
agencies and the Weld County Code. (Department of Public Health and Environment)
21. No parking or staging of commercial vehicles shall be allowed on County roads. (Department of

22. The maximum number of employees employed at the site shall be six (6). (Department of
Planning Services)
23. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2006 International Building
Code; 2006 International Residential Code; 2006 International Mechanical Code; 2006
International Plumbing Code; 2006 International Fuel Gas and Energy Code; and the 2008
National Electrical Code and Chapter 29 of the Weld County Code.

24. Hauling hours shall be limited to 7:00AM until 7:00PM daily. (Department of Planning Services)
25. The Landscaping on site shall be maintained in accordance with the approved Screening Plan.

26. Sources of light, including light from high -temperature processes such as combustion or welding,
shall be shielded so that light rays will not shine directly onto adjacent properties where such
would cause a nuisance or interfere with the use on the adjacent properties; and
Neither direct nor reflected light from any light source may create a traffic hazard to operators of
motor vehicles on public or private streets and no colored lights may be used which may be
confused with or construed as traffic control devices. (Department of Planning Services)
27. Effective January 1, 2003, Building Permits issued on the lot will be required to adhere to the fee
structure of the County wide Road Impact Fee Program. (Department of Planning Services)

28. Effective August 1, 2005, Building Permits issued on the proposed lots will be required to adhere
to the fee structure of the Capital Expansion Impact Fee and the stormwater/drainage impact fee.

29. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Section 15-1-40 of the Weld County Code.
32. The property owner or operator shall be responsible for complying with the Design Standards of

Chris: Please provide the applicant the following comments:
This Department considers the application complete enough to move forward in the process.
The septic permit and stormwater permit application forms are of little use to the
Department at this time. The applicant should submit application for a commercial septic
permit with their perc test results prior to construction. A SWMP should be developed and
the stormwater permit application submitted to the CDPHE-WQCD prior to construction
activities.
It may be premature to comment on the design of the unloading pad and tank battery
containment, since I don't have detailed plans but please share the following with the
applicant:
All produced water processing and storage tanks (all tanks except fresh water) shall be on
an impervious pad and have secondary containment. The unloading pad area shall be
impervious and have containment for all washdown water and ability to contain spillage
from the largest tanker offloading. See typical comments below:
A concrete secondary containment structure (floor and walls) surrounding each tank or
battery of tanks shall be constructed. The volume retained by the structure shall be 150%
greater than the volume of the largest tank inside this structure. A registered
rofessional engineer shall design the structure. The structure shall prevent any release
om the tank system from reaching land or waters outside of the containment area. The
perator shall provide evidence from the engineer to the Weld County Dept. of Public
Health and Environment (WCDPHE) indicating that the structure has been constructed to meet
this criterion.
A detailed design of the "concrete unloading pad" shall be submitted to WCDPHE for review
and approval. The design shall demonstrate how all spilled waste, stormwater and wash
down water will be contained within the receiving area and concrete sump. The design
shall also include the method in which seams will be sealed to prevent leakage through the
pad. A leak detection system shall be designed and installed beneath the "concrete
unloading pad". The "concrete unloading pad" shall be constructed and operated in
accordance with the approved design.

SUBJECT: 7 -Day Completeness Review for Lonestar Saltwater Disposal Facility
Weld County Public Works has received the submittal application for the 7 Day Completeness Review. This phase of the
planning process is a content review of the submitted materials, NOT a technical review. Comments made during this
phase of the process will not be all-inclusive, and will address the critical issues of concern including but not limited to the
Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit.
The Public Works Department will perform a detailed technical review of the project once the submittal application is
deemed acceptable and is promoted to the review phase of the planning process.
Weld County Road Classification Plan (FHU): (June 2002) WCR 34 is a local paved road and requires a
60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
Our most recent ADT count for WCR 34 reflects 279 vehicles taken in 2007. The 85th percentile indicates that the
average speed is 54 miles per hour with 48 % of the traffic being trucks.
�eld County Strategic Roadway: (December 2002) WCR 49 is classified by the County is a Strategic
oadway, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27,
37, 49 and 74)
Our most recent ADT count for WCR 49 reflects 4,000 ± taken in 2009. The 85th percentile speed is 71 miles per hour
with 35% truck traffic.
Improvements Agreement: There will be two improvements agreements with this proposal. The first will be a
designated haul route associated with truck traffic. The second will be an improvements agreement according to policy
regarding collateral for improvements. This will be on -site improvements.
Site Plan: If the facility is going to be fenced, the entrance gate needs to be recessed the length of a typical WB50 semi
truck. There will be staging or parking on WCR 34 prior to entering the facility. A stop sign will be placed in the
appropriate location prior to entering on to the county road.
Traffic Study: The applicant has submitted a Traffic Study that was signed, stamped, and dated by Matthew L. Kruse,
P.E. # 41484. A technical review was not performed on this Traffic Study. A technical review of the study will occur when
an official application is submitted. Although turn lanes are not warranted based on the proposed traffic volumes Public
Works is requesting acceleration and deceleration lanes to account for:
• The heavy trucks in use which require longer acceleration and deceleration times and lengths as compared to
passenger vehicles
• Public safety the 85th percentile is 71mph on WCR 49 and there have been 15 accidents in the past 3 yrs with 3
•injuries.
• Also for consistency with similar projects in the county which had the requirement of acceleration and
decelerations lanes.
• •
lieliminary Drainage Report: The applicant has submitted a preliminary drainage report that was signed, stamped, and
aced by Daniel Dean Hull, P.E. # 39337. A technical review was not performed on this drainage report. A technical
review of the report will occur when an official application is submitted.
Geotechnical Report: The applicant has submitted a Geotechnical Report for the onsite conditions which was stamped,
dated, and signed by Joels C Malama, P.E. # 42184. The report does not appear to address offsite conditions for the
county roads bordering the site. If upgrades are required to the county roads, it will be necessary to provide a
Geotechnical Report that addresses the offsite conditions so the design of the roadway improvements can be reviewed.

On Thursday, November 13, 2008 an informal discussion took place at the Greeley
Administrative Offices Conference Room regarding the proposed brine water disposal facility.
(The legal description is part of Section 18, Township 3 North, Range 64 West of the 61h P.M.; Situs
Address is 15988 CR 49, LaSalle)
Background Information:
The applicant is proposing a brine water disposal facility. The site encumbers approximately
37.327 acres.
There will be an office building located on site and will be manned 24/7. The applicant is
proposing one employee on site and an additional two employees during normal operating
hours.
Due to the topography of the land the applicant is proposing to gate the existing access to the
Noble Energy wells and install a new access to the east of the existing access for safety
precautions. The applicant has visited with Curt Moore of Noble Energy in regard to this matter
as well as some adjustments to the layout of the proposed facility.
The applicant is proposing 4 off-loading bays. The injection well will be located outside the
drilling envelopes; but close to the proposed tank farm.
The applicant indicated that this proposed facility mirrors the existing Conquest facility on CR 39
and CR 28.
The closest neighbor is located south of and adjacent to the site. According to the applicant he
has attempted to contact the neighbor on two occasions without any success to date.
The applicant has had discussions with Art Gutterson of Gutterson Ranches with regard to
gaining their traffic and to keep the traffic off of CR 49. The applicant stressed that he will
decrease the amount of traffic on CR 49 by working with Gutterson Ranches on this project.

Health
The applicant indicated that there is a well for the house and buildings located west of the
proposed facility. Previously the buildings were utilized for a dairy operation and the applicant is
not sure at this time if the well was classified as domestic or commercial use. If approved by the
state the applicant intends to pipe water over from this well to his proposed facility.
The applicant indicated that he would like to self -monitor the operation. Staff commented that
the Health Department would like the applicant to consider having a third party monitoring
system.
Public Works
Access is from CR 34. Applicant is proposing 60 trucks or 120 trips per day. Public Works will
require a 60 foot radius at the access point as well as pave the first 100 foot into the site and
double cattle guards for full tire rotation.
A Site Plan identifying the circulation and parking will be required.
A Traffic Study will be required. Xcell/decell lanes will also be required at the intersection of CR
49 and CR 34. The applicant expressed some concern on the xcell/decell lanes as he proposes
to decrease the amount of traffic on CR 49.
Public Works will require a Preliminary Drainage Report and a Geotechnical Report if they need
to do retention ponds.
The site does not appear to be a in a FEMA designated floodplain; therefore no Flood Hazard
Development Permit will be required.
Planning
The applicant indicated that he has an Oil and Gas Permit to drill and is proposing to drill at the
end of the first quarter 2009. He expressed that he would really like to expedite the process to
fulfill his expected timeline.
Staff explained the USR process - that the applicant shall submit 4 packets for our 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the applicant complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.

Improvements
Section states that the applicant is identifying approximately 180 round trips (total) per
day
• The traffic report states approximately 60 round trips (total) per day
Upgrading to pavement of WCR 34 between WCR 51 and WCR 53, one mile
• Comments state WCR 34 had an AADT count of 279 vehicles taken in 2007
• Of these 279 vehicles, 237 of these were trucks (85%)
• This number would go up based on the proposed site, there would be an
additional 72 truck trips (36 entering/36 exiting, 60% of the generated traffic) the
site from the east, the portion Weld County is requesting paved
• The anticipated AADT once the Lonestar facility is opened would be 351
vehicles, with 309 of these vehicles being trucks. This would represent an
approximately 25% increase in the total traffic and a 30% increase in the truck
traffic
Paving of the internal roadway (truck circulation pattern) parking lot and widening of
the site access drive radii to 60 feet shall be required.

A westbound left turn lane deceleration lane on WCR 34
• Weld County Public Works was contacted to find out what standards or warrants
are used to determine deceleration and acceleration lanes. Weld County Public
Works referred to the Colorado Department of Transportation reference "State
Highway Access Code" due to the nature of the rural roads and high speeds seen
on the roads near the proposed site.
• According to section 3.8 Category R -A Regional Highway and section 3.9
Category R -B Rural Highway from the "State Highway Access Code" the
following are auxiliary lane requirements:
o A left turn deceleration lane with taper and storage length is required for
any access with a projected peak hour left ingress turning volume greater
than 10 vph.
o A right deceleration lane and taper length is required for any access with a
projected peak hour right ingress turning volume greater than 25 vph.
o A right turn acceleration lane and taper length is required for any access
with a projected peak hour right turning volume greater than 50 vph when
the posted speed on the highway is greater than 40 mph.
o A left turn acceleration lane may be required if it would be a benefit to the
safety and operation of the roadway or as determined by subsection 3.5.
• During the peak hour of operation, a very conservative estimate was used to
create a "worse case" scenario of 15 trucks entering the proposed facility with 10
of those coming from the east on WCR 34 and turning left into the site. Even
with this very conservative approach the left turn deceleration lane would not be
warranted by what is included in subsection 3.8 and 3.9 because the requirement
is greater than 10 vph, which will most likely not be the case.
• In subsection 3.5 it states that the auxiliary lane may be dropped if the 20th year
predicted roadway volumes are at a certain threshold. The threshold for a left turn
deceleration lane is if the opposing vehicles are below 100 DHV the deceleration
lane may be dropped.WCR 34 only has an AADT of 279 vehicles and in 20 years
is not anticipated to increase in traffic to be above this threshold.
• Based on this analysis the left turn deceleration lane is not warranted based on the
state access code.
A southbound left turn lane deceleration lane on WCR 49 on to WCR 34
• Again the Colorado Department of Transportation "State Highway Access Code"
was referred to as above.
• Based on the latest traffic counts that were conducted, there was an hour in the
AM collection period, from 8:00 am to 9:00 am that experienced 11 left turning
movements, this didn't show up in the peak hour diagram because the peak hour
for the entire intersection was from 7:00 am to 8:00 am. This volume appears to
show that the intersection already needs a left turn deceleration lane at this
intersection, without any traffic from the proposed development.
• In the year 2030 full build -out scenario, the AM and PM peak hours the left
turning movement is anticipate to be at 12 and 13 vehicles respectively, thus
tripping the threshold for a left turn deceleration lane in that design year for the
peak hour of the intersection.

Traffic Study Comments
There are sight distance issues at the intersection of WCR 34 and WCR 49 due to rolling
hills in the area
• If there is a sight distance problem, this is a design deficiency of Weld County
and currently a potential safety concern for the vehicles currently on the roadway.
• This roadway should have been properly designed to provide adequate sight
distance by Weld County.
The applicant has indicated that this site will produce 180 trips per day
• The traffic report states approximately 60 round trips (total) per day.
No parking or staging of commercial vehicles on the county road is allowed
• This is a valid request
A stop sign will be required to be installed at the access before traffic will enter onto
WCR 34
• Agree with this comment
The access will have 45' radius to accommodate the larger trucks enter and exiting the
site
• Improvement section calls the radii to be 60', need clarification from Weld
County.
A westbound left turn deceleration is warranted on WCR 34 into the project site access
based on the turning movement figures in the traffic study

A southbound left turn deceleration is warranted on WCR 49 onto the WCR 34 based on
the turning movement figures in the traffic study

Although turn lanes are not warranted on WCR 49 based on the proposed trip volumes
supplied in the traffic study, public works is requesting a right turn acceleration lane and
a right turn deceleration lane on WCR 49 to account for:
• The heavy trucks in use which require longer acceleration and deceleration times
and lights as compared to passenger vehicles
• Public safety the 85" percentile speed is 71 mph on WCR 49 and there have been
6 accidents in the past 4 years
• Also for consistency with similar projects in the county which had the requirement
of acceleration and deceleration lanes
o The proposed site is anticipated to add 2 trucks to the northbound right
turn lane and 3 trucks to the westbound right turn lane in the peak hours.
o Currently there were 4 vehicles observed making the northbound right turn
movement in the AM peak hour and 10 vehicles making the westbound
right turn movement in the PM peak hour. 85 percent of the traffic on
WCR 34 is truck traffic, using this percentage 3 of the 4 vehicles turning
right onto WCR 34 are trucks making the existing movement and 8 out of
the 10 vehicles making the right turn from WCR 34 to WCR 49 existing
are trucks

PRE -APPLICATION REVIEW REQUEST
The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.
